Article 17. Procedure for Preliminary Consideration of the Initiative for the Withdrawal of Land Plots by the Jokargy Kenes of the Republic of Karakalpakstan, Local Kengash

The issue of compliance of the initiative to withdraw a land plot with public needs, provided for in Article 4 of this Law, and the rationality of the expected costs associated with the withdrawal of a land plot, shall be preliminary considered at the next open meeting of the Jokargy Kenes of the Republic of Karakalpakstan, local Kengash, convened after the submission of substantiating materials.
Based on the results of the preliminary consideration of the initiative to withdraw a land plot at the meetings of the Jokargy Kenes of the Republic of Karakalpakstan, the local Kengash, a decision shall be adopted to hold an open discussion of the initiative to withdraw land plots (hereinafter referred to as an open discussion) or to reject the initiative.
The decision to hold an open discussion should assess the following questions:
on the compliance of the initiative for the withdrawal of land plots with the requirements of Article 4 of this Law;
on the absence of another suitable land plot for the implementation of projects and works for the purposes established by the first part of Article 4 of this Law;
on compliance with the requirements, in accordance with which, first of all, land plots on which residential buildings and residential premises unsuitable for habitation, including due to physical wear and tear (with the exception of objects of material cultural heritage), unused objects (buildings, structures) are located shall be identified, and in case of non-identification of such land plots, other land plots shall be selected;
on the rationality of the expected costs associated with the withdrawal of land.
Meetings of the Jokargy Kenes of the Republic of Karakalpakstan, local Kengashes on preliminary consideration of the initiative to withdraw a land plot shall be held openly with the participation of representatives of the media and the public.
