Article 44. Issues to be resolved by the court in deciding on the dissolution of a marriage
Family code of the Republic of Uzbekistan · Date: 30.04.1998 · In force
In the judicial dissolution of marriage, the spouses may submit for court's consideration an agreement on spouses with whom minor children will live, on the order of payment of the maintenance of children and (or) a disabled spouse in need, and the amount of these funds or the division of the common property of the spouses.
In the absence of an agreement between the spouses on the issues specified in part 1 of this Article, as well as when it is established that this agreement violates the interests of children or either of the spouses, the court shall be obliged to:
determine with which of the parents the minor children will live after the dissolution of the marriage;
determine from which parent and in what amount alimony for the maintenance of minor children will be recovered;
execute division of property in their joint ownership at the request of the spouses (either of them);
determine the amount of the maintenance at the request of the spouse eligible to receive this maintenance from the other spouse.
If the division of property affects the interests of third parties, the court shall sever the claim for division of property in separate proceedings.
When considering a case for dissolution of marriage, claims for recovery of funds spent on the wedding shall not be satisfied.
