Article 41923. Supplementing, amending, withdrawing the supervisory complaint and retracting the protest

The person who filed the supervisory complaint may supplement, amend, or withdraw it before the supervisory instance court retires to the deliberation room.

The prosecutor who lodged a supervisory protest, as well as a superior prosecutor, may supplement, amend, or retract the protest before the supervisory instance court retires to the deliberation room.

If the complaint is withdrawn or the protest is retracted, the supervisory instance court shall issue a ruling to terminate the proceedings on the supervisory complaint (protest).

The termination of proceedings due to the withdrawal of the complaint or the retraction of the protest shall not prevent the examination of another supervisory complaint (protest) filed by other persons regarding the same judicial document.
