Article 34. Suspension of the validity of a permit
On weapons (LRU-550-son) · Date: 29.07.2019 · In force
The validity of a permit may be suspended in the following cases:
when violations of the licensing requirements and conditions are identified by the permit holder;
when a court decision or an instruction from the internal affairs body imposing on the permit holder the obligation to eliminate the identified violations is not fulfilled.
The suspension of the validity of a permit shall be carried out by a court, and may also be carried out by the internal affairs body if the validity of the permit is suspended for a period not exceeding ten working days in connection with the prevention of the risk of loss or theft of weapons and their ammunition.
The decision of the internal affairs body to suspend the validity of the permit shall be communicated to its holder in written or electronic form (if available) no later than one working day from the date the decision is adopted, indicating the reasons for the suspension of the permit's validity and the specific norms of the legislation.
The court's decision to suspend the validity of the permit shall be communicated to its holder within the periods established by law.
The internal affairs body or the court must establish a deadline for the permit holder to eliminate the circumstances that caused the suspension of the permit's validity. In this case, the period established for the elimination of the circumstances that caused the suspension of the permit's validity must not be less than five working days.
The period of suspension of the permit's validity is not included in its total validity period.
In the event that the circumstances that caused the suspension of the permit's validity are eliminated by the permit holder, the internal affairs body or the court must adopt a decision to restore the permit's validity within five working days from the date a confirmation of the elimination of the specified circumstances is received.
The decision of the internal affairs body to suspend the permit's validity may be appealed to the court. If the court finds the suspension of the permit's validity to be unjustified, the internal affairs body shall be liable to the permit holder for the number of damages incurred by them.
