Article 368. Striking-out of a claim on recognition and enforcement of a decision of foreign court and foreign arbitration court (tribunal)

The Court, having established, when resolving the issue of acceptance for proceedings of the claim on recognition and enforcement of a decision of foreign court and foreign arbitration court (tribunal), that it was filed in violation of the requirements of Articles 366 and 367 of this Code, shall return the claim and the attached documents to the recoverer.

The court shall render a ruling on the return of the claim.

The ruling, the application, and the documents attached thereto shall be sent to the claimant or his/her representative within five days from the date of rendering the ruling.

After elimination of the circumstances that served as the ground for the return of the claim, the recoverer shall be entitled to apply to the court again under a standard procedure.
