Article 21. Procedure for Adoption of Decision on the Withdrawal of Land Plots

Within one month after the submission to the Jokargy Kenes of the Republic of Karakalpakstan, local Kengash of the protocol drawn up on the basis of the results of an open discussion, the apparatus of the Jokargy Kenes of the Republic of Karakalpakstan, the secretariat of local Kengashes shall prepare a draft decision of the Jokargy Kenes of the Republic of Karakalpakstan, local Kengash on the withdrawal of land plot.

The draft decision of the Jokargy Kenes of the Republic of Karakalpakstan, local Kengashes on the withdrawal of a land plot shall indicate:

geographical coordinates of the land plot to be withdrawn;

grounds and purpose of the withdrawal of the land plot;

information about objects of immovable property located on the site to be withdrawn, subject to demolition, and their owners;

description of the project and work to be carried out on the withdrawn land, including information about the facilities to be built, the timing of the start and completion of the project and work;

other issues related to the withdrawal of a land plot, including the provision of compensation to right holders.

The draft decision of the Jokargy Kenes of the Republic of Karakalpakstan, the local Kengash on the withdrawal of a land plot shall be sent, respectively, to the Ministry of Justice of the Republic of Karakalpakstan, the department of justice of the region and the city of Tashkent through a single electronic system for the development, agreeing and registration of decisions of local executive authorities “E-qaror” for review and issuance of a legal opinion on the compliance or non-compliance of this draft decision with the requirements of this Law.

The Ministry of Justice of the Republic of Karakalpakstan, the Department of Justice of the region and the city of Tashkent, within ten working days, shall conduct a legal examination of the draft decision of the Jokargy Kenes of the Republic of Karakalpakstan, the local Kengash on the withdrawal of a land plot and, based on the results, issue an appropriate legal opinion.

In the event that the Ministry of Justice of the Republic of Karakalpakstan, the department of justice of the region and the city of Tashkent issues a negative opinion on the draft decision of the Jokargy Kenes of the Republic of Karakalpakstan, the local Kengash on the withdrawal of a land plot, the draft decision may be resubmitted for issuance of an opinion after the identified deficiencies have been eliminated. The re-introduced draft decision shall be considered on a general basis.
