Article 83. Restriction of parental rights
Family code of the Republic of Uzbekistan · Date: 30.04.1998 · In force
By taking into account the interests of the child, the court may decide to take the child away from the parents (or from one of them) without depriving them of their parental rights (restriction of parental rights).
Restriction of parental rights shall be allowed, if leaving the child with the parents (or one of them) is dangerous for the child due to the circumstances beyond the control of the parents (or one of them) (mental disorder or other chronic disease, concurrence of heavy circumstances, etc.).
Restriction of parental rights shall also be allowed in cases where leaving the child with the parents (or one of them) is dangerous for the child due to their behaviour, but no sufficient grounds for depriving the parents (or one of them) of parental rights are established. If the parents (or one of them) do not change their behaviour, the guardianship and trusteeship body shall - upon expiry of six months after the court ruling on the restriction of parental rights - bring an action for deprivation of parental rights. In the interests of the child, the guardianship and trusteeship body shall have the right to bring an action to deprive the parents (or one of them) of parental rights before this period expires.
An action for restriction of parental rights may be brought by the child's close relatives, bodies and institutions charged by law with the protection of the rights of minor children, preschool educational organizations, general educational institutions, and other institutions, as well as the prosecutor.
Cases of restriction of parental rights shall be considered with the participation of the prosecutor and the guardianship and trusteeship body.
When considering cases of restriction of parental rights, the court shall decide the issue of recovery of child support alimony from the parents (or one of them).
