Article 30. Procedure for Adopting Decision On Demolition of Immovable Property Located On Withdrawn Land Plot

After entering into a special information system integrated into the “Integrated Information System of the Cadastre and Registration” of documents confirming the provision of compensation, as well as after the expiration of the time limit for vacating the object of immovable property provided for in the agreement, the initiator shall submit to the Jokargy Kenes of the Republic of Karakalpakstan, local Kengashes a list of objects of immovable property located on the withdrawn land plot subject to demolition.

After the submission of a list of objects of immovable property located on the withdrawn land plot subject to demolition, the apparatus of the Jokargy Kenes of the Republic of Karakalpakstan, the secretariats of local Kengashes shall prepare a draft decision within fifteen days on the demolition of objects of immovable property located on the withdrawn land plot.

The draft decision of the Jokargy Kenes of the Republic of Karakalpakstan, local Kengashes on the demolition of objects of immovable property located on the withdrawn land plot should reflect the following:

number, date and source of publication of the decision of the Jokargy Kenes of the Republic of Karakalpakstan, local Kengash on the withdrawal of this land plot;

address list of objects of immovable property located on the withdrawn land plot subject to demolition;

date of commencement of the demolition of each object of immovable property located on the withdrawn land plot;

requirements for compliance with urban planning norms and rules established by legislation.

The draft decision of the Jokargy Kenes of the Republic of Karakalpakstan, the local Kengash on the demolition of objects of immovable property located on the withdrawn land plot shall be accompanied by:

copy of the agreement concluded between the Council of Ministers, the khokimiyat of the relevant region, Tashkent city or district (city) and the right holder;

documents confirming the provision of compensation in full to the right holders.

The draft decision of the Jokargy Kenes of the Republic of Karakalpakstan, the local Kengash on the demolition of an object of immovable property shall be sent to the Ministry of Justice of the Republic of Karakalpakstan, the department of justice of the relevant region and the city of Tashkent through a single electronic system for the development, agreeing and registration of decisions of local executive authorities “E-qaror” for review and issuance of a legal opinion on the compliance or non-compliance of the draft decision with the requirements of this Law.
