Article 79. Measures of Liability

The Administration of the Center shall be entitled to apply to a person that has committed a violation of the acts of legislation on the International Digital Technologies Center the following measures of liability:

a written warning;

an order to perform certain actions or refrain from performing certain actions;

the imposition of an obligation to eliminate the violation and its consequences, including to compensate for damage caused or restore the position existing before the violation;

the return of benefit obtained as a result of the violation;

financial sanctions;

the temporary restriction of the conduct of certain types of activity or operations;

the application of urgent protective measures necessary to prevent or eliminate the violation or its consequences;

the temporary suspension or termination of the right to use the incentives and preferences provided for by the special legal regime of the Center;

the suspension or termination of the status of participant of the Center.

The measures of liability provided for by this Article may be applied in addition to financial sanctions or instead thereof in the cases established by resolutions of the Governing Council.

The application of measures of liability shall not relieve the offender of the obligation to eliminate the consequences of the violation and to compensate for the damage caused, in the manner established by the applicable law.

When selecting a measure of liability, its duration and amount, and the sequence of the application of measures of liability, the Administration of the Center shall be obliged to take into account the nature and consequences of the violation, the degree of culpability (where present), as well as the proportionality of the measure of liability applied to the violation committed.

The procedure for the identification of violations, the consideration of materials, the taking of resolutions, the lodging of appeals and the enforcement of measures of liability shall be determined by the resolutions of the Center within the framework of this Constitutional Law.
