Article 305. Filing the application and the content thereof

The application of the person on recognition of the citizen as missing or declaring the citizen as dead shall be filed by the interested person with court at last known place of residence of the missing citizen.

The court shall proceed with consideration of the application on recognition of the citizen as missing or declaring the citizen as dead upon expiry of the time limits established by the legislation.

The purpose, for which the claimant needs a citizen having recognized missing or declared dead shall be specified in the application, as well as the circumstances confirming that the person is missing or circumstances threatening the missing person with death or giving the grounds to assume his/her death from certain accident shall be stated.
