If a decision adopted or a transaction concluded in the presence of a conflict of interests is recognized void, the profit obtained as a result of adopting such decision or concluding such transaction shall, by court procedure, be transferred to state revenue without requiring the return of everything received under the transaction. In this case, expenses related to the performance of such void transaction shall be reimbursed at the expense of the person who allowed the conflict of interests.
Losses caused to individuals or legal entities, including state bodies or other organizations, as a result of a decision or transaction being recognized void due to a conflict of interests may be recovered, in recourse (regress) order, from the culpable employees of the state body or other organization.
