Article 3. Basic Concepts

The following basic concepts shall be applied in this Law:

substantiating materials mean documents containing information about the land plot planned for withdrawal for public needs with compensation, objects of immovable property located on it (including the condition of residential and non-residential premises, their current purpose), confirming the compliance of the goals of the land plot withdrawal with the purposes recognized as public needs, as well as containing a description and time limits for the implementation of the project and the work that are planned to be carried out on this land plot;

land plot means a part of the land fund that has a fixed border, area, location, legal regime and other characteristics reflected in the state land cadastre, including land plots on which multi-apartment buildings are located, which is provided in the prescribed manner to individuals and legal entities, respectively, on the right of lifetime inheritable possession, permanent possession, permanent use, fixed-term (temporary) use, lease;

right holder of a land plot and objects of immovable property located on it (hereinafter referred to as the right holder) means an individual or legal entity that has the right of lifetime inheritable possession, permanent possession, permanent use, fixed-term (temporary) use, lease of a land plot and the right of ownership of an object of immovable property located on this land plot, on the basis of title documents;

initiator of the withdrawal of a land plot for public needs with compensation (hereinafter referred to as the initiator) means the republican government bodies, the Council of Ministers of the Republic of Karakalpakstan, khokimiyats of regions, the city of Tashkent or districts (cities);

agreement means a notarized written agreement concluded between the Council of Ministers of the Republic of Karakalpakstan, the khokimiyat of the relevant region, Tashkent city or district (city) and the right holder, respectively, by their consent, which provides for the amount, type and term of compensation;

compensation means reimbursement for losses to the right holder in monetary or other form in connection with the withdrawal of a land plot for public needs in the manner prescribed by this Law;

object of immovable property means buildings, structures, perennial plantings and other property firmly connected with the land, that means, objects that cannot be moved without disproportionate damage to their purpose. For the purposes of this Law, objects of immovable property do not include subsoil, including a mineral deposit.
