Article 65. Form and content of an administrative complaint
On administrative procedures (LRU-457-son) · Date: 08.01.2018 · In force
An administrative complaint is filed in writing, orally or electronically and must contain:
1) the name of the administrative body that adopted the administrative act;
2) last name, first name, patronymic and place of residence of the applicant (his/her representative) who filed the complaint, and for a legal entity — its name and location (postal address);
3) the requirements of the applicant;
4) list of attached documents (if any);
5) the date of submission of the application.
An administrative complaint is signed by the interested person or his representative. If the complaint is filed by a representative, a copy of the power of attorney or other document certifying his/her authority to sign the administrative complaint must be attached to him/her.
In cases provided for by law, an administrative complaint filed in defense of the rights and legitimate interests of other individuals and legal entities, in addition to the information listed in this article, must contain the name of the person (surname, name, patronymic) in whose interests the complaint is filed, and his address and other information provided by law.
Legislation may provide for other requirements for an administrative complaint and the documents attached to it.
The administrative body shall not have the right to present requirements to the administrative complaint and the documents attached to it that are not provided for by the legislation.
In case of oral appeal, an individual must present a document proving his/her identity, and a representative of a legal entity — a document confirming his/her authority and proving his identity.
Complaints submitted in electronic form must contain the electronic address and a single identifier of the applicant, and in cases provided for by law, an electronic digital signature and other details.
The indication of the electronic address in the complaint is the consent of the applicant to receive notifications in electronic form through the information system.
