Article 322. Consideration of the case

The case of involuntary hospitalization of a person in a specialized department of a TB hospital or extension of the hospitalization period shall be considered by the court within three days from the date of application for involuntary hospitalization of a person in a specialized department of a TB hospital or extension of the hospitalization period, with the participation of a representative (member) of the medical commission of TB hospital where that person is registered or treated, a representative of the person with infectious form of tuberculosis, as well as the prosecutor. The person infected with a contagious form of tuberculosis, whose case is being considered in court may be summoned to the court session if his/her health condition allows it.

Failure to appear of a representative (member) of the medical commission of TB hospital or a representative of a person with contagious form of tuberculosis in the court session for an invalid reason shall not be an obstacle to the consideration of the case, but the court may consider the appearance of these persons obligatory.
