Article 22. Procedure for Concluding Agreement with Right Holders

After the decision of the Jokargy Kenes of the Republic of Karakalpakstan, the local Kengash on the withdrawal of the land plot adopted, the Council of Ministers of the Republic of Karakalpakstan, the khokimiyat of the relevant region, Tashkent city or district (city) shall work with the right holders to reach an agreement on the terms, types and amount of compensation.

After reaching an agreement between the Council of Ministers of the Republic of Karakalpakstan, the khokimiyat of the relevant region and the city of Tashkent or district (city) and the right holder, a bilateral agreement shall be signed, which shall be notarized and sent to the territorial departments of the Chamber of State Cadastres through a special information system integrated into the “Integrated information system of the cadastre and registration”, as well as a ban on the alienation of immovable property located on this land plot shall be imposed.

The agreement shall provide for the types, amount and time limit for providing compensation, as well as the time limit for vacating of the immovable property object after the provision of compensation in full. In this respect, the time limit for vacating an immovable property shall be calculated from the date of provision of compensation in full and should not exceed six months.

In the event of the death of the right holder after the conclusion of the agreement, the rights and obligations under the agreement shall pass to their heirs in proportion to their shares in the inheritance.

In the event of the death of the right holder before the conclusion of the agreement, negotiations related to the conclusion of the agreement shall be held with their heirs on a common basis. The composition of the heirs and the share of each of them in the inheritance shall be determined on the basis of a certificate of the right to inheritance, in the event of a dispute, they shall be determined by the court.

After signing the agreement, the alienation of objects of immovable property located on the withdrawn land plot shall be allowed with the written consent of the Council of Ministers of the Republic of Karakalpakstan, the khokimiyat of the relevant region, Tashkent city or district (city) or in case of termination of the agreement (in the manner established in the agreement, with the consent of parties or in court).
