Article 8. Principle of inadmissibility of discrimination
On trade unions (LRU-588-son) · Date: 06.12.2019 · In force
Affiliation or non-affiliation with trade unions does not entail any restriction of the labor, other socio-economic, political, personal rights, freedoms, and legitimate interests of citizens guaranteed by legislation. It is prohibited to condition employment, promotion, or the termination of an employment contract with a worker on affiliation with a specific trade union, or joining or withdrawing from it.
Written or oral obligations of a worker not to join a trade union or to withdraw from it are void.
A person who considers that they have been subjected to discrimination based on trade union affiliation or non-affiliation may apply to the court with a statement for the elimination of discrimination, compensation for material damage caused, and compensation for moral harm.
