Family code of the Republic of Uzbekistan · Date: 30.04.1998 · In force
Through the marriage contract, the spouses shall be entitled to change the legally prescribed regime of common joint property (Article 23 of this Code) and establish the regime of joint, shared, or separate ownership for all of the property of the spouses or for its separate types, or on the property of each of the spouses.
The marriage contract may be concluded both in respect of the existing and in respect of the future property of the spouses.
Spouses shall be entitled to define in the marriage contract their rights and duties on shared maintenance, bearing of family expenses, participation in each-other's income, conclusion of property contracts with other persons, joint employment in entrepreneurship; to determine the property to be transferred to each of the spouses in the event of dissolution of the marriage; and to include in the marriage contract other provisions concerning the property relations of the spouses.
Rights and duties envisaged by the marriage contract may be limited to certain terms or be made conditional on the occurrence or non-occurrence of certain conditions.
The marriage contract may not limit the legal capacity or legal ability of the spouses; their right to appeal to the court for the protection of their rights; regulate the personal non-property relations between the spouses and the rights and duties of the spouses in respect of the children; involve provisions that restrict the right of the disabled spouse to receive maintenance; contain other conditions, which put one of the spouses in a highly disadvantaged position or contradict with the family legislation norms.
