Article 120. Exemption of a spouse from the duty to keep the other spouse or limitation of this duty to a certain period of time

The court may exempt a spouse, at his or her request, from a duty to keep other spouse who is incapable and in need of help, or limit this duty to a specified period of time in the following cases:

If the spouses have been married for a short period of time;

If the marriage has been dissolved as a result of disruptive conduct of the spouse requiring payment for own maintenance;

If the incapability of the spouse requesting payment for own maintenance was the result of his/her abuse of alcohol, narcotic drugs, or psychotropic substances or the commission of an intentional crime.
