Article 145. Caution and expelling from the courtroom
Civil procedure code of the Republic of Uzbekistan · Date: 22.01.2018 · In force
The presiding judge shall caution on behalf of the court a person who violates the order during the proceedings.
If a party or a third party violates the order in the court session, the court shall expel the offender from the courtroom for the whole duration of the court session or for a part thereof. In the latter case, the presiding judge shall make the person newly admitted to the courtroom aware of the procedural actions taken in his/her absence. If both parties and third parties violate the order of the court session, the court may postpone the trial of the case.
In case of repeated violation of order, the persons participating in the case, witnesses, experts, specialists, and interpreters may be expelled from the courtroom by the court's ruling, while the citizens present during the proceedings may be expelled from the courtroom by order of the presiding judge. In the event of a mass violation of order by citizens, the court may postpone the trial of the case.
A caution shall be given if prosecutor or lawyer disobey the orders of the presiding judge. In the event of further disobeying the orders of the presiding judge by the persons specified, the court may rule on postponing the hearing on the case if it seems not possible to replace the person in question without prejudice to the case. At the same time, the court shall render a special ruling, which shall be sent respectively to a higher public prosecutor or to the Qualification Commission under the territorial branch of the Chamber of Lawyers of the Republic of Uzbekistan.
