Article 20. Procedure for Holding Open Discussion with Right Holders

The Jokargy Kenes of the Republic of Karakalpakstan, local Kengashes shall hold an open discussion with the right holders within a month from the date of adoption of the relevant decision.

The initiator must send a written notice to the right holders indicating the time and place of the open discussion after two working days from the date of the adoption by the Jokargy Kenes of the Republic of Karakalpakstan, local Kengashes of the decision to hold an open discussion, but not less than seven days before the open discussion.

Right holders should also be notified of the time and place of the open discussion through publishing announcements, respectively, on the official website of the Council of Ministers of the Republic of Karakalpakstan, the khokimiyat of the relevant region, Tashkent city or district (city) and in other media, as well as on the official data pages of government agencies in social networks.

An open discussion shall be organized by the initiator, and mandatory audio and video recording of the open discussion process shall be ensured. An open discussion should be organized with the participation of the media. The initiator must ensure the presence of the media at the open discussion.

Restriction of audio, photo and video recording of the open discussion process shall not be allowed.

The venue of the open discussion should be located near the place of residence or location of the majority of the right holders.

The initiator must ensure that right holders (their representatives) can participate online in an open discussion.

An open discussion shall be considered held if two thirds of the right holders (their representatives) participate in it.

In the course of an open discussion, the initiator must familiarize the right holders (their representatives) with the goals, conditions and prospects for the withdrawal of this land plot for public needs and listen to their opinion.

Based on the results of the open discussion, the initiator shall draw up a protocol, which shall be signed by the representative of the initiator and all right holders (their representatives) who participated in the open discussion.

The protocol shall indicate the place, time of the open discussion, the composition of the participants, the agenda, and the opinions expressed during the discussion. The protocol shall be accompanied by a list of representatives of the initiator and right holders (their representatives) who participated in the open discussion, as well as an audio and video recording of the open discussion process.
