Article 13. Right of ownership to common property
On management of multi-apartment houses (LRU-581-son) · Date: 07.11.2019 · In force
Common property belongs to the owners of premises on the right of common shared ownership.
The right of using common property does not depend on the share of the owner in the common property. Owners of premises have equal rights to use common property and the land plot adjacent to the house.
Separate parts of common property, except for those indicated in parts seven and eight of this article, may be transferred for use to owners of premises or other persons in the procedure established by the decision of the general meeting of owners of premises.
An owner of a premise using separate parts of common property exclusively in their own interests is obliged to make a payment for the maintenance of common property in the amount established by the decision of the general meeting of owners of premises.
In common property, the share of an owner of a premise cannot be allocated in kind.
Separate parts of common property, except for those indicated in parts seven and eight of this article, may be alienated based on a decision adopted unanimously by all participants of common shared ownership.
Common property is not subject to alienation or transfer for use to one or several owners, or other persons, if its alienation or transfer for use limits other owners in the realization of their property rights.
It is prohibited to alienate bearing and enclosing structures, inter-apartment stairwells, stairs, elevators, elevator and other shafts, intra-house engineering networks and communications, mechanical, electrical, sanitary-technical and other equipment and devices located outside or inside premises and serving more than one premise.
