In order to provide social and material support to families included in the Social Register by allocating preferential loans within the framework of the implementation of the "From Poverty to Prosperity" program, as well as to ensure the implementation of the Resolution of the President of the Republic of Uzbekistan No. PR-330 dated September 23, 2024, "On priority measures for the implementation of the 'From Poverty to Prosperity' program," the Cabinet of Ministers hereby decides:

1. To approve the Regulation on the procedure for allocating loans to families included in the Social Register in accordance with the Annex, providing for:

The procedure for submitting and reviewing applications by families included in the Social Register;

The procedure for reviewing applications, scoring assessment, and issuing conclusions thereon;

The procedure for the allocation of loans and the maintenance of their monitoring by commercial banks for families included in the Social Register.

2. It shall be established that:

Unsecured loans for the purchase of laptops and small production equipment to start entrepreneurial activities, mobile shops (food trucks), motor scooters, scooters, and other similar fixed assets shall be allocated through the Unified Electronic Platform of Family Entrepreneurship Development Programs — "Oilakredit.uz";

Interest payments on loans allocated by commercial banks to families included in the Social Register shall be calculated at the interest rate within the framework of the Family Entrepreneurship Development Program, and these interest payments shall be compensated to commercial banks from the funds allocated from the State Budget to the State Trust Fund for Poverty Reduction;

For the allocation of loans to families included in the Social Register, a total of 250 billion UZS shall be directed in 2025 at the expense of the repayment of loans previously allocated within the framework of the Family Entrepreneurship Development Program in previous years.

3. The Central Bank, together with the Ministry of Poverty Reduction and Employment, shall ensure the integration of information systems and data exchange within a one-month period.

4. The Council of Ministers of the Republic of Karakalpakstan, the khokimiyats of regions and the city of Tashkent, together with the National Information Agency of Uzbekistan, the National Television and Radio Company of Uzbekistan, and commercial banks, shall take measures to ensure wide coverage of the essence and significance of this Resolution in the mass media and among the population.

5. Control over the execution of this Resolution shall be assigned to the Deputy Prime Minister of the Republic of Uzbekistan — Minister of Economy and Finance, J.A. Kuchkarov.

REGULATION

on the procedure for allocating loans to families included in the Social Register

Chapter 1. General Provisions

1. This Regulation determines the procedure for the allocation of loans by JSC "Xalq Bank" and JSCB "Mikrokreditbank" (hereinafter referred to as "commercial banks") to families included in the Social Register for the purchase of laptops and small production equipment to start entrepreneurial activities, mobile shops (food trucks), motor scooters, scooters, and other similar fixed assets within the framework of the "From Poverty to Prosperity" program (hereinafter referred to as the "Program").

2. The following basic concepts are used in this Regulation:

Assigned leaders — heads and deputy heads of organizations of the Republic of Karakalpakstan, regions, and the city of Tashkent, as well as districts (cities), assigned to families included in the Social Register who are in the most difficult situations;

Supplier — business entities registered in the prescribed manner in the marketplace system that supply goods selected by the borrower;

Marketplace system — an electronic trading platform that offers services for the free purchase or sale of goods (works, services) based on market principles at the expense of loans allocated on the platform and provides borrowers with the opportunity to independently select suppliers;

Platform — the Unified Electronic Platform of Family Entrepreneurship Development Programs (Oilakredit.uz), which ensures the allocation of loans within the Program in a fully digitalized form;

Conclusion — the conclusion of the assigned leaders on the allocation or refusal of a loan based on the borrower's application, issued after a field visit to study their capabilities, conditions, and sufficient knowledge and experience;

Borrower — individuals included in the Social Register who wish to become self-employed by starting an entrepreneurial activity.

3. Interest calculated for loans allocated by commercial banks shall be covered by the funds of the State Trust Fund for Poverty Reduction.

4. Loans for financing projects within the Program are allocated exclusively through the platform. In relation to loans within the Program, it is prohibited to bring and distribute goods to a member of a family included in the Social Register in a centralized manner without reviewing applications through the platform in the prescribed manner.

5. The operation of the platform is organized based on the integration of central databases of information systems of state administration bodies, economic associations, local executive authorities, and other organizations with the single identification system.

Chapter 2. Review of Applications through the Platform

6. Loan applications within the Program are submitted by the borrower independently or, if necessary, with the assistance of the "Mahalla Seven" through the platform. In this case, applications are sent according to the mahallas distributed among commercial banks within the framework of the family entrepreneurship program.

7. The borrower's compliance with eligibility requirements (inclusion in the Social Register, drafting of an individual plan) is verified through the "Online-mahalla.uz" electronic platform.

8. Applications for the allocation of loans are reviewed online on the platform at all stages, and information regarding the decision made at each stage is provided through the platform (Telegram bot, SMS notification, e-mail, or personal account).

9. The conclusion of the assigned leaders shall be the basis for the formalization of loan documents for the borrower within the Program. In this case, the funds paid by commercial banks for the loan non-repayment risk insurance policy shall be covered from the funds received for the interest of these loans at the expense of the funds of the State Trust Fund for Poverty Reduction. When the risk of non-repayment of preferential loans is insured by commercial banks, the insurance premium is calculated in an amount not exceeding 0.5 percent per annum.

10. Assigned leaders, together with the "Mahalla Seven" and commercial banks, shall establish a system of continuous monitoring and control over the effective use and timely repayment of preferential loans allocated within the Program.

Chapter 3. Scoring Assessment

11. Applications are accepted for review through the platform in an automated manner within one business day based on the results of scoring assessment according to established criteria.

12. An application shall be automatically rejected by the platform based on scoring data in the following cases:

Submission of an application by citizens not included in the Social Register;

When a previously submitted application of the borrower is in the process of review on the platform;

Submission of an application on behalf of a citizen under 18 years of age;

Submission of an application by foreign citizens and stateless persons who do not have a residence permit in the Republic of Uzbekistan;

Submission of an application on behalf of an incapacitated citizen or a citizen with limited capacity, or a citizen disabled for work;

Presence of an unpaid loan of the borrower within the Program;

Presence of an overdue debt of the borrower on loans received from banks or microcredit organizations;

Misuse of previously allocated loans;

Submission of an application by citizens who fail to fulfill their obligations established in the social contract on support measures for families included in the Social Register;

Presence of a negative credit history (credit history over the last 2 years is taken into account).

13. An application of a borrower that received a positive assessment according to the scoring result is sent through the platform to the assigned leaders for review.

14. Information on the scoring calculation methodology is published on the platform and is constantly updated based on amendments introduced as necessary.

Chapter 4. Issuance of Conclusion by the Assigned Leader

15. The assigned leader, based on the borrower's application, shall conduct a field visit within five business days to study the conditions, capabilities, and the presence of sufficient skills for the type of activity, and shall upload a photo report and a conclusion on the allocation or refusal of a loan to the platform based on the results of the study.

16. The assigned leader has the authority to make a decision taking into account the specific features and seasonality of the project being implemented before issuing a conclusion.

17. A positive conclusion shall not be issued in the following cases:

Lack of conditions for the borrower to implement the project;

When it is established that another citizen intends to receive a loan on behalf of the applicant;

Submission of an application for purposes other than those specified in paragraph 21;

Detection of activities that are contrary to legislation.

18. The reasons for refusal to allocate a loan must be specified in the conclusion issued by the assigned leader. Refusal to allocate a loan on grounds other than those specified in paragraph 16 of this Regulation is not permitted. Based on the positive conclusion of the assigned leader, the borrower's application is submitted to the commercial bank through the platform for review.

19. In the event that a commercial bank lacks sufficient resource funds, applications shall be maintained by the assigned leader in an electronic queue on the platform until resources are formed through the repayment of previously allocated loans and the allocation of additional funds.

20. The assigned leader shall ensure the provision of a laptop or fixed assets at the expense of loan funds and conduct a field study every quarter to ensure its targeted and effective use, drawing up an electronic act on the platform.

Chapter 5. Allocation of Loans by Commercial Banks

21. Loans shall be allocated to borrowers at the interest rate established within the framework of family entrepreneurship development programs, subject to the payment of a margin:

For the purchase of one laptop valued up to 15 million UZS — for a term of up to 5 years with a 2-year grace period;

For the purchase of small production equipment, mobile shops (food trucks), motor scooters, scooters, and other similar fixed assets valued up to 30 million UZS to start an entrepreneurial activity — for a term of up to 5 years on an installment basis. In this regard, the calculated interest shall be compensated to commercial banks at the expense of the funds of the State Trust Fund for Poverty Reduction.

22. Increased and (or) additional interest and forfeit (fines, penalties) shall not be calculated for overdue debts on loans allocated by commercial banks to borrowers. Borrowers have the right to repay the principal debt ahead of the terms established in the loan agreement. In this case, the commercial bank is prohibited from collecting commissions or forfeits from the borrower for early repayment of the principal debt.

23. In the event of detecting inconsistencies, errors, or deficiencies in the documents submitted to commercial banks for obtaining a loan according to the requirements of this Regulation, the allocation of the loan shall be rejected, and the assigned leader and the borrower shall be notified thereof through the platform.

24. The borrower may eliminate inconsistencies, errors, and deficiencies in the documents within 10 days and resubmit them to the commercial bank. When the deficiencies that served as the basis for the rejection of the submitted documents are eliminated by the borrower within the established period and submitted to the commercial bank, the review of the documents shall continue based on the initial application submitted by the borrower.

25. The decision on the allocation of a loan by commercial banks shall be made within a period not exceeding three business days; documents shall be generated and signed in electronic form. If the borrower does not sign the loan agreement submitted by the bank within 10 days, their application for a loan shall be rejected. In the event of rejection of the loan allocation by the commercial bank, the decision thereof, indicating the reasons for rejection, shall be uploaded to the platform.

26. When a decision on the allocation of a loan is made by commercial banks, an SMS notification shall be sent to the borrower regarding the selection of products to be purchased at the expense of the loan from the marketplace system.

27. After the loan agreement is signed between the commercial bank and the borrower, and the loan is transferred by wire to the supplier's account, the procedure for working with the marketplace system shall be carried out based on the requirements of the Regulation approved by the Resolution of the Cabinet of Ministers No. 373 dated July 8, 2022. When a loan is allocated to a borrower in cash or via a separately opened bank card, commercial banks shall ensure payment for platform services based on the requirements of the public offer.

28. The amount of loans allocated within the Program and the interest calculated thereon shall be generated online on the platform. In this case, interest on the loan shall be calculated for the funds actually paid based on the loan agreement after the product is received by the borrower.

Chapter 6. Procedure for Product Delivery

29. After the product is delivered, an electronic invoice shall be formalized by the supplier on the platform for the purpose of delivery and acceptance. The borrower shall sign the electronic invoice after receiving the product and being satisfied with it. In this regard, goods shall be delivered to the borrower on the basis of a cash register receipt with a fiscal sign.

30. The assigned leader shall be notified through the platform regarding the signing of the invoice. Within three business days, the assigned leader shall conduct a field visit and draw up an electronic act in the form of a photo report on the platform regarding whether the goods have been actually delivered or not.

31. A fully signed electronic invoice and an electronic act confirmed by the assigned leader shall serve as the basis for the commercial bank to make payment for these products. At the request of the borrower, payments for the purchased product shall be determined in accordance with the agreement of the parties in the product supply contract.

32. Payment for the delivered product shall be made by the bank within three banking business days by transferring funds to the supplier. Subsequently, the established fee for the services of the marketplace system shall be automatically collected from the supplierʼs earnest money (deposit) based on the public offer, and the remaining part of the earnest money shall be returned to the supplier.

33. When an electronic act regarding the non-delivery of the product is formalized by the assigned leader, they shall take necessary measures to ensure full fulfillment of the terms of the contract concluded between the borrower and the supplier or to terminate the contract.

34. When the terms of the contract are fully fulfilled by the supplier, the assigned leader shall conduct a repeat study within three business days and draw up a repeat electronic act in the form of a photo report on the platform.

If the case of non-delivery of products by the supplier is repeated, the assigned leader shall formalize an electronic act to cancel the conclusion, and the loan agreement shall be automatically terminated through the platform.

The procedure for excluding suppliers from participation in the marketplace system and their inclusion in the Register of Unscrupulous Suppliers shall be carried out based on the requirements of the Regulation approved by the Resolution of the Cabinet of Ministers No. 373 dated July 8, 2022.

Chapter 7. Procedure for Compensating Calculated Interest to Commercial Banks at the Expense of the Funds of the State Trust Fund for Poverty Reduction

35. A margin shall be calculated on loans allocated by commercial banks to borrowers at the interest rate established within the framework of the Family Entrepreneurship Development Program.

36. The amount of the margin on calculated interest shall be compensated at the expense of the funds of the State Trust Fund for Poverty Reduction by the end of each month, based on the list submitted by the 5th day of the following month, and by the 10th day (in accordance with paragraph 22 of this Regulation, increased and (or) additional interest and forfeits shall not be calculated for overdue debts, nor shall they be compensated by the Fund).

Chapter 8. Final Provisions

37. In the event that cases of misuse of loans allocated within the Program are detected, commercial banks have the right to early collection of loans in the prescribed manner.

38. If the loan debt received by the borrower from a commercial bank is not repaid for more than 90 days in accordance with the repayment schedule, it shall be collected in the manner prescribed by legislation.

39. Persons guilty of violating the requirements of this Regulation shall be liable in accordance with the procedure established by legislative acts.
