Article 413. Completion, amendment of the cassation appeal (protest), withdrawal of the appeal and withdrawal of the protest

A person who has lodged a cassation appeal shall have the right to complete, amend or waive the appeal until the court of cassation enters the counseling office.

The prosecutor who filed the cassation protest, as well as the higher prosecutor, shall have the right to complete, amend or withdraw the protest until the court of cassation enters the deliberation room.

In case of rejection of the appeal and withdrawal of the protest, the court of cassation shall issue a ruling and terminate the proceedings in the cassation procedure.

Termination of the proceedings on the cassation appeal (protest) due to the waiver (its recall) shall not preclude consideration of another cassation appeal (protest) if the court document has been appealed by other persons.
