Article 301. Preparation of case for court trial

When preparing the case for court proceedings, the judge shall render a ruling obliging the guardianship and trusteeship authorities at the place of residence (location) of the adopted child to present to the court an opinion on the validity and conformity of adoption to the interests of the adopted child.

The following documents shall be attached to the opinion of the guardianship and trusteeship authority on the validity and conformity of adoption to the interests of the adopted child:

Certificate of examination of living conditions of the adoptive parent/s, made by guardianship and trusteeship authority at the place of residence (location) of the adopted child or at the place of residence of the adoptive parent/s. It shall be obligatory to indicate in the certificate of examination of living conditions of the adoptive parent/s — among other information — whether there is an obstacle to adoption stipulated by Article 152 of the Family Code of the Republic of Uzbekistan;

Extract from the birth record of the adopted child;

Medical report on the health status and physical and mental development of the adopted child;

Consent of the adopted child who has reached the age of ten years to adoption, as well as to possible changes of his/her surname, name, patronymic and record of the adoptive parent/s as his/her parent/s, except for the cases stipulated in Article 156 of the Family Code of the Republic of Uzbekistan;

Consent of the parent/s of the child to his/her adoption, and also the consent of the legal representatives of the parents of the adopted child who have not reached the age of sixteen. In the event of absence of the legal representatives, the consent of the guardianship and trusteeship authority shall also be attached, except for the cases stipulated by Article 160 of the Family Code of the Republic of Uzbekistan;

Document confirming presence of information on the adopted child in a database on registration of children without parental care and candidates for adoptive parents, as well as documents confirming absence of possibility of transfer of the child for upbringing in a family of citizens of the Republic of Uzbekistan or for adoption by relatives of the child — in the event of adoption of the child by citizens of the Republic of Uzbekistan permanently residing outside the territory of the Republic of Uzbekistan, foreign citizens, or stateless persons who are not relatives of the child.
