Article 4076. Suspension of Enforcement of the Judgment by the Cassation Instance Court

Upon the request of parties to the case, the cassation instance court (judge) may suspend the enforcement of the judgment rendered by the court of first instance until the completion of cassation proceedings, except in cases where the judgment is subject to immediate enforcement.

The suspension of enforcement shall be indicated in the ruling on acceptance of the cassation complaint (protest) for proceedings.
