Article 63. Procedure for administrative appeal
On administrative procedures (LRU-457-son) · Date: 08.01.2018 · In force
An interested person has the right to file an administrative complaint with a higher administrative body or with another authorized administrative body that, in accordance with the law, is authorized to consider administrative complaints, through the administrative body that adopted the appealed administrative act, procedural act or performed an administrative action.
The administrative body that received the administrative complaint, within three working days from the moment of its receipt, sends the administrative complaint to a higher administrative body or other body authorized to consider this administrative complaint, together with the administrative case.
In case of disagreement with the result of consideration of an administrative complaint against an administrative act in an administrative manner or in the absence of a higher administrative body, the interested person has the right to appeal against the administrative act in court.
The legislation may define another body to which an administrative complaint against an administrative act may be filed.
