Article 370. Grounds for denial of recognition and enforcement of the decision of foreign court and foreign arbitration court (tribunal)

The court shall deny recognition and enforcement of the decision of foreign court and foreign arbitration court (tribunal) either in full or in part, in the following events:

1) the decision under the law of the State on the territory of which it was rendered has not entered into legal force;

2) the party against which the decision was rendered was not timely and properly notified of the time and place of the consideration of the case or for other reasons was not able to provide the court with its explanations;

3) consideration of the case in accordance with international treaties or legislation of the Republic of Uzbekistan shall fall within the exclusive competence of the court of the Republic of Uzbekistan;

4) there is a decision of the court of the Republic of Uzbekistan adopted on a dispute between the same persons, on the same subject and on the same grounds, which has entered into legal force;

5) the case on a dispute between the same persons, on the same subject and on the same grounds is under consideration of the court of the Republic of Uzbekistan, the proceedings on which have been instituted before the commencement of the proceedings in the court of a foreign State;

6) the limitation period for presenting the decision of the foreign court or foreign arbitration court (tribunal) for enforcement has expired and this period has not been restored by the court;

7) a party presented evidence that the dispute was resolved by an incompetent foreign court;

8) the decision was cancelled by the competent authority of the foreign State;

9) the decision was rendered by the court of a foreign State that is not a party to the international treaties of the Republic of Uzbekistan related to the recognition and enforcement of the decision of the foreign court and the foreign arbitration court (tribunal);

10) the execution of the decision of the foreign court or foreign arbitration court (tribunal) will harm the sovereignty and security of the Republic of Uzbekistan or contradict the basic principles of the legislation of the Republic of Uzbekistan.

The recognition and enforcement of the decision of a foreign court or foreign arbitration court (tribunal) may also be denied on other grounds stipulated by international treaties of the Republic of Uzbekistan.
