Article 267. The right of the court to allow immediate execution of the decision
Civil procedure code of the Republic of Uzbekistan · Date: 22.01.2018 · In force
The court may allow immediate execution of the following decisions in whole or in part:
1) in the events when the plaintiff and the defendant agree with the decision made and its immediate execution;
2) on awarding of remuneration due to the author for the use of the results of his/her intellectual activity;
3) on all other cases, when, due to special circumstances, the delay in the execution of the decision may lead to significant damage for the recoverer or the execution itself may become impossible.
If immediate execution is allowed on the grounds specified in Item one of part one of this Article, the consent of the parties shall be recorded in the court session record. If the consent of the parties is expressed in written statements addressed to the court, these statements shall be attached to the case, with indication in the record of the court session.
Should the court admit an immediate execution on the grounds specified in Item 3 of part one of this Article, the court may request the plaintiff to ensure the reversal of execution of the decision in the event of cancellation of the court decision.
After the decision is made, within the time limits for appealing (protesting), the issue of the admission of immediate execution of the decision shall be considered in the court session with the notification of the persons participating in the case. However, the non-appearance of these persons shall not be an obstacle for consideration of the issue of immediate execution.
A ruling shall be rendered upon consideration of the matter of immediate execution of the decision.
A special complaint (protest) may be filed against the ruling on immediate execution of the decision. Filing a private complaint (protest) against the court ruling on immediate execution of the decision shall not suspend the execution of this ruling.
