Article 10. State control over the use of the land parcel granted for maintaining a dehkan farm
On the dehkan farm (LRU-680-son) · Date: 01.04.2021 · In force
Control over the targeted and rational use of land parcels granted for maintaining a dehkan farm is carried out by authorized state bodies in the manner established by the legislation.
In the event the dehkan farm does not sow agricultural crops according to its specialization, the land tax is collected at three times the rate, except for the cases provided for in part two of Article 9 of this Law.
The reduction of soil fertility, soil contamination with chemical and radioactive substances, as well as the application of methods leading to the deterioration of the ecological situation by the Dehkan Farm, are grounds for bringing the dehkan farm to accountability in the manner established by the law.
In the event of the detection of buildings and structures, including underground structures, other than greenhouses and other buildings made of light constructions, as well as irrigation structures, on the land parcel granted for maintaining a dehkan farm, upon the written representation of the authorized state body, the head of the dehkan farm is obligated to voluntarily demolish these buildings and structures at his own expense within fifteen days from the date of receipt of the written representation of the authorized state body and restore the land parcel to its original state.
In the event that the head of the dehkan farm does not voluntarily comply with the written representation of the authorized state body, the issue of the demolition of the buildings and structures, including underground structures, and the restoration of the land parcel to its original state is resolved in a judicial manner.
In the event of the repetition of one of the cases provided for in parts two, three, and four of this Article, for three consecutive years, the issue of the withdrawal of the land parcel granted under the right of lifelong heritable possession, or the early termination of the lease (sublease) agreement, is resolved in a judicial manner.
The accountability of the dehkan farm and its members for the non-targeted and ineffective use of the land parcel granted for maintaining a dehkan farm is established by the legislation.
