Article 144. Attachment
Civil procedure code of the Republic of Uzbekistan · Date: 22.01.2018 · In force
If a duly notified person — whose participation in the court proceedings is obligatory in line with Article 313 of this Code or his/her appearance is recognized by the court as obligatory — did not appear in court in cases stipulated by this Code without valid reasons or did not notify of the reasons for the failure to appear, the court may render a ruling on the application of the attachment measure. The execution of this ruling shall be the responsibility of the territorial internal affairs body. The costs for the attachment shall be recovered on the basis of the relevant application made by this territorial internal affairs body in the manner prescribed by this Code.
Attachment measure may not be applied to minors, pregnant women, and persons unable to appear in court due to illness, age or other valid reasons.
The court ruling on the attachment of a person — in addition to the information stipulated by Article 272 of this Code — shall specify the date, time and place to which the person is to be forcibly brought, as well as a territorial internal affairs body which is tasked with execution of attachment.
The court ruling on the attachment shall be subject to immediate enforcement and transferred to the territorial internal affairs body at the place of proceedings or place of residence, place of stay (location), place of work, service, or education of the person subject to attachment.
Appealing (protesting) of the court ruling on the attachment shall not suspend its execution.
