Article 25. Procedure and Terms for Providing Compensation

Upon withdrawal of a land plot on which the apartment building is located, by agreement of the parties, the right holder shall be granted ownership of another equivalent residential premises (apartment) with an area not lower than the social norm of the housing area, and as a rule, located in the same district (city) or in another district (city) at the choice of the right holder. At the request of the right holder, residential premises (apartment) can be provided in an apartment building being built on a withdrawn land plot. In this case, until the right holder is provided with this residential premises (apartment), they and their family members shall be provided with a comfortable other residential premises for temporary lease at the expense of the initiator.

Upon withdrawal of a land plot on which a non-residential object is located, by agreement of the parties, the right holder shall be granted ownership of an equivalent non-residential object with an area not less than the total area of the previous non-residential object, as a rule, located in the same district (city) or in another district (city) at the choice of the right holder. When providing a non-residential object in a facility being built on a withdrawn land plot, until the moment this non-residential facility is provided, the right holder shall be provided non-residential facility for temporary lease at the expense of the initiator.

Upon withdrawal of a land plot on which an individual residential building is located (including one not completed by construction, but registered in accordance with the established procedure), by agreement of the parties, the right holder shall be granted an equivalent individual residential building with an area not lower than the social norm of housing area, as a rule, located in the same district (city) or in another district (city) at the choice of the right holder. Until the right holder is provided with this individual residential building, they and their family members shall be provided with comfortable living quarters for temporary lease at the expense of the initiator.

Upon withdrawal of a land plot owned by the right holder on the right of lifetime inheritable possession, permanent possession, permanent use, fixed-term (temporary) use or lease, the right holder shall be paid monetary funds in the amount equal to the market value of the right to this land plot.
