Article 27010. The courtʼs decision

The decision of the court in a case concerning the return of a state-owned land plot unlawfully occupied and the demolition of an unauthorized construction shall be adopted by the court in accordance with the rules provided for in Chapter 23 of this Code.

If the claim for the return of the state-owned land plot unlawfully occupied is upheld by the court, in addition to the information specified in Articles 253, 255, and 256 of this Code, the operative part of the court decision must indicate:

1) the area and location (address) of the land plot being returned;

2) the state body to which the land plot is returned to its possession.

If the claim for the demolition of an unauthorized construction is upheld by the court, in addition to the information specified in Articles 253, 255, and 256 of this Code, the operative part of the court decision must indicate:

1) the address and description of the unauthorized construction;

2) the construction subject to demolition.

If the statement of claim contains both claims for the return of a state-owned land plot unlawfully occupied and for the demolition of an unauthorized construction, and these claims are upheld, the operative part of the court decision must include the information provided in parts two and three of this article.

The court decision concerning the return of a state-owned land plot unlawfully occupied and the demolition of an unauthorized construction shall enter into legal force ten days after its adoption, unless an appeal (protest) is filed.

A copy of the court decision in a case concerning the return of a state-owned land plot unlawfully occupied and the demolition of an unauthorized construction must be sent or handed over against signature to the persons involved in the case within three working days after the decision is adopted. If the electronic addresses of such persons are available, the decision may be sent in the form of an electronic document.
