Article 340. Restoration of lost court proceedings

Lost court proceedings on the case may be restored by the court at the request of the persons participated in the case, the prosecutor, as well as upon the court's initiative.

Lost court proceedings shall be restored either in full or in a part necessary to restore in the court's opinion. The court decision or ruling on termination of the proceedings — if such were rendered on the case — shall be subject to necessary restoration.

The claimant shall be exempt from the payment of court costs incurred by the court during the consideration of the case on restoration of the lost court proceedings. If the claim was intentionally false, the court costs shall be recovered from the claimant.
