Parents (or one of them) may be restored in parental rights in cases where they have changed their behaviour, way of life and (or) attitude to the upbringing of the child.
The restoration of the parental rights shall be exercised in the judicial order upon the suit of the parents (or one of them), deprived of the parental rights. Cases of the restoration of parental rights shall be considered with the participation of the guardianship and trusteeship body and the prosecutor.
Simultaneously with the suit by the parents (or one of them) claim for the restoration of parental rights, a claim for the return of the child to the parents (or one of them) may be considered.
By taking into account the child's opinion, the court may refuse to satisfy the suit by the parents (or one of them) for the restoration of parental rights, if the restoration of parental rights contradicts with the child's interests.
The restoration of parental rights in respect of a child who has reached the age of ten years shall be possible only with his/her consent.
Restoration of parental rights shall not be allowed if the child is adopted and the adoption has not been cancelled.
