Article 49. Postponement of consideration of an administrative case at a hearing
On administrative procedures (LRU-457-son) · Date: 08.01.2018 · In force
The grounds for postponing the consideration of an administrative case are:
failure to appear at the meeting of any of the interested persons in respect of which there is no information about the proper notification;
Satisfaction of an application for recusal of an official of an administrative body authorized to consider an administrative case, or his absence;
the absence in the meeting of interested persons participating in the administrative proceedings, without which the consideration of the administrative case is not possible;
non-appearance of interested persons, duly notified of the time and place of the meeting, for reasons recognized by the administrative body as valid.
The administrative body has the right to consider an administrative case in the absence of a duly notified interested person, if the administrative body recognizes the reasons for the failure to appear at the meeting as unreasonable, or there is reason to believe that the interested person deliberately delays the consideration of the administrative case.
Interested persons have the right to apply for the consideration of an administrative case in their absence.
The administrative body, postponing the consideration of the administrative case, appoints the time and place of the next meeting, which it announces to the persons who appear against receipt. Persons who did not appear at the meeting and are again involved in the consideration of the administrative case are notified of the time and place of the next meeting.
