Article 75. Enforcement measures
On administrative procedures (LRU-457-son) · Date: 08.01.2018 · In force
The administrative body, in cases provided for by law, has the right to apply the following enforcement measures:
monetary coercion;
implementation of the actions provided for by an administrative act, at the expense of the debtor, by an administrative body or another person;
direct coercion.
The enforcement measure must be formalized by an executive act of the administrative body. The application of enforcement measures without the adoption of an appropriate executive act is not allowed.
When assigning a compulsory enforcement measure, an administrative body must be guided by the principles of administrative procedures.
If the appointed measure of compulsory execution did not ensure the proper and timely execution of the requirements of the administrative act, the administrative body has the right to apply a more severe measure of coercion.
The law may also provide for other enforcement measures.
