On the systematization of regulatory legal acts in the field of marriage, family, and civil status registration (550-son)

RESOLUTION
OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN
In recent years, large-scale work has been carried out in our Republic to improve the quality of law-making activities, update the institutional and legal framework of the ongoing reforms, and repeal norms that have become outdated or lost their significance.
At the same time, the rapid development associated with systemic changes in legislation necessitates the development of specific measures to reduce the regulatory burden and systematize social relations that are regulated in a fragmented manner.
In order to free the national legislative database from redundant regulatory legal acts, ensure its consistency, repeal documents that lack legal force in law enforcement practice, as well as to ensure the implementation of the Decree of the President of the Republic of Uzbekistan dated April 30, 2021, No. DP-6218 "On measures for the complex systematization of the national legislative database," the Cabinet of Ministers decides:
1. It shall be taken for information that Clause 32 of the Program for the systematization of regulatory legal acts by branches of legislation for 2022 — 2025, approved by the Decree of the President of the Republic of Uzbekistan dated April 30, 2021, No. DP-6218, stipulates the systematization of regulatory legal acts in the field of marriage and family, and the registration of civil status acts.
2. The following shall be approved:
Regulation on Civil Status Registration Offices according to Annex No. 1;
Regulation on the Procedure for Determining the Number of Personnel of Civil StatusRegistration Offices according to Annex No. 2;
Rules for the Registration of Civil Status Acts according to Annex No. 3;
Administrative Regulations for the Provision of Composite State Services Related to Birth Registration according to Annex No. 4;
Administrative Regulations for the Provision of Composite State Services Related to Death Registration according to Annex No. 5.
3. It shall be established that:
the stamp fee for the issuance of new certificates with the coat of arms shall be collected in the amount of 15 percent of the base calculated value (with the exception of death certificates, birth certificates issued for the placement of orphans and children deprived of parental care in educational institutions, and duplicate certificates issued due to the occurrence of natural and man-made emergencies on the territory of the Republic of Uzbekistan or foreign states, including disasters of a domestic nature (fire or collapse of residential or non-residential premises, burning of vehicles));
when applying independently through the Single Interactive State Services Portal, fees and state duties shall be collected in the amount of 90 percent of the established sums;
in the event that cases are identified where birth certificates with the same series and number were issued over various years as a result of the digitalization of archive data of civil status registration offices, no stamp fee shall be collected for the re-issuance of such certificates;
funds received from the stamp fee shall be distributed in the following order: 15 percent — to the revenue of district and city budgets; 85 percent — to the Fund for the Development of State Services of the Ministry of Justice of the Republic of Uzbekistan, and shall be utilized to cover expenses related to the preparation of certificates with the coat of arms and civil status record forms, strengthening the material and technical base of justice bodies and institutions, material incentives for employees, as well as measures for the maintenance of additional staff units of civil status registration offices.
4. The Ministry of Justice of the Republic of Uzbekistan, together with the Ministry of Digital Technologies, shall, within one month, create the possibility for applicants to submit requests through the Single Interactive State Services Portal to obtain a birth certificate for a child based on a birth certificate notice, according to their preference.
5. Certain decisions of the Government of the Republic of Uzbekistan shall be considered to have lost their force according to Annex No. 6*.

6. Control over the execution of this resolution shall be assigned to the Minister of Justice of the Republic of Uzbekistan, A.D. Tashkulov.

REGULATION
on Civil Status Registration Offices
Chapter 1. General Provisions
1. This Regulation defines the main tasks, functions, rights, and obligations, as well as the organizational framework for the activities of civil status registration offices (hereinafter — CSRO).
2. The following are considered CSRO bodies:
district and city CSRO departments (hereinafter — CSRO departments);
CSRO archives of the Ministry of Justice of the Republic of Karakalpakstan, and the justice departments of the regions and Tashkent city (hereinafter — territorial justice bodies).
3. CSRO bodies are part of the system of territorial justice bodies and are considered structural units without the status of a legal entity.
4. In accordance with the Decree of the President of the Republic of Uzbekistan dated February 18, 2020, No. DP-5938 "On measures to improve the social and spiritual atmosphere in society, further support the mahalla institution, and bring the system of working with families and women to a new level," the Minister of Justice of the Republic of Uzbekistan is responsible for supervising the work of CSRO bodies, selecting and placing qualified personnel, coordinating law enforcement practice, maintaining the "Single Electronic Archive of CSRO" information system, and managing the territorial archives of CSRO bodies.
5. CSRO bodies, in their activities, shall be guided by the Constitution and laws of the Republic of Uzbekistan, resolutions of the chambers of the Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions, and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers, this Regulation, and other legislative acts.
6. CSRO bodies shall have a seal bearing the State Emblem of the Republic of Uzbekistan and their name written in the state language.
7. The activities of CSRO bodies are based on the principles of the rule of law, the protection of citizens' rights and interests protected by law, and the confidentiality of the registration of civil status acts and the changes or additions made to them.
Circumstances that become known to an employee in connection with the registration of civil status acts are considered professional secrets and may not be disclosed or published, including after the termination of the labor contract.
Chapter 2. Tasks and Functions of CSRO Bodies
8. The task of CSRO bodies is to provide state services to physical and legal entities regarding the registration of civil status acts. The task of CSRO archives is to provide state services to physical and legal entities by issuing extracts, copies, and other certificates.
9. In accordance with the tasks assigned to them, CSRO bodies perform the following functions:
introduce changes, corrections, and additions to civil status act records;
maintain the accounting of civil status act records;
ensure the preservation of civil status act records and other documents established by law;
issue certificates, and if necessary, duplicate certificates and notices to citizens (regarding act records compiled in relation to themselves) confirming the registration of civil status acts;
issue copies or extracts and notices from act records based on written requests from the Ministry of Justice of the Republic of Uzbekistan (hereinafter — the Ministry), courts, law enforcement agencies, and notaries in connection with cases in progress, as well as requests from CSRO bodies and consular missions of the Republic of Uzbekistan in foreign countries;
if necessary, provide specific information from act records for the purposes of collection, generalization, or comparison based on requests from defense departments, healthcare bodies, employment promotion centers, departments of the Off-budget Pension Fund under the Ministry of Economy and Finance of the Republic of Uzbekistan, and other authorized agencies;
maintain the accounting, storage, and expenditure of certificate forms with the coat of arms and submit reports on this within the established deadlines;
maintain statistical reports according to the established forms;
maintain the electronic database of civil status act records;
consider applications within the established deadlines and procedure;
carry out legal outreach and promotion work regarding family legislation, as well as issues of registering civil status act records.
10. In addition to the functions provided for in Clause 9 of this Regulation, CSRO departments:
register civil status acts (birth, marriage, divorce, and death), as well as perform actions for the establishment of paternity, adoption, and changes of surname, first name, and patronymic;
restore and annul civil status act records;
coordinate the work of chairpersons of citizens' assemblies of towns, villages, and auls in the registration of deaths and provide them with practical assistance, and take measures to ensure that the requirements for the storage and expenditure of certificates with the coat of arms are met;
solemnly register marriages and births (at the request of citizens).
11. In addition to the functions provided for in Clause 9 of this Regulation, CSRO archives introduce relevant changes and marks into the second copies of act records and annul them based on notifications from CSRO departments.
In the absence of the first copy of an act record, they introduce changes, corrections, and additions to its second copy.
They monitor the accuracy of the data entered by CSRO employees into the "Single Electronic Archive of CSRO" information system by comparing it with the existing documents in the archive; The CSRO archive of the Tashkent City Territorial Department, where the first copies of civil status act records registered in the consular missions of the Republic of Uzbekistan are stored, shall introduce changes, corrections, and additions to those act records.
CSRO bodies shall carry out the tasks and functions assigned to them in cooperation with interested organizations.
Chapter 3. Rights and Obligations of CSRO Bodies
13. CSRO bodies have the following rights:
to request from physical and legal entities the information and documents necessary for the registration of civil status act records in cases provided for by legislative acts;
to submit proposals to the Ministry and territorial justice bodies regarding the improvement of the CSRO sphere;
to provide paid services to citizens in accordance with the lists of paid services provided to individuals, approved by the Ministry in agreement with the Ministry of Economy and Finance of the Republic of Uzbekistan.
CSRO bodies also possess other rights provided for by legislative acts.
14. CSRO bodies shall:
assist citizens in exercising their rights and protecting their legal interests, and explain their rights and obligations;
in the event that a violation of legislation by citizens is identified during the registration of civil status acts, report this to the relevant organizations so that necessary measures can be taken;
refuse to register civil status act records that contradict legislative acts;
maintain and preserve the archive fund;
execute the instructions of the Ministry and territorial justice bodies and provide them with information on issues related to the activities of CSRO bodies;
report to the Ministry and territorial justice bodies on the activities of CSRO bodies in the established manner.
Other obligations may also be assigned to CSRO bodies in accordance with legislative acts.
Chapter 4. Organization of the Activities of CSRO Bodies
15. A citizen of the Republic of Uzbekistan who meets the following requirements may be appointed to the position of head of a CSRO body, except in the case provided for in Clause 18 of this Regulation:
not younger than twenty-five years of age;
having a higher legal education or having completed retraining courses for individuals with higher education into the legal specialty at the Institute for Retraining and Advanced Training of Legal Personnel under the Ministry of Justice of the Republic of Uzbekistan and received a diploma of the established sample;
having at least three years of work experience in the legal specialty, including at least two years of work experience in a CSRO body.
A candidate for the leadership of a CSRO body should, as a rule, be in the reserve for the leadership of a CSRO body.
Persons who have not passed the relevant selection process in the established manner may not be accepted for the leadership of a CSRO body.
16. The head of a CSRO body is appointed and dismissed from office by the heads of the territorial justice bodies in agreement with the Ministry.
17. The requirements provided for in the fourth and fifth paragraphs of Clause 15 of this Regulation do not apply to employees working in management positions in justice bodies and institutions.
18. In the event that a candidate meeting the requirements for the position of head of a CSRO body is not found, a person having at least a secondary specialized education in the legal specialty and at least two years of work experience in a CSRO body may be appointed to this position in accordance with Clause 16 of this Regulation.
19. The head of a CSRO body:
organizes and plans the activities of the CSRO body, and ensures the timely and high-quality execution of the Ministry's instructions;
ensures the accounting, storage, and expenditure of certificate forms with the coat of arms in the established manner;
ensures the integrity and preservation of seals and stamps with the coat of arms;
organizes the reception of individuals and representatives of legal entities;
takes measures to ensure that information considered a professional secret is not disclosed by CSRO body employees;
monitors the compliance of CSRO body employees with labor and executive discipline and internal regulations;
submits proposals to the territorial justice body regarding the promotion of CSRO body employees or the application of disciplinary measures against them;
submits proposals to the territorial justice body on filling vacant positions.
20. In addition to those provided for in Clause 19 of this Regulation, the head of a CSRO department:
ensures the timely and high-quality execution of the instructions of the territorial justice body in the manner prescribed by law;
reduces or extends the one-month period established by law at the request of applicants when there are valid reasons for the registration of a marriage;
monitors the maintenance and registration of civil status act registration books and other documents;
takes measures to create conditions for the solemn registration of marriages and births;
ensures the timely, correct, and complete filling of civil status acts;
ensures the timely, correct, and complete entry of civil status acts into the "Single Electronic Archive of CSRO."
21. The head of a CSRO body is personally responsible for the fulfillment of the tasks, functions, and obligations assigned to the CSRO body.
22. In cases where the head of a CSRO body is temporarily absent (labor leave, business trip, illness), the performance of their duties shall be assigned to 1st-category inspectors or other employees by order of the head of the justice body in the relevant territory.
23. Citizens of the Republic of Uzbekistan having a higher legal education are appointed to the position of 1st-category inspector of a CSRO body, and those having, as a rule, a secondary specialized education in the legal specialty are appointed to the position of 2nd-category inspector.
Persons who have completed retraining courses for individuals with higher education into the legal specialty at the Institute for Retraining and Advanced Training of Legal Personnel under the Ministry of Justice of the Republic of Uzbekistan and received a diploma of the established sample may also work in the positions of 1st and 2nd-category inspector.
24. In the event that a candidate with a higher legal education is not found for the position of 1st-category inspector of a CSRO body, a person having a secondary specialized education in the legal specialty may be appointed to this position in the manner established in this Regulation.
25. 1st and 2nd-category inspectors and clerks are directly appointed to and dismissed from office by the head of the territorial justice body.
In exceptional cases, the head, and 1st and 2nd-category inspectors of a CSRO body may be appointed to and dismissed from office by the Minister of Justice of the Republic of Uzbekistan.
26. In cases where the 1st-category inspector is temporarily absent (labor leave, business trip, illness), their duties shall be performed by the 2nd-category inspector.
27. When there are 3 or more inspectors in a CSRO department, the position of clerk shall be introduced.
28. Employees of CSRO bodies are not entitled to register civil status act records or introduce relevant changes, corrections, and additions to them regarding themselves, their spouse, or their relatives (parents, children, grandchildren, grandfathers, grandmothers, siblings). In such cases, civil status act records shall be registered by another employee or in another CSRO body based on a written instruction from the territorial justice body, and a corresponding note shall be entered into the remarks column of the civil status act record.
29. Heads and inspectors of CSRO bodies are not entitled to engage in paid activities other than scientific, creative, and pedagogical activities.
30. Advanced training for CSRO body employees is carried out by the Institute for Retraining and Advanced Training of Legal Personnel under the Ministry of Justice of the Republic of Uzbekistan.
31. The duties, rights, and obligations of CSRO body employees are defined in the relevant job descriptions.
The job descriptions of CSRO body employees are approved by the heads of the territorial justice bodies.
32. Rank titles (class ranks) are conferred upon CSRO body employees in the manner established by the Cabinet of Ministers.
Chapter 5. Staffing Table of CSRO Bodies
33. The number of employees of CSRO bodies is determined in accordance with the procedure established by the Cabinet of Ministers.
34. The staffing table of CSRO bodies is approved by the territorial justice body within the limits of the established number of staff units and the labor remuneration fund.
Chapter 6. Final Provision
35. Persons guilty of violating the requirements of this Regulation shall be held liable in the manner prescribed by legislative acts.
Annex No. 2 to the Resolution of the Cabinet of Ministers dated October 20, 2023, No. 550
REGULATION
on the Procedure for Determining the Number of Personnel of Civil Status Registration Offices
Chapter 1. General Provisions
1. This Regulation provides for the procedure for determining the number of personnel of civil status registration offices (hereinafter — CSRO).
2. The following are considered CSRO bodies:
district and city CSRO departments (hereinafter — CSRO departments);
CSRO archives of the Ministry of Justice of the Republic of Karakalpakstan, and the justice departments of the regions and Tashkent city (hereinafter — CSRO archives).
3. The following are considered employees of CSRO bodies:
head (manager);
1st and 2nd-category inspector;
clerk (technical personnel).
4. The number of personnel of CSRO departments and CSRO archives is determined by the Ministry of Justice of the Republic of Uzbekistan (hereinafter — the Ministry) in agreement with the Ministry of Economy and Finance of the Republic of Uzbekistan.
CSRO departments are established and abolished by the Minister of Justice of the Republic of Uzbekistan within the limits of existing staff units.
The number of personnel of CSRO bodies is determined at most once a year.
In this regard, the expenses of CSRO bodies for labor remuneration, including the single social payment (with the exception of payments for rank titles and long-service bonuses), shall be covered by State Budget funds.
Chapter 2. Criteria for Determining the Number of CSRO Body Personnel
5. In every CSRO body:
in CSRO departments — the positions of head and 1st-category inspector shall be introduced;
in CSRO archives — the positions of head, one 1st-category inspector, and one 2nd-category inspector shall be introduced.
6. When determining the second and subsequent inspector positions in CSRO departments, the following criteria shall be taken into account in aggregate:
a) the average monthly number of the following civil status acts registered within the territory of the relevant district or city: birth, death, marriage, and divorce; changes, corrections, and additions made to act records; changes of surname, first name, and patronymic; issued duplicate certificates and notices; legal assistance provided under international treaties; and services provided based on the extraterritorial principle.
In this regard, the number of registered civil status acts, changes, corrections, and additions made to act records, changes of surname, first name, and patronymic, issued duplicate certificates and notices, legal assistance provided under international treaties, and services provided based on the extraterritorial principle per employee (excluding the head and clerk) must be at least 250–300 per month;
b) the population size within the serviced district or city territory. In this regard, inspector positions shall be introduced as follows: 1 inspector for a population from 50,000 to 100,000 people, 2 inspectors for a population from 100,000 to 150,000 people, 3 inspectors for a population from 150,000 to 200,000 people, 4 inspectors for a population of 200,000 people or more.
7. When there are 4 or more inspector positions in a CSRO body, 1st-category inspectors must not constitute more than half of their total number.
8. In addition to the criteria provided for in Clause 6 of this Regulation, when determining the number of inspector positions in a CSRO department based on specific circumstances, the distance between residential settlements within the borders of the serviced territory and the existing transport traffic between them may also be taken into account.
9. When determining the third and subsequent inspector positions in CSRO archives, the following criteria shall be taken into account in aggregate:
the number of existing document files in the archive fund. In this regard, the number of inspectors is determined based on 4,000 document files per employee, each containing 250 pages per year;
the number of entries made into civil status act records based on notifications received from CSRO departments. In this regard, the number of inspectors is determined based on a workload of 450–500 entries per employee per month;
the number of issued notices, duplicate certificates, and extracts from civil status acts. In this regard, the number of inspectors is determined based on a workload of 250–300 documents per employee per month.
10. When there are 3 or more inspectors in a CSRO body, the position of clerk shall be introduced.
Chapter 3. Consideration of Proposals Regarding the Number of CSRO Body Personnel
11. Proposals regarding the number of personnel of CSRO departments and CSRO archives shall be submitted to the Ministry by the Ministry of Justice of the Republic of Karakalpakstan and the justice departments of the regions and Tashkent city.
12. Proposals regarding the number of personnel of CSRO departments shall be accompanied by materials containing the following data for the district and city:
the number of civil status acts registered by CSRO departments over the last three years, including changes, corrections, and additions made to act records, changes of surname, first name, and patronymic, issued duplicate certificates and notices, legal assistance provided under international treaties, and services provided based on the extraterritorial principle;
the population size;
other data justifying the proposal.
13. Proposals regarding the number of inspectors for CSRO archives shall be accompanied by the following data:
the number of existing cases in the archive fund over the last three years;
the number of entries made into civil status act records over the last three years;
the number of notices, duplicate certificates, and extracts from civil status acts issued over the last three years;
other data justifying the proposal.
14. Proposals regarding the number of personnel of CSRO bodies shall be summarized by the Ministry and submitted to the Ministry of Economy and Finance of the Republic of Uzbekistan for agreement.
15. After the proposals regarding the number of personnel of CSRO bodies are agreed upon in the established manner with the Ministry of Economy and Finance of the Republic of Uzbekistan, a relevant decision shall be adopted by the Ministry in accordance with Clause 4 of this Regulation.
Annex No. 3 to the Resolution of the Cabinet of Ministers dated October 20, 2023, No. 550
RULES
for the Registration of Civil Status Acts
Chapter 1. General Provisions
1. These Rules establish the procedure for the registration of civil status acts by civil status registration offices (hereinafter — CSRO), chairpersons of citizens' assemblies of towns, villages, and auls (hereinafter — citizens' assembly), and consular missions of the Republic of Uzbekistan and consular departments of diplomatic missions of the Republic of Uzbekistan (hereinafter — consular missions of the Republic of Uzbekistan).
The following are considered CSRO bodies:
district and city CSRO departments (hereinafter — CSRO departments);
CSRO archives of the Ministry of Justice of the Republic of Karakalpakstan, and the justice departments of the regions and Tashkent city (hereinafter — territorial justice bodies) (hereinafter — CSRO archives of territorial justice bodies).
2. CSRO bodies, citizens' assemblies, and consular missions of the Republic of Uzbekistan shall carry out their activities regarding the registration of civil status acts in accordance with the Constitution of the Republic of Uzbekistan, international treaties of the Republic of Uzbekistan, the Family Code of the Republic of Uzbekistan, these Rules, and other regulatory legal acts pertaining to the activities of CSRO bodies.
3. The establishment of CSRO bodies, general management of their activities, the conduct of systemic supervision, and the maintenance of the "Single Electronic Archive of CSRO" information system shall be carried out by the Ministry of Justice of the Republic of Uzbekistan.
The Regulation on the procedure for record-keeping in CSRO bodies is approved by the Ministry of Justice of the Republic of Uzbekistan.
The Ministry of Justice of the Republic of Uzbekistan shall provide CSRO bodies, consular missions of the Republic of Uzbekistan, and citizens' assemblies with certificate forms bearing the coat of arms according to the samples in accordance with Annexes 1 — 4a* to these Rules.

4. CSRO bodies, consular missions of the Republic of Uzbekistan, and citizens' assemblies shall be provided with civil status act record forms and other documents by the Ministry of Justice of the Republic of Uzbekistan, as well as the Ministry of Foreign Affairs of the Republic of Uzbekistan.
5. CSRO bodies shall register the following civil status acts through relevant records:
birth;
marriage;
divorce;
death.
Civil status act records (hereinafter — act records) are considered documents of state importance, are compiled in one copy, and are preserved for 75 years from the time of registration in CSRO bodies.
Events and facts such as adoption, establishment of paternity, change of surname, first name, and patronymic, and gender reassignment are reflected in the aforementioned civil status acts by introducing relevant changes to them.
6. Citizens' assemblies shall carry out the registration of deaths by way of writing a civil status act. In this regard, the registration of the death of persons whose identity has not been established or who have been declared deceased by a court is not permitted by citizens' assemblies.
7. In relation to citizens of the Republic of Uzbekistan residing abroad, the actions specified in Clause 5 of these Rules shall be performed by the consular missions of the Republic of Uzbekistan.
The consul shall accept applications for introducing changes, corrections, and additions to act records, restoration of act records, as well as changes of surname, first name, and patronymic, together with the relevant documents, from citizens of the Republic of Uzbekistan permanently or temporarily residing abroad, citizens of foreign states who registered their civil status in the Republic of Uzbekistan, and stateless persons, and shall send these documents to the authorized bodies for consideration.
In cases where one of the persons applying to the consul for the registration of a civil status act is a citizen of Uzbekistan and the other is a foreign citizen or a stateless person, the registration of the civil status act shall be carried out only if it does not contradict the laws of the state where the consular mission of the Republic of Uzbekistan operates, or the international treaties or agreements signed by the Republic of Uzbekistan.
If an international treaty signed by the Republic of Uzbekistan provides for norms other than those specified in the norms of the family legislation of the Republic of Uzbekistan, then the rules of the international treaty shall apply.
8. During the registration of civil status acts by the consular missions of the Republic of Uzbekistan, a consular fee shall be collected in the manner established by legislative acts.
9. The registration of act records may be refused in the following cases:
if the registration of the act record contradicts the legislation;
if the submitted documents do not comply with the requirements placed upon them in these Rules and other legislative acts;
if the person applying for the registration of the act record is not entitled to do so or has been found legally incompetent by a court.
At the request of the person who was refused the registration of civil status act records, the CSRO body must notify this person of the reason for the refusal in written or electronic form within fifteen days.
10. A complaint regarding the refusal to register civil status acts may be filed in the order of subordination to the territorial justice bodies, the Ministry of Justice of the Republic of Uzbekistan, or to a court in the established manner.
11. Actions of a consul regarding the refusal to register civil status acts may be appealed in the order of subordination to the head of the diplomatic mission of the Republic of Uzbekistan in the foreign state, to the Ministry of Foreign Affairs of the Republic of Uzbekistan, or to a court of the Republic of Uzbekistan in the established manner.
12. Employees of CSRO bodies, as well as the consul, are not entitled to register act records or introduce relevant changes, corrections, and additions to them regarding themselves, their spouse, or their relatives (parents, children, grandchildren, grandfathers, grandmothers, siblings).
In such cases, the registration of act records or the introduction of changes, corrections, and additions to them shall be carried out by another employee or in another CSRO body based on a written instruction from the superior body in the order of subordination. A corresponding entry shall be made in the "For Remarks" column of the act records.
121. In the event of a change in an individual's surname, first name, patronymic, or date of birth, including a change of surname due to the registration of marriage or divorce, application-questionnaires for the issuance of new identification ID-cards to the individual shall be sent by the CSRO body to the authorized bodies in a composite form based on the individual's consent, simultaneously with the processing of certificates bearing the coat of arms.
The application-questionnaires for the issuance of new identification ID-cards on behalf of the individual shall be filled out by the CSRO body. When the processed application-questionnaires are received by the authorized bodies performing the tasks of issuing identification ID-cards to individuals in accordance with the Decree of the President of the Republic of Uzbekistan dated September 22, 2020, No. DP-6065 "On measures for the introduction of identification ID-cards in the Republic of Uzbekistan," no additional application-questionnaire shall be required from said individual.
When processing new identification ID-cards on the grounds provided for in this clause, payments shall be made, and biographical and biometric data, as well as other documents required in accordance with legislative acts, shall be provided upon visiting the authorized bodies performing the tasks of issuing identification ID-cards.
Chapter 2. Legal Significance of Registering Civil Status Acts
13. Taking into account the protection of the personal and property rights of citizens and the interests of the state and society, the law stipulates the registration by authorized bodies of important events in the lives of citizens—birth, marriage, death, and other circumstances that cause the emergence, change, and termination of essential subjective rights and obligations of an individual.
The registration of civil status serves as the basis for issuing a document (a certificate with the coat of arms) that acts as the grounds for the emergence of citizens' rights and duties. The significance of registering civil status acts lies in the fact that the certificate issued by the CSRO body on its basis is considered indisputable evidence confirming the accuracy of the fact indicated therein.
A birth certificate is the sole document confirming a child's birth and who their parents are.
A marriage certificate is a document confirming the status of the persons who entered into marriage as husband and wife and expressing the emergence of mutual rights and obligations between them.
A divorce certificate is considered a document confirming the termination of the marriage of the persons who were married.
A death certificate is considered a document confirming the death of a person and the termination of their legal capacity.
14. Responsibility for the timely registration of births and deaths, and for the correct and accurate filling of medical birth certificates, as well as medical certificates of perinatal death and death in the healthcare institutions of the Republic of Uzbekistan, is assigned to the heads of district and city healthcare departments.
Chapter 3. Bodies Registering Civil Status Acts
15. The registration of civil status acts in districts and cities is carried out by CSRO bodies, while death may also be registered in towns, villages, and auls by the chairpersons of citizens' assemblies.
The actions of citizens' self-government bodies regarding the registration of deaths shall be under the supervision of the relevant CSRO bodies in the territories where they are located.
The registration of civil status acts of citizens of the Republic of Uzbekistan permanently or temporarily residing abroad is carried out by the consul in accordance with the legislative acts of the Republic of Uzbekistan.
In the temporary absence of the consul, civil status acts shall be registered by an official of the consulate appointed by the consul.
In foreign states where there are no diplomatic missions of the Republic of Uzbekistan, civil status acts shall be registered by the consular mission of the Republic of Uzbekistan in another foreign state as designated by the Ministry of Foreign Affairs of the Republic of Uzbekistan.
Chapter 4. Birth Registration
Section 1. Birth Registration Procedure
16. The registration of a childʼs birth is mandatory and must be carried out by the CSRO body, regardless of the citizens' place of permanent (temporary) registration.
At the request of the parents, the CSRO body may conduct the birth registration in a solemn atmosphere.
17. An application for birth must be submitted in oral or written form within one month from the day of the child's birth.
18. The application may be submitted by the parents or one of them, and in specific cases, by relatives, neighbors, or other persons authorized by the parents (or one of them), as well as by officials of medical institutions, internal affairs bodies, or tutelage and guardianship authorities.
The expiration of the established deadline shall not prevent the registration of the birth. In such cases, to register the birth of a child under the age of sixteen, an application stating the reasons for missing the deadline is submitted to the CSRO body by the childʼs parents (or one of them if legally married), another interested person via power of attorney, a person acting in place of the parents, or officials of tutelage and guardianship authorities.
In these instances, the CSRO body shall require other documents in addition to the document confirming the fact of birth, as prescribed by legislation.
If the application is submitted after the deadline, the birth is recorded in the current register for civil status act records of birth.
19. For children over the age of 16 born outside a medical institution and without medical assistance, where no medical birth certificate has been issued by a medical institution, birth registration is carried out based on a court decision.
If the child is 16 years or older and possesses a medical birth certificate issued by a medical institution, the birth is registered based on the application of the parents (or one of them) and the adult child.
20. For birth registration, the following are submitted: a medical certificate of the child's birth (except when birth is registered as a composite state service), identity documents of the parents (citizenʼs passport, diplomatic passport, identification ID-card, or military ID for service members), a marriage certificate with the coat of arms, or an application for the establishment of paternity, or an application from an unmarried mother.
The medical birth certificate must include:
the mother's surname, first name, patronymic, place of residence, date of birth, nationality, citizenship, marital status, and education;
the time, date, and place of the child's birth, gender, weight, and height;
the duration of pregnancy and the pregnancy sequence number;
criteria of live birth (breathing, heartbeat, umbilical cord pulsation, involuntary muscle contraction);
the time the medical certificate was issued, its serial number, and the name of the medical institution.
The certificate is signed by an official of the medical institution and certified with a seal. Registration of a child born outside a maternity hospital and without medical assistance is carried out based on a certificate issued by a district doctor (feldsher or midwife).
In such cases, an act drawn up in the presence of witnesses to the birth and certified by the district doctor (feldsher or midwife) serves as the basis for issuing the medical certificate.
The medical certificate is filed together with the civil status act record of birth.
In specific cases where one parent lacks an identity document, the CSRO body may not refuse registration. Information about the parent without documents is entered based on the marriage certificate or birth certificates of previous children. If neither parent has identity documents, registration is carried out based on written requests from the medical institution or the tutelage and guardianship authority. Births to minor parents (or one minor parent) are registered on general grounds.
In this case, the participation of a legal representative of the minor parent (if not legally married) or the tutelage and guardianship authority is required.
21. The recording of the birth act of a child whose parents are married is performed based on identity documents and a marriage certificate or notice.
If no more than 300 days have passed since the father's death, the divorce of the parents, or the date the parents' marriage was declared void by a court prior to the birth, information about the father is recorded in the same manner.
In such cases, the applicant must submit a divorce certificate, an extract (copy) of the court's divorce decree, an extract (copy) of a legally binding court decision declaring the marriage void, or the fatherʼs death certificate. In the "For Remarks" column of the act record, the place and date of the divorce or death registration, the serial number of the act record, and the name of the court and date of the decision are specified.
All disputes regarding the child's lineage are resolved through the courts.
22. If the marriage between the parents is not registered (and the mother is not present at the birth registration), the record regarding the child's father is made based on the motherʼs application, certified by a notary or a medical institution.
In this case, the father's surname in the birth act record is recorded according to the mother's surname, and the father's first name, patronymic, and nationality are recorded according to the mother's instructions.
23. When registering the birth, the child's surname is given by agreement of the parents (either the fatherʼs or motherʼs surname) or, in accordance with national traditions, based on the paternal or maternal grandfather's first name. In the absence of agreement, disputes are resolved by the tutelage and guardianship authority, or by the consul within a consular district.
24. The child's first name is given with the parents' consent. Double names are permitted (e.g., Saidahmadkhuja, Tukhtamurodjon, Gulirano, Mirzaolim, Mirzo Ulugbek, Rosa-Maria).
Giving a child a name that might subsequently disparage their honor and dignity, based on the child's interests, is not permitted. Disagreements regarding the name are resolved by the tutelage and guardianship authority.
25. The child's patronymic is given based on the father's first name. Information about the father in the birth act record and certificate is recorded without changes based on identity documents. It is strictly forbidden to leave the "Father" and "Mother" columns blank in a birth act record.
26. Based on Article 15 of the Law of the Republic of Uzbekistan "On the State Language," if there are spelling errors in the father's surname, first name, and patronymic, the child's birth act record may be registered with the errors corrected at the parents' request.
The birth act record may be registered by adding suffixes such as "-ev", "-ov", "-eva", "-ova", "-iy", "-khon", "-khuja", "-khoji", "-bek", "-zoda", "mir-", "abdu-" to the surname, or "-evich", "-ovich", "-evna", "-ovna", "qizi", "ugli", "-iy", "-khon", "-khuja", "-khoji", "-bek", "-zoda", "mir-", "abdu-" to the patronymic, or by removing such suffixes from the surname and patronymic.
27. Once the birth act record is registered, the applicant is issued a birth certificate.
During birth registration by CSRO bodies, the individual's Personal Identification Number is entered into the birth certificate with the coat of arms.
The Personal Identification Number is automatically generated in real-time by the Personalization Agency under the Ministry of Justice of the Republic of Uzbekistan.
A notification is sent via the "Single Electronic Archive of CSRO" information system to the "Single National Social Protection" information system of the National Social Protection Agency under the President of the Republic of Uzbekistan for the assignment of relevant benefits to the applicant in the established manner.
28. In the case of twins (two or more children), a medical birth certificate must be submitted for each. Separate act records with sequential numbers are registered for each child, and individual birth certificates with the coat of arms are issued to each.
29. The registration of the birth of a foundling (abandoned child) is carried out based on an application from the internal affairs bodies, tutelage and guardianship authorities, the administration of the institution where the child is placed, or a medical institution. The person who found the child must report it to the district internal affairs body or the tutelage and guardianship authority within twenty-four hours.
30. Internal affairs, tutelage and guardianship authorities, or the administration of the institution where the child is placed must apply to the CSRO bodies for the registration of the foundling (abandoned child) no later than seven working days after the child was found.
The application must clearly state the time, place, and condition of the child when found, as well as their age, gender, weight, and height.
Information regarding the surname, first name, and nationality of the parents in the foundlingʼs birth act record is entered based on instructions from the aforementioned authorities. In this case, the surname of the child and the persons listed as parents shall be the same.
Registration of a child abandoned by the mother is carried out based on an application from the medical institution where the child is placed or the local tutelage and guardianship authority, within 7 days of abandonment. The application must specify the time, place, condition, age, gender, weight, and height of the child at the time of abandonment. Surnames, first names, patronymics, and parental information for such children are entered based on the instructions of the aforementioned bodies. The surname of the child and the persons listed as parents shall be recorded identically.
31. The registration of a stillborn child, as well as the birth and death of children who die within the first week of life (perinatal death), is carried out within 24 hours by the local CSRO body based on a written request from the medical institution or the forensic medical examination institution.
If one twin is stillborn or dies in the first week, the registration is carried out by the same CSRO body that registered the live twin. Stillborn births are recorded only in the register of birth act records based on a medical certificate of perinatal death.
If a child dies after birth, even if they lived only a few minutes, both birth and death act records are compiled.
In such cases, the birth record is based on a medical birth certificate, and the death record is based on a medical certificate of perinatal death.
The birth act record contains full information about the mother, and the "For Remarks" column indicates the serial number and date of the death act record. A notification of death is sent to the "Single National Social Protection" information system of the National Social Protection Agency for the assignment of relevant benefits. A notice for burial is issued to the cemetery, and if necessary, a death certificate may be issued at the parents' request (for children who died in the first week).
32. If a mother who is not married to the child's father dies, or if her whereabouts are unknown and no application for paternity has been submitted, the birth registration is carried out based on a written request from the bodies listed in Clause 29 of these Rules.
33. Information regarding the deprivation of parental rights is indicated in the "For Remarks" column of the birth act record based on a legally binding court decision; parental information in the act record is not crossed out and no changes are made. In such cases, duplicate birth certificates are not issued to the persons deprived of parental rights.
A duplicate certificate may be issued to the minor childʼs guardian or tutor.
34. Based on a legally binding court decision on the restoration of parental rights, the note "Parental rights restored" is entered into the birth act record.
35. Information about the father entered into the birth act record may only be canceled based on a legally binding court decision.
36. In accordance with the legislation of the Republic of Uzbekistan, the birth registration of a child who can be considered a citizen of the Republic of Uzbekistan upon birth is carried out by the consul in the consular district where the child was born or where the parents reside permanently or temporarily.
37. If a citizen of the Republic of Uzbekistan is born abroad and the birth was not registered by a consular mission or the authorized body of that state, the birth act record is registered by the CSRO body, regardless of the citizens' place of permanent (temporary) registration, upon submission of a medical document confirming the birth (along with a translation into the state language) issued by the authorized body of the foreign state and legalized or apostilled in the established manner.
38. In all cases of birth registration, the administrative territory where the child was born is recorded as the place of birth.
Section 2. Establishment of Paternity
39. The establishment of paternity for a child born to parents who are not married to each other shall be carried out at a CSRO body based on a joint application submitted by the father and mother (if the father is a minor, by his legal representative) or on the basis of a court decision that has entered into legal force.
In establishing paternity for a child whose birth has been registered and who has not reached the age of 10, a joint application by adult parents for the establishment of paternity may be submitted to the CSRO body in electronic form via the Single interactive state services portal (hereinafter — SISSP), except for cases provided for in paragraphs 41, 42, 44, 46, 47, 54, 57, and 59 of these Rules.
In this case, the identity of the parents is verified through biometric identification systems Face-ID or MyID, and the verification of their identity by the parents through Face-ID or MyID systems signifies consent to the establishment of paternity in respect of the child.
When an application is submitted via the SISSP, the CSRO body shall review the application within three working days from the time of receipt, enter the information about the father into the child's birth act record, and print a new birth certificate.
At the request of the father or mother who submitted the application for the establishment of paternity, the new birth certificate may be received via postal service. In this case, postal expenses shall be covered by the applicant.
The amount of the fee for the service provided by the postal service shall be determined by the postal service.
40. The application for the establishment of paternity shall be considered by the CSRO body regardless of the place of permanent (temporary) registration of citizens.
41. The establishment of paternity shall be carried out on the day the application is submitted in the presence of the parents, except for cases provided for in paragraph 45 of these Rules.
42. In exceptional cases, an application for the establishment of paternity may be submitted to the CSRO body even before the birth of the child.
In such cases, information regarding the time of birth and the name of the child is not indicated until the child is born.
If the birth of the child is registered in another CSRO body, the CSRO body that stored the advance application shall send it to the place of registration upon request.
43. The establishment of paternity by power of attorney is not permitted.
44. If paternity is established after the birth of the child has been registered, the child's birth certificate shall be attached to the application for the establishment of paternity or to the court decision on this matter.
45. In the event that one of the parents is not present during the establishment of paternity, their signature shall be certified in the manner prescribed by legislation (by the signature and seal of a notary, an authorized person of a consular institution of the Republic of Uzbekistan, or the head of a medical institution, a CSRO body, a military unit, or a penal institution).
46. In the event of the mother's death, or if she is recognized by a court as legally incompetent or missing, or if she is deprived of parental rights, or if it is impossible to determine her place of residence, the establishment of paternity in respect of a minor child may be carried out based on the application of the father with the consent of the guardianship and trusteeship body.
In such cases, one of the following documents shall be attached to the application:
a copy of the death certificate of the mother;
a copy of the court decision recognizing the mother as legally incompetent;
a copy of the court decision depriving the mother of parental rights;
a copy of the court decision recognizing the mother as missing.
47. If the father of the child is recognized by a court as legally incompetent, the application for the establishment of paternity may be submitted on his behalf by his guardian with the permission of the guardianship and trusteeship body.
48. In the absence of a joint application by the parents, paternity (if the father or mother is a minor) may be established in court proceedings upon the lawsuit of one of the parents or the guardianship and trusteeship body.
Information about the father shall be entered into the birth act record of the child on the basis of a court decision. In this case, the court decision that has entered into legal force and the child's birth certificate shall be submitted to the CSRO body.
49. The application for the establishment of paternity must be in a special form, and clear and complete answers must be provided to all questions indicated therein. The application shall be signed at the CSRO body, and the information therein shall be verified against the applicant's identity document. Each application shall be registered on the day of its receipt.
50. Paternity in respect of a child who has reached the age of 10 or older shall be established with the child's consent. In this case, the child's consent shall be expressed by their personal signature on the application submitted by the parents, and their signature shall be certified by an employee of the CSRO body.
The CSRO body shall make the relevant changes to the birth act record on the basis of the application for the establishment of paternity.
If the establishment of paternity is carried out in respect of a person who has reached the age of 16, the information about the father must be changed. Information about the child shall be entered according to the procedures and rules for changing the surname, first name, and patronymic.
51. Paternity shall be established regardless of whether the child's father is in a legal marriage with another woman. Therefore, the consent of his wife is not required for the establishment of paternity.
52. If information about the father has been entered into the child's birth act record on the basis of a marriage certificate or an application for the establishment of paternity, paternity in respect of this child may not be established by another person until the information about the father indicated in the act record is revoked through court proceedings.
53. If the child's birth act record has been lost, paternity may be established after the birth act record has been restored.
54. If the registration of birth and the establishment of paternity are carried out simultaneously, the surname of the child shall be given at once by agreement of the parents, and information about the father shall be recorded according to the submitted application. In this case, an application from a single mother is not required.
55. In cases where paternity is established for a person under the age of 16, the child's patronymic shall be changed (recorded) according to the father's name.
If the patronymic previously indicated in the child's birth act record does not match the name of the person recorded as the child's father, the CSRO body is not entitled to refuse the establishment of paternity or to demand an explanatory letter from the parents on this matter.
56. If the marriage of the parents was registered after the birth of the child was registered, the record of this marriage registration cannot serve as a basis for entering information about the child's father into the birth act record.
In this case, information about the father shall be entered into the child's birth act record in accordance with the application for the establishment of paternity.
57. On the basis of the application for the establishment of paternity, the CSRO body shall enter the information about the father into the child's birth act record on the same day and issue a new birth certificate.
58. If the birth act record is registered in another CSRO body, the CSRO body that accepted the application for the establishment of paternity shall send a notification to the CSRO body that registered the act record via the electronic information system regarding the making of changes to the act record.
The CSRO body that registered the initial act record shall make the necessary changes to the act record within two working days, confirm the act record via the electronic information system, and the CSRO body that accepted the application for the establishment of paternity shall print the certificate with the coat of arms.
The CSRO body that made the changes shall send a notification to the CSRO archive of the territorial justice body via the "Single Electronic Archive of CSRO" information system for making the relevant changes to the second copy of the birth act record (except for cases where the act record is registered in one copy).
59. If the child's birth act record is registered in CIS countries, the CSRO body that accepted the application for the establishment of paternity shall send it or the court decision on this matter (with a translation into Russian), together with the birth certificate, to the CSRO body that registered the birth act record.
60. In establishing paternity for a child under the age of 16, the rules for making changes to act records may be applied, meaning that not only the child's surname and patronymic but also their first name may be changed.
Section 3. Adoption
61. Making changes regarding adoption shall be carried out at the CSRO body that registered the birth act record on the basis of a court decision. If the place of birth of the adopted child is changed, it shall be carried out at the CSRO body at the place indicated in the court decision; if not indicated in the court decision, it shall be carried out by the CSRO body regardless of the permanent (temporary) registration place of the adopters.
Necessary changes to the book of birth records of the child being adopted shall be entered by CSRO bodies within ten days from the day the court decision on adoption enters into legal force. If the CSRO body is approached after the expiration of the specified period, the court decision must contain a note stating that this decision has not lost its force.
62. Upon formalizing an adoption, the following shall be submitted to the CSRO body:
an extract from the court decision on adoption that has entered into legal force;
the birth certificate of the child being adopted;
identity documents of the adopter(s).
63. Court decisions shall be registered in a special book according to the time of receipt and filed in a separate folder in chronological order.
64. On the basis of the court decision and the adopters' documents, the CSRO body shall make the relevant changes to the birth act record, issue a new birth certificate and, if necessary, a certificate of adoption.
65. If the place of birth of a child under the age of 10 is changed within the Republic by a court decision, a restored act record shall be registered at the CSRO body at the place indicated in the court decision; if not indicated in the court decision, it shall be registered by the CSRO body to which the adopters applied.
In this case, a request for making changes to the act record shall be sent via the electronic information system to the CSRO body that registered the act record, and the CSRO body that registered the initial act record shall send the act record to the requesting CSRO body via the "Single electronic archive of CSRO" information system.
The CSRO body to which the adopters applied shall send a notification regarding its cancellation to the CSRO body where the initial act record was registered and to the CSRO archive of the territorial justice bodies (except for cases where the act record is registered in one copy) via the "Single electronic archive of CSRO" information system.
66. For the purpose of maintaining the secrecy of adoption, documents for adoption may be submitted to the CSRO body by representatives of the adopters in the manner prescribed by legislation.
67. If the adoption is revoked, a note shall be made in the birth act record stating "The adoption was revoked by the decision of the ___________ court dated the __ day of _________ month of the year ______," the initial data in the act record shall be restored, and a new birth certificate shall be issued.
68. The CSRO body shall send a notification to the CSRO archive of the territorial justice bodies for making relevant changes to the second copy of the act record (except for cases where the act record is registered in one copy).
Chapter 5. Registration of Marriage
Section 1. Procedure, Time, and Place of Marriage Registration
69. In accordance with Articles 14 and 15 of the Family Code of the Republic of Uzbekistan, the mutual consent of the persons entering into marriage and their reaching the marriageable age are the primary conditions for the conclusion of a marriage.
In the presence of valid reasons, in exceptional cases (pregnancy, birth of a child, declaration of a minor to be fully legally capable — emancipation), upon the request of the persons wishing to enter into marriage, the marriageable age may be reduced by a period of not more than one year by the khokim of the district or city at the place of registration of the marriage.
70. Marriage shall be registered by the CSRO body after one month from the day the persons wishing to enter into marriage apply with a written or electronic application of the prescribed form.
Upon acceptance of the application for marriage registration by the CSRO bodies, a referral for a medical examination in the prescribed manner shall be issued to the persons entering into marriage, except for cases specified in the second part of Article 17 of the Family Code of the Republic of Uzbekistan.
In this case, persons entering into marriage up to the age of fifty must undergo a mandatory medical examination for HIV infection.
71. The head of the CSRO body may reduce the one-month period in the presence of valid reasons and upon the request of the applicants.
In this case, documents confirming the valid reasons — birth certificates of children, a certificate from a medical institution regarding the pregnancy of the bride or the illness of one party, a certificate of a business trip, and similar documents — shall be presented.
72. The extension of the period for marriage registration shall be considered based on the joint application of those entering into marriage. In certain cases, if there are sufficient grounds, as well as at the initiative of the CSRO body, this period may be extended up to three months.
73. The application of the prescribed form shall be completed on the basis of the identity documents of the persons entering into marriage, and clear and complete answers must be provided to all questions.
74. When accepting the application, the CSRO body must explain to the persons entering into marriage the procedure and conditions for concluding a marriage, the rights and obligations that will arise in the future as spouses and parents, and ensure that they are informed about each other's health and family status.
The persons entering into marriage shall be warned of the consequences of concealing circumstances that prevent the conclusion of a marriage.
75. If the persons entering into marriage have common children for whom paternity has not been established, the CSRO body must explain to them the procedure for the establishment of paternity.
76. Since the law prohibits the conclusion of a marriage between persons if even one of them is already in a previously registered marriage, the CSRO body, at the time of accepting the application, must verify via the "Single electronic archive of CSRO" information system whether the applicants are in a legal marriage according to their identity documents.
A person who was previously married must submit a document to the CSRO body confirming the termination of the previous marriage. This may be a certificate of termination (notice of divorce) or a court decision, a death certificate of the husband (wife) (death notice) and a notice of the marriage concluded with the deceased person, or a court decision recognizing the marriage as invalid.
77. In accordance with Article 16 of the Family Code of the Republic of Uzbekistan, the conclusion of a marriage is not permitted:
between persons of whom at least one is already in another registered marriage;
between relatives in a direct line of descent, between full and half brothers and sisters, as well as between adopters and the adopted;
between persons of whom at least one is recognized by a court as legally incompetent due to a mental disorder (mental illness or intellectual disability).
78. When setting the time for marriage registration, the CSRO body should determine the consent of the persons entering into marriage to hold it in a solemn atmosphere, including by visiting the location. Registration in a solemn manner or by visiting a location shall be carried out only upon the request of those entering into marriage. Upon the request of the persons entering into marriage, the marriage shall be registered in the presence of their relatives and acquaintances. A designated number of witnesses chosen by the persons entering into marriage may participate in the marriage registration.
79. When submitting an application for marriage, identity documents, namely a citizen's passport, a diplomatic passport (passport for traveling abroad), an identifying ID-card, a serviceman's personal identity card, or a military ID, must be presented.
80. If for any reason it is impossible for both persons entering into marriage to arrive at the same time, the application may be submitted by one of them to the CSRO body, provided that the signature of the person who could not arrive is certified in the prescribed manner.
81. The application for marriage must be registered in a special book for recording applications.
82. The registration of marriage shall be carried out only in the presence of the persons entering into marriage. CSRO bodies must ensure that the persons entering into marriage have undergone a medical examination and are informed of the results of these examinations, except for cases provided for in the fifth part of Article 13 of the Family Code of the Republic of Uzbekistan. Marriage registration by power of attorney or through a representative, as well as in the absence of a certificate of medical examination, is not permitted.
Employees of CSRO bodies shall be liable in the prescribed manner for disclosing information constituting professional medical secrets that became known to them during marriage registration.
83. In exceptional cases where one of the persons entering into marriage cannot arrive at the CSRO body due to illness, the marriage registration shall be carried out at a hospital, at home, or in another appropriate place, in the presence of both persons entering into marriage. A relevant note shall be made in the "For remarks" column of the act record.
84. If the CSRO body receives an application regarding the existence of circumstances specified in paragraph 77 of these Rules, the registration of marriage shall be postponed. In this case, it is recommended that the applicant provide the necessary evidence within the prescribed period. The CSRO body may conduct the necessary investigation upon the request of an interested person or at its own initiative. The applicants shall be notified of the postponement of the marriage registration. If there are legal impediments to the registration of the marriage, the CSRO body shall refuse its registration. If these details are not confirmed, the registration of the marriage shall be carried out on general grounds. The period for verifying the aforementioned circumstances must not exceed three months.
85. Upon registration of the marriage, the persons entering into marriage may, at their own choice, choose the surname of one of them as a common surname or remain with their pre-marital surnames.
A surname formed by joining the surnames of the persons entering into marriage (for example, groom Akhmedov, bride Shukhratova, thus the groom becomes Akhmedov-Shukhratov and the bride becomes Akhmedova-Shukhratova) may be chosen as a common surname.
86. If one of the persons entering into marriage adopts the surname of the husband or wife, they shall be warned of the necessity to replace the citizen's passport or identifying ID-card, and the passport for traveling abroad (if available), within one month.
When a surname is changed due to the registration of the marriage of a person liable for military service or a conscript, the CSRO body shall notify the district (city) department of defense affairs where the person liable for military service or conscript is registered within 7 days.
87. A state duty shall be collected in the prescribed manner for the registration of marriage.
88. If the prescribed rules for concluding a marriage are violated, or if a marriage is concluded for malicious purposes, it shall be recognized as invalid by a court decision.
On the basis of a court decision that has entered into legal force recognizing a marriage as invalid, the CSRO body shall make a note to this effect in the act record of marriage registration and send a notification to the CSRO archive of the territorial justice body, except for cases where the act record is registered in one copy.
In cases where a marriage is recognized as invalid by a court, a duplicate marriage certificate shall not be issued.
Section 2. Registration of Marriage of Citizens of CIS Countries, Foreign Citizens, Stateless Persons, and Citizens of the Republic of Uzbekistan Residing Abroad
89. In accordance with the Family Code of the Republic of Uzbekistan, the registration of marriage of citizens of the Republic of Uzbekistan with citizens of CIS countries, foreign citizens, and stateless persons, as well as the registration of marriage between foreign citizens, shall be carried out by the CSRO bodies of the Republic of Uzbekistan on general grounds.
The registration of marriage between a citizen of Uzbekistan and a foreign citizen or a stateless person shall be carried out only if the visa of the foreign citizen or stateless person to stay in the Republic of Uzbekistan is valid on the day of the conclusion of the marriage.
In this case, a copy of the identity document and a document confirming that the foreign citizen or stateless person is not married, legalized in the prescribed manner or with an apostille (along with a translation into the state language), must be attached to the application for marriage.
90. The registration of the marriage of a citizen of the Republic of Uzbekistan permanently residing abroad shall be carried out by the competent bodies of that state in accordance with its legislation or at the consular institutions of the Republic of Uzbekistan in accordance with these Rules.
91. The registration of the marriage of a citizen of the Republic of Uzbekistan with a foreign citizen or a stateless person shall be carried out by a consul only if the registration of the marriage is recognized by the laws of the state where the consular institution of the Republic of Uzbekistan is located, or in cases according to agreements or international treaties to which that state and the Republic of Uzbekistan are parties.
92. At the request of a citizen of a foreign state who intends to register a marriage with a citizen of the Republic of Uzbekistan residing in that state at the relevant bodies of the said state, the consul may issue a certificate stating that the applicant citizen of the Republic of Uzbekistan is not married, for submission to the bodies of that state registering the marriage.
Such certificates shall be issued on the basis of information available at the consular institutions.
If the consular institution does not have information regarding the family status of the person entering into marriage, the consul shall obtain this information from the Ministry of justice of the Republic of Uzbekistan through the Ministry of foreign affairs of the Republic of Uzbekistan.
Section 3. Registration of Marriage with Persons in Places of Deprivation of Liberty
93. Registration of marriage with persons serving sentences in penitentiary institutions shall be carried out by the CSRO bodies in the territory where the institution is located.
94. A person wishing to enter into marriage with a convict shall complete the relevant part of the application for marriage on a special blank and submit it to the CSRO body, regardless of their place of permanent (temporary) registration. The CSRO body shall compare the information provided in the application with the applicant's identity document, certify the accuracy of the information recorded in the application and the applicant's signature, and return the application to the applicant. Thereafter, the person wishing to enter into marriage with the convict shall submit this application to the administration of the penitentiary institution for delivery to the convict.
95. Upon receiving the application for marriage with a convict, the administration of the penitentiary institution shall present it to the convict to complete the relevant section. The administration of the penitentiary institution shall compare the information in the completed application with the data in the convict's personal file (even in the absence of the convict's identity document), certify their authenticity and the signature, and send the application to the CSRO body in the territory where the penitentiary institution is located.
In this case, on the same day after the application is registered by the CSRO body, a referral for the medical examination of the convict entering into marriage and a notification regarding the scheduling of the marriage registration time shall be sent to the administration of the penitentiary institution.
If the information regarding the family status in the convict's personal file is incomplete, insufficient, or inaccurate, the administration of the penitentiary institution shall take measures to request or clarify this information through the relevant organizations and institutions.
The administration of penitentiary institutions shall ensure that the convict undergoes a medical examination prior to marriage in the prescribed manner.
96. Registration of marriage with a convict shall be carried out in the presence of the persons entering into marriage in premises designated by the administration of the penitentiary institution in agreement with the CSRO body.
97. A marriage certificate shall be issued by the CSRO body to the person entering into marriage with the convict.
98. A stamp shall be placed by the CSRO body on the questionnaire in the convict's personal file, and the surname, first name, and patronymic of the husband or wife, year of birth, the name of the CSRO body, as well as the date of marriage and the act record number shall be recorded.
99. Registration of marriage with persons held in pre-trial detention shall be carried out by the CSRO body of that territory, with the permission of the official or body conducting the investigation, at the temporary detention facility (investigative isolation facility, guardhouse).
100. In the case specified in paragraph 99 of these Rules, the signature of the official of the body that granted permission for the registration shall be placed on the application for marriage and the act record of marriage registration.
Chapter 6. Dissolution of Marriage
Section 1. Registration of the Dissolution of Marriage of Spouses without Minor Children by Mutual Consent
101. In accordance with Articles 42 and 218 of the Family Code of the Republic of Uzbekistan, the CSRO body shall accept an application for the dissolution of marriage from spouses who have no property disputes and no minor children (including adopted ones). If the wife is pregnant, the acceptance of the application for the dissolution of marriage shall be refused.
An application for the dissolution of marriage by spouses whose marriage act record was registered by the CSRO bodies of the Republic of Uzbekistan may be submitted in electronic form via the SISSP, except for cases provided for in the second paragraph of paragraph 102 of these Rules.
In this case, the identity of the spouses is verified through biometric identification systems Face-ID or MyID, and the verification of their identity by the spouses through Face-ID or MyID systems signifies consent to the dissolution of marriage.
To take appropriate measures to reconcile the spouses, the CSRO body, no later than three days from the date of filing the application for dissolution of marriage, must notify in writing the commission for strengthening family values of the citizens' gathering at the place of joint residence of the spouses, or if they do not live together, the commission for strengthening family values of the citizens' gathering at the place of residence of each of them.
102. Registration of the dissolution of marriage of spouses living separately shall be carried out by the CSRO body based on their joint application.
If one of the spouses cannot come to the CSRO body to file the application for the dissolution of marriage, one of them may submit a joint application written on behalf of both spouses. The signature of the spouse who is unable to arrive must be certified by a notary or by the head of the CSRO body. The application shall confirm the mutual consent of the spouses to the divorce, the absence of minor children, as well as the consent of the spouse who cannot attend the CSRO body on the day scheduled for registration to have the dissolution of marriage registered in their absence.
In this case, CSRO bodies may request documents from the relevant authorities confirming the absence of minor children.
103. If there is mutual consent of the spouses for the dissolution of marriage, but there are disputes regarding common property or the maintenance of an incapacitated, needy husband or wife, the dissolution of marriage shall be resolved through court proceedings.
104. The desire of either the husband or the wife to return to their pre-marital surname must be indicated in the application for the dissolution of marriage.
After the dissolution of marriage is registered, a note regarding its termination shall be made on the marriage certificate, which is then returned to the applicants.
105. Upon registration of the dissolution of marriage, a state duty shall be collected in the prescribed manner from one or both spouses, according to their mutual agreement.
When registering the dissolution of marriage in the presence of only one of the spouses, the state duty shall be collected in full.
Section 2. Dissolution of Marriage Based on the Application of One of the Spouses
106. In accordance with Articles 43 and 219 of the Family Code of the Republic of Uzbekistan, the dissolution of marriage shall be registered by CSRO bodies based on the application of one of the spouses, regardless of whether they have common minor children, if the other spouse:
has been recognized by a court as missing;
has been recognized by a court as legally incompetent due to a mental disorder (mental illness or intellectual disability);
has been sentenced to deprivation of liberty for a term of not less than three years for a committed crime.
In such cases, the following shall be additionally attached to the application:
a court decision that has entered into legal force recognizing the husband (wife) as legally incompetent or missing;
an extract from a court verdict that has entered into legal force regarding the sentencing of the husband (wife) to deprivation of liberty for a term of not less than three years, as well as the consent of the convicted husband (wife) stating the absence of disputes regarding common children and property during the dissolution of marriage.
If there is a dispute concerning the children, the division of common joint property, or the payment of funds for the maintenance of a husband (wife) in need of assistance and incapacitated, the dissolution of marriage shall be carried out through court proceedings.
1061. Based on the grounds provided for in paragraph 106 of these Rules, one of the spouses may also apply via an electronic application through the SISSP.
In the event that the application is submitted in electronic form via the SISSP, the identity of the applicant husband (wife) is verified through biometric identification systems Face-ID or MyID, and the verification of their identity through Face-ID or MyID systems signifies the consent of the applicant husband (wife) to the dissolution of marriage.
Based on the results, the CSRO body shall, within one working day, send a notification to the applicant's personal cabinet on the SISSP regarding the time for reviewing the application and the requirement to bring the relevant documents specified in paragraph 106 of these Rules.
In this case, if the husband (wife) who filed the application does not apply to the relevant CSRO body and does not provide the original copies of the relevant documents within five working days from the day the notification was sent, the application shall not be considered.
107. Dissolution of marriage for persons sentenced to deprivation of liberty for a term of not less than three years, who have no common children or property disputes, shall be carried out by CSRO bodies on the basis of the mutual consent of the spouses in accordance with general rules.
108. Dissolution of marriage based on a court decision recognizing one of the spouses as missing shall be carried out by the CSRO body regardless of the place of permanent (temporary) registration of the husband or wife.
109. In the event of the return of the husband (wife) recognized by the court as missing and the cancellation of the relevant court decision, the marriage may be restored by the CSRO body based on the joint application of the spouses.
In this case, the CSRO body shall cancel the act record of dissolution of marriage and the relevant certificate issued on its basis.
The marriage may not be restored if one of the parties has entered into a new marriage.
In this case, if the person recognized as missing applies, a certificate of dissolution of marriage shall be issued.
Section 3. Registration of the Dissolution of Marriage by Court Decision
110. In accordance with Article 47 of the Family Code of the Republic of Uzbekistan, a marriage shall be terminated from the day the dissolution of marriage is registered at the CSRO body.
111. The CSRO body shall, based on a court decision and upon the application of one of the spouses, register the act record of dissolution of marriage and issue a certificate of dissolution of marriage.
In this case, prior to registering the dissolution of marriage, the CSRO body shall verify via the "Single electronic archive of CSRO" information system whether the fact of dissolution of marriage has already been formalized by one of the spouses.
If the dissolution of marriage was registered at the CSRO body upon the application of one of the parties, the act record shall be completed with the information regarding the second party, and a certificate of dissolution of marriage shall be issued.
The registration of the act record of dissolution of marriage, the making of additions to the entries in the act record of dissolution of marriage, and the issuance of the certificate of dissolution of marriage may also be carried out upon the application of a representative of one of the parties acting on the basis of a power of attorney.
Registration of the dissolution of marriage based on court decisions that entered into legal force between September 1, 1998, and September 15, 2010, shall be carried out in accordance with the procedures and rules for the restoration of lost act records.
1111. Based on the grounds provided for in paragraph 111 of these Rules, one of the spouses may also apply via an electronic application directly through the SISSP.
In the event that the application is submitted in electronic form via the SISSP, the identity of the applicant husband (wife) is verified through biometric identification systems Face-ID or MyID.
Based on the results, the CSRO body shall, within one working day, send a notification to the applicant's personal cabinet on the SISSP regarding the time for reviewing the application and the requirement for them or their representative acting on the basis of a power of attorney to bring the original copy of the relevant court decision.
In this case, if the husband (wife) who filed the application or their representative acting on the basis of a power of attorney does not apply directly and does not provide the original copy of the relevant court decision within five working days from the day the notification was sent, the application shall not be considered.
112. The dissolution of marriage with a citizen of the Republic of Uzbekistan based on a court decision that has entered into legal force in a CIS country or a foreign state (regardless of when the decision was issued) shall be registered at the CSRO body in the general manner, unless otherwise provided for by an interstate agreement. Upon registration of the dissolution of marriage, a state duty shall be collected in the amount established by the Law of the Republic of Uzbekistan "On State Duty".
Chapter 7. Registration of Death
113. Registration of death shall be carried out by the CSRO body regardless of the place of permanent (temporary) registration of the deceased.
114. The application for the registration of death must be submitted no later than 3 days after the medical certificate of death is issued (except for cases of death registration as a composite state service).
Relatives and close persons of the deceased, as well as the administration of a medical institution, may apply for the registration of death by submitting a medical certificate of death.
If a birth act record has not been registered at a CSRO body in respect of a deceased minor, a birth act record shall be registered for the deceased person and a certificate to this effect shall be issued to the applicant, after which a death act record shall be registered in the prescribed manner for the deceased person.
115. The medical certificate submitted for the registration of death or the court decision declaring a citizen deceased shall be attached to the act record (except for cases of death registration as a composite state service).
116. Registration of the death of foreign citizens and stateless persons shall be carried out on general grounds.
117. Registration of the death of a citizen of the Republic of Uzbekistan who died abroad shall be carried out by the consular institution of the Republic of Uzbekistan at the place of residence of the deceased or at the place where the death occurred.
If the death registration is carried out in a district other than the place of residence of the deceased, the consular institution that registered the death shall send a notification to the consular institution where the deceased was registered, indicating the surname, first name, patronymic, and date of death, as well as the number of the death act record and the place and date of death registration.
118. If during the registration of death it becomes known that the deceased has minor children left without guardianship, the consul shall immediately notify the Ministry of foreign affairs of the Republic of Uzbekistan on the same day.
119. Registration of the death of persons who died in penitentiary institutions shall be carried out by the CSRO body based on a notification from the administration of the said institution.
120. Registration of the death of persons on the basis of a court decision declaring a citizen deceased, and of persons whose death was not registered within the periods prescribed by legislation, shall be carried out by the CSRO body on general grounds.
121. Upon registration of death, the birth certificates of those who died under the age of 16 shall be submitted. In this case, the CSRO body employee (consul) shall record the number and date of the death act record on the certificate.
The birth certificates of the deceased shall be destroyed once every quarter on the basis of an act.
122. After the death act record is registered, the applicant shall be issued a death certificate with the coat of arms and a certificate of the prescribed form for submission to the cemetery.
A notification shall be sent via the "Single electronic archive of CSRO" information system for the assignment of the relevant allowance to the applicant in the prescribed manner by the "Single national social protection" information system of the National social protection agency under the President of the Republic of Uzbekistan (hereinafter — the National social protection agency).
If information regarding the birth act record of the deceased person exists in the "Single electronic archive of CSRO" information system, the information regarding their death shall be entered into the "For remarks" column.
123. Restoration of death act records shall be carried out according to the decisions of district and city courts. If the date of death of the deceased is not indicated in the court decision, the date the court decision entered into force shall be considered the day of death of the deceased.
124. Registration of the death of unidentified persons shall be carried out by the CSRO body in the territory where the medical institution of the healthcare system is located, based on the medical certificate of death from that institution.
In such cases, all information in the death act record shall be indicated on the basis of the medical certificate of death, and only a certificate for submission to the cemetery shall be issued.
A death certificate with the coat of arms shall be issued only after the missing information in the act record is completed.
125. Upon receiving an additional medical certificate or a notification from the prosecutor's office regarding the identification of the body, the CSRO body shall enter the missing information into the act record and send a notification to the CSRO archive of the territorial justice body for making necessary changes to the second copy of the act record, except for cases where the act record is registered in one copy.
Chapter 8. Restoration of Act Records
126. In accordance with Article 230 of the Family Code of the Republic of Uzbekistan, the restoration of act records means the re-establishment of lost records when there are sufficient grounds confirming that such a record previously existed.
127. Act records of birth, marriage, and dissolution of marriage shall be restored only upon the application of the persons in respect of whom these records were compiled.
If the birth record of a child under sixteen years of age is lost, the record shall be restored upon the application of the child's parents, guardian, trustee, or the administration of a children's institution.
If there is a dispute between the persons interested in the restoration of the record, the restoration of the record shall be carried out in accordance with the Civil Code of the Republic of Uzbekistan.
1271. An application for the restoration of act records of birth, marriage, and dissolution of marriage may also be submitted via the SISSP only by the persons in respect of whom these records were compiled, except for the cases provided for in the third paragraph of paragraph 127 of these Rules.
The identity of the applicant is verified through biometric identification systems Face-ID or MyID.
Based on the results, the CSRO body shall, within one working day, send a notification to the applicant's personal cabinet on the SISSP regarding the time for reviewing the application for restoration of the act record and the requirement to bring the documents provided for in paragraphs 129, 133, and 134 of these Rules upon personal application.
In this case, if the applicant does not apply directly and does not provide the relevant documents within five working days from the day the notification was sent, the application shall not be considered.
128. If both copies of the act record are lost, the restoration of the act record shall be carried out by the CSRO body upon the personal application of a citizen who has reached the age of 16.
Restoration of act records shall be carried out only after all circumstances serving as a basis for their restoration have been identified by the CSRO body.
Upon receipt of an application for the restoration of an act record, the CSRO body may request copies of act records confirming the validity of the restoration from the relevant CSRO bodies at the place where they are stored through the "Single electronic archive of CSRO" information system.
129. To restore a birth act record, the following documents shall be submitted to the CSRO body:
an application for the restoration of an act record of the prescribed form;
a certificate from the CSRO archive of the territorial justice body regarding the absence or loss of the act record at the applicant's place of birth (indicating the reasons for the loss);
a copy of the citizen's passport (identifying ID-card) of the applicant;
copies of the citizens' passports (identifying ID-cards) of the parents; if the parents are deceased, certificates of their death;
certificates of marriage (of the parents and of the applicant themselves);
in the absence of the parents' documents, birth certificates of brothers and sisters (if any).
Other documents supporting the applicant's request may also be submitted to the CSRO body for the restoration of the birth act record.
130. When accepting the application, the applicant shall be warned by the CSRO body of the liability for giving false statements.
The accepted application shall be registered in the book for recording applications for restoration.
131. In the restored birth act record, the applicant's year of birth shall be indicated on the basis of their citizen's passport (identifying ID-card), military ID, and other available documents.
If the submitted documents indicate only the year of birth of the applicant but do not indicate the day and month of birth, their date of birth shall be considered July 1 of that year.
132. After studying the submitted documents, a conclusion shall be drawn up by the head of the CSRO body, thereafter an act record number shall be placed under the letter "R" (Restored) in the book of birth act records, and on its basis, the restored birth act record shall be registered and a birth certificate shall be issued.
In the absence of information regarding the applicant's parents, the "Information about parents" column in the restored birth act record shall not be completed and a dash shall be placed.
133. To restore a marriage act record, the following documents must be submitted:
an application of the prescribed form;
a certificate from the CSRO archive of the territorial justice body regarding the absence or loss of the marriage act record (indicating the reasons for the loss);
photocopies (copies) of citizens' passports (identifying ID-cards);
birth certificates of children (if any);
other additional documents confirming the existence of the marriage act record.
On the basis of the submitted documents, a conclusion shall be drawn up by the CSRO body, then the number of the last act record in the book of marriage act records shall be recorded repeatedly with the addition of the letter "R", and the restored marriage act record shall be compiled.
In the marriage certificate, the initial date of registration of the act record being restored shall be indicated in the "were married" column, and the number and date of the compiled restored marriage act record shall be indicated in the "the relevant act record was registered" column.
134. To restore an act record of dissolution of marriage, the following documents must be submitted:
an application of the prescribed form;
a certificate from the CSRO archive of the territorial justice body regarding the absence of the act record of dissolution of marriage (indicating the reasons for the loss);
a photocopy (copy) of the citizen's passport (identifying ID-card);
a marriage certificate with a note regarding the dissolution of marriage;
other documents confirming the existence of the previous act record of dissolution of marriage.
On the basis of the submitted documents, a conclusion shall be drawn up by the CSRO body, the serial number of the last act record in the book of act records of dissolution of marriage shall be recorded repeatedly with the addition of the letter "R", and the restored act record of dissolution of marriage shall be compiled.
In the "in the book of registration of acts of dissolution of marriage" column of the certificate of dissolution of marriage with the coat of arms, the initial date of the act record of dissolution of marriage shall be recorded, and in parentheses — the number and date of the restored act record.
135. In the absence of sufficient grounds for the restoration of act records, the CSRO body shall provide the applicant with a reasoned conclusion regarding the refusal. With this conclusion, the applicant has the right to apply to a court to resolve the matter on its merits.
136. The application for the restoration of an act record must be reviewed by the CSRO body within fifteen days.
In the presence of valid reasons (non-receipt of copies of records confirming the validity for the restoration of the act record, etc.), the period for reviewing the application may be extended by the head of the CSRO for a period of not more than fifteen days, and the applicant shall be notified thereof.
137. A state duty shall be collected in the prescribed manner for the restoration of an act record.
Chapter 9. Making Changes, Corrections, and Additions to Act Records
138. Making changes, corrections, and additions to act records shall be carried out by the CSRO body at the place where these records are stored, provided there are sufficient grounds and no dispute between interested persons, if such records were compiled within the territory of the Republic of Uzbekistan.
Making changes to act records of birth, marriage, and dissolution of marriage of persons who have reached the age of sixteen shall be carried out upon their application.
Making changes to the birth act record of persons who have not reached the age of sixteen shall be carried out upon the application of their parents or legal representatives.
An application regarding the change of the name of children under the age of ten may also be submitted by their parents (at their request) via the Single interactive state services portal (hereinafter — SISSP).
In the event that the application is submitted via the SISSP, the application shall be generated by the father (mother) and confirmed by the mother (father).
If the applicants apply via the SISSP, confirmation of the application with an EDS (electronic digital signature) is not required.
At the request of the applicants, a new birth certificate may be received via postal service.
If the application specifies the delivery of the new birth certificate via postal service, the CSRO body shall hand over the printed new birth certificate to the postal service employee. The postal service employee shall deliver the ready new birth certificate to the specified address and, after receiving the old birth certificate (if available) from the applicants, deliver it to the CSRO body. In this case, postal expenses shall be covered by the applicant.
If the use of postal services is not provided for in the application, one of the applicants shall apply to the CSRO body specified in the application with an identity document, submit the old birth certificate (if available), and receive the new birth certificate.
Making changes, corrections, and additions to act records may be carried out on the basis of an application and a power of attorney certified by a consul or a notary.
Making corrections to a death act record shall be carried out by the CSRO body upon the application of the next of kin or heir(s).
Corrections and additions to act records of birth, marriage, and dissolution of marriage of deceased persons shall be entered by the CSRO body on the basis of a court decision.
A refusal by the CSRO body to make changes, corrections, and additions to act records may be appealed through court proceedings.
1381. Persons who have reached the age of sixteen may also submit applications for making changes, corrections, and additions to act records via the SISSP, except for the cases provided for in paragraph 142 of these Rules.
The identity of the applicant is verified through biometric identification systems Face-ID or MyID.
Based on the results, the CSRO body shall, within one working day, send a notification to the applicant's personal cabinet on the SISSP regarding the time for reviewing the application for making changes, corrections, and additions to act records and the requirement to bring the documents provided for in these Rules upon personal application.
If the applicant does not apply directly and does not provide the relevant documents within three working days from the day the notification was sent, the application shall not be considered.
139. Making changes, corrections, and additions to act records shall be carried out in the following cases:
when there is a desire to record a surname, first name, and patronymic in order to observe historical and national traditions based on Article 15 of the Law of the Republic of Uzbekistan "On the State Language";
upon establishment of paternity;
upon adoption;
when the surname of a minor child is changed by mutual agreement of the parents (including when the parents' marriage is dissolved) or by a khokim's decision;
when the nationality is changed;
when an application is submitted by an unmarried mother to change information about the child's father (until the child reaches the age of 16);
when the establishment of paternity is recognized as invalid by a court decision, when information about the father is revoked, or when an adoption is revoked;
when the surname and patronymic of a minor child are changed in connection with the change of the parents' surname, first name, and patronymic;
when there are spelling errors and inaccuracies in the act records, as well as when entries regarding the time and place of birth and the father's name are missing;
when the first name and surname of a child under the age of 16 are changed, if the first name and surname were given without taking into account the wishes of the parents;
if the first name in the act record is written in a shortened or diminutive form;
upon gender reassignment.
An application for making changes, corrections, and additions to an act record shall be reviewed by the CSRO body within 5 working days from the day the application was received (except for the sixteenth paragraph of this paragraph).
In the presence of valid reasons (non-receipt of copies of records to which changes must be made and in other cases), this period may be extended by the head of the CSRO for a period of up to 15 working days.
An application regarding the change of the name of children under the age of ten shall be reviewed within 3 working days.
140. In all the cases mentioned above, corrections shall be made without drawing up a conclusion at the place where the act records were compiled, except for cases where the act records are located outside Uzbekistan, as well as cases where there are discrepancies in act records of marriage and death, birth act records of brothers and sisters, and other act records.
141. Copies of documents confirming the validity of the applicant's request shall be attached to the application for making changes: a copy (photocopy) of their identity documents and copies of other necessary documents. Along with these, the original copies of the certificates requiring changes shall be filed in the folder.
Upon receipt of an application for making changes, corrections, and additions to an act record, the CSRO body shall request a copy of the act record to be changed or corrected, as well as copies of act records confirming the existence of grounds for making changes or corrections, from the CSRO body where they are stored through the "Single electronic archive of CSRO" information system.
142. If the act record to be changed is located outside the Republic, the CSRO body shall draw up a conclusion or (if an interstate agreement exists) certify the applicant's signature on the application and send the folder (application) to the CSRO body at the place where the act record was compiled for execution.
143. A conclusion regarding making changes to an act record shall be drawn up in 3 copies, one of which shall be filed in the folder, the second shall remain at the CSRO body, and the third copy shall be given to the applicant.
If necessary, copies of the conclusion shall be sent to the relevant CSRO bodies through the "Single electronic archive of CSRO" information system.
144. The CSRO body that made changes to the act record shall notify the CSRO archive of the territorial justice body via the "Single electronic archive of CSRO" information system no later than two working days regarding the making of relevant changes to the second copy of the act record, except for cases where the act record is registered in one copy.
145. At the request of the applicant, the CSRO body may issue a certificate stating that changes have been made to the act record.
146. Changing the gender of a person in their birth act record shall be carried out according to the conclusion of a medical institution regarding gender reassignment.
The person whose gender has been reassigned shall be warned of the necessity to replace their identity documents within one month.
147. In all cases, except for the third, fourth, and thirteenth paragraphs of paragraph 139 of these Rules, a state duty shall be collected in the prescribed manner for making changes.
148. Applications for making changes, corrections, and additions to the act records of citizens of the Republic of Uzbekistan residing abroad shall be reviewed by the consular institutions of the Republic of Uzbekistan in the manner prescribed by these Rules.
Relevant changes, corrections, and additions shall be made to the act record stored in the archive of the CSRO body on the basis of documents sent by the consul.
Chapter 10. Change of Surname, First Name, and Patronymic
149. An application for the change of surname, first name, and patronymic shall be reviewed by the CSRO body after the applicant reaches the age of 16, regardless of the place of their permanent (temporary) registration.
Upon changing the surname, first name, and patronymic, an application for the re-registration of a motor vehicle may be sent to the internal affairs bodies in a composite manner at the request of the applicant.
At the request of the applicant, the certificate of registration of motor vehicles may be obtained by visiting the internal affairs bodies in person or by using a delivery service.
If a person who has reached the age of 16 applies for a change of surname, first name, and patronymic before receiving a citizen's passport (identifying ID-card) or another identity document replacing a passport, a birth certificate shall be attached to the application.
Persons who have reached the age of eighteen and have no minor children may also submit applications for the change of surname, first name, and patronymic via the SISSP.
The identity of the applicant is verified through biometric identification systems Face-ID or MyID.
Based on the results, the CSRO body shall, within one working day, send a notification to the applicant's personal cabinet on the SISSP regarding the time for reviewing the application for changing the surname, first name, and patronymic and the requirement to bring the documents provided for in paragraph 151 of these Rules upon personal application.
If the applicant does not apply directly and does not provide the relevant documents within five working days from the day the notification was sent, the application shall not be considered.
150. Applications for the change of surname, first name, and patronymic shall be considered:
in accordance with Article 15 of the Law of the Republic of Uzbekistan "On the State Language";
on the basis of a court decision that has entered into legal force;
if the surname and first name are unpleasant to the ear;
if the person's surname and first name do not correspond to their nationality;
upon the desire to return to one's pre-marital surname (both during the marriage and after the dissolution of the marriage);
upon the desire to have a common family surname (if the spouses did not adopt a common surname at the time of marriage);
upon the desire of children to have the same surname as the father or mother, to have the mother's pre-marital surname, or to have the surname of a stepfather or guardian;
upon gender reassignment;
upon the establishment of paternity in respect of a person who has reached the age of 16.
151. The following documents shall be attached to the application for the change of surname, first name, and patronymic:
the birth certificate of the applicant;
if the applicant is married, the marriage certificate; if the marriage is dissolved — the certificate of dissolution of marriage;
if the applicant has minor children, the birth certificates of the children;
if the applicant is a minor or recognized as legally incompetent by a court decision, the application of the parents or the guardian or trustee;
a conclusion of a medical institution regarding gender reassignment (if the application is made on the basis of gender reassignment).
152. In the event that the act records necessary for making changes are lost, the change of surname, first name, and patronymic shall be carried out after these documents have been restored.
153. The accepted application shall be entered into a special book.
154. On the basis of the submitted documents and, if necessary, by obtaining copies of the required act records from other CSRO bodies at their request through the "Single electronic archive of CSRO" information system, the head of the CSRO department shall send a questionnaire to the internal affairs body through the "Single electronic archive of CSRO" information system for the purpose of conducting the relevant verification.
155. The internal affairs body shall review the submitted documents within 20 days.
The internal affairs body may provide an opinion stating that the change of the applicant's surname, first name, and patronymic is inexpedient in the following cases:
if the person has knowingly submitted false or incorrect information about themselves;
if the person is being sought by the bodies of inquiry, investigation, or the court — until the search is canceled;
if a criminal case has been initiated against the person — until a final court decision or another decision is made regarding the case.
The opinion of the internal affairs body regarding the change of the applicant's surname, first name, and patronymic shall be submitted to the CSRO body through the information system.
In the event that the CSRO body draws up a conclusion stating that the change of the applicant's surname, first name, and patronymic is inexpedient, the specific reasons for this circumstance shall be indicated.
156. The CSRO body shall send a notification regarding the change of the surname, first name, and patronymic to the internal affairs body within 3 days, and if the applicant is liable for military service — also to the district (city) department of defense affairs.
157. If the act record to which a change is to be made is located in another place, the CSRO body shall send a notification regarding the making of changes to the act record through the "Single electronic archive of CSRO" information system.
158. Based on the notification, the CSRO body shall make the relevant changes to the act record and confirm the act record through the "Single electronic archive of CSRO" information system, and also send a notification to the CSRO archive of the territorial justice body through the "Single electronic archive of CSRO" information system for making similar changes to the second copy of the act record, except for cases where the act record is registered in one copy.
In this case, the CSRO body that accepted the application for the change of surname, first name, and patronymic shall print and issue a new certificate.
159. The person whose surname, first name, and patronymic have been changed shall be warned by the CSRO body of the necessity to replace their identity documents within one month.
160. The change of the surname of one of the spouses who are in a legal marriage shall not lead to the change of the surname of the other.
The change of the surname of both parents shall lead to the change of the surname of their children who have not reached the age of 16.
The fact that the parents or one of them has changed their surname shall not lead to a change in the surname of their adult children.
If one of the parents changes their surname, the matter of changing the surname of their minor children shall be resolved by agreement of the parents, and in the absence of such agreement — by the guardianship and trusteeship body.
161. A change of the father's first name shall lead to a change in the patronymic of minor children.
The patronymic of adult children shall be changed only upon their application.
162. If a person who retained their pre-marital surname at the time of marriage subsequently adopts the husband's surname, or if they change the surname adopted at the time of marriage to their pre-marital surname, the change shall be entered only into the marriage act record.
If a person who retained their marital surname after the dissolution of marriage changes it to their pre-marital surname, the change shall be entered only into the act record of dissolution of marriage.
163. In all cases where the surname, first name, and patronymic are changed by persons who have reached the age of 16, the change shall be entered only into the "information about the child" column of the birth act record.
The information about the parents shall remain unchanged.
164. Applications from citizens of the Republic of Uzbekistan permanently residing abroad shall be reviewed by the consul. The documents specified in paragraph 151 of these Rules must be attached to the application. If necessary, the consul shall request documents confirming the validity of the applicant's request and the act records to which changes must be made through the Ministry of foreign affairs of the Republic of Uzbekistan.
On the basis of the collected documents, the consul must obtain, through the Ministry of foreign affairs of the Republic of Uzbekistan, a supporting opinion from the competent bodies of the Republic of Uzbekistan or the state where the applicant permanently resides, stating that permission has been granted for the change of the applicant's surname, first name, and patronymic.
On the basis of this opinion, the consul shall draw up a reasoned conclusion regarding the change of the surname, first name, and patronymic and send it along with the folder to the CSRO body where the act record to be changed is stored.
165. An application for the change of surname, first name, and patronymic must be reviewed within one month from the day it was submitted. In the presence of valid reasons (non-receipt of copies of act records necessary for formalizing the case from other CSRO bodies, delay in receiving the opinion of the internal affairs bodies, etc.), the head of the CSRO body may extend this period for a period of not more than fifteen days.
166. A state duty shall be collected in the prescribed manner for the change of surname, first name, and patronymic.
Chapter 11. Annulment of Act Records
167. In accordance with Article 233 of the Family Code of the Republic of Uzbekistan, if the CSRO body identifies the existence of two or more identical records, the restored records may be annulled by the CSRO body at the place where they were compiled.
If there are significant differences in the surname, first name, patronymic, date of birth, or parental information in the identified act records, the restored civil status act records shall be annulled by a court decision.
168. Upon receiving a court decision on the annulment of an act record, the CSRO body that compiled the record to be annulled shall draw a diagonal line across it, make a corresponding note, and issue a notice to the applicant.
169. The CSRO body sends notifications regarding the annulment of the act records to the CSRO archive of the territorial justice body and to the CSRO body at the place where the initial act record was compiled via the "Single Electronic Archive of CSRO" information system, except for cases where the act record was registered in one copy.
Upon receiving the notification, the CSRO archive of the territorial justice body shall make a note of the annulment on the second copy of the relevant act record, and the CSRO body shall issue a duplicate certificate to the applicant in accordance with the initial act record.
170. The annulment of records based on documents received from the former Soviet republics is carried out by the CSRO body based on the conclusions of the territorial justice bodies, and the documents regarding the annulment of the record are kept at said CSRO body.
Chapter 12. Filling Out Act Records
171. Act records are compiled in a single copy. Each type of act record is numbered sequentially and in order from January 1 to December 31 of each year. Act records are filled out in the state language using Latin graphics with the aid of a computer.
172. All columns of the act records must be filled out completely, without errors, and without abbreviations (except for generally accepted ones).
173. Act records are filled out based on the citizen's passport (identification ID-card), or in its absence—on the basis of other identity documents. When registering act records in relation to a foreign citizen, the state of which they are a citizen shall be indicated in addition to their nationality. In the absence of information regarding nationality, information regarding citizenship shall be recorded. For stateless persons, the words "stateless" shall be written in the "Citizenship" column.
174. If a person applying to the CSRO body for the registration of an act record does not know the state language, they may utilize the services of an interpreter. A corresponding entry regarding this shall be made in the "For Remarks" column. In the event that a deaf, mute, or deaf-mute person is illiterate, a person capable of explaining the content of the act record to them and confirming by signature that the content matches the wish of the deaf, mute, or deaf-mute person may participate in the registration. A corresponding entry regarding this shall be made in the "For Remarks" column. When compiling an act record for a blind person, the text of the act record shall be read to them by the employee of the CSRO body who compiled the act record. A corresponding entry regarding this shall be made in the "For Remarks" column.
175. When formalizing an act record for a stillborn child, information is entered into the birth act record on the basis of a medical certificate of perinatal death.
176. In relation to a child born alive but who died within the first week of life, information is entered into the death act record on the basis of a medical certificate of perinatal death.
177. After the act records are filled out, they are read and signed by the applicant.
178. Based on the act record, the relevant certificates with the coat of arms are filled out in the state language using Latin graphics and handed over to the applicant.
179. For the issuance of a certificate with the coat of arms (with the exception of death certificates with the coat of arms), a stamp fee established by the Cabinet of Ministers of the Republic of Uzbekistan is collected.
Chapter 13. Issuance of Duplicate Certificates and Other Information
180. The CSRO body where the first copy of the act record is kept shall issue duplicate certificates based on applications from interested persons submitted directly or through the Single Interactive State Services Portal (hereinafter — SISP) and on the basis of the relevant act records.
Regarding the acquisition of duplicate birth, marriage, and divorce certificates, only the individuals whom the act records concern may apply personally; for a duplicate birth certificate for a minor child, one of the parents may also apply through SISP, except for cases where the act records were registered outside of Uzbekistan.
The identity of the applicant is verified through Face-ID or MyID systems.
At the applicant's request, a duplicate certificate may be obtained via postal service within the territory of Uzbekistan.
In this regard, postal expenses shall be covered by the applicant.
The amount of payment for the service provided by the postal service is determined by the postal service itself.
When considering an application for a duplicate certificate received through SISP, the CSRO body shall formalize the duplicate certificate within one working day if the act record is registered in that same CSRO department, or within three working days if it is registered in another CSRO body; it is then handed over to the applicant personally or to a postal service employee for delivery to the address specified by the applicant in the request.
In special cases (when the first copy of the act record is lost or when it is more convenient to obtain a certificate based on the second copy), the CSRO archives of the territorial justice bodies shall issue duplicate birth, marriage, death, and divorce certificates after verifying that the first and second copies of the act record are identical.
181. Duplicate birth certificates are issued to the person whom the civil status act record concerns, to their parents, or to other persons based on powers of attorney certified in the manner prescribed by law. A duplicate birth certificate shall not be issued for a deceased person. If necessary, a notice/extract regarding the birth of the deceased person may be issued.
Duplicate death certificates are issued to the close relatives and heirs of the deceased or to persons holding a power of attorney certified in the manner prescribed by law.
Duplicate marriage and divorce certificates are issued to the persons whom the act records concern or to persons holding a power of attorney certified in the manner prescribed by law.
Upon divorce, a duplicate marriage certificate is not issued. If necessary, a notice/extract regarding the registration of the marriage may be issued.
182. Duplicate certificates for children and legally incompetent persons are issued upon the applications of their parents (adoptive parents), guardians, tutors, or the administrations of social protection institutions for children.
183. In the absence of parents, duplicate birth certificates for minors or persons who have not yet received a citizenʼs passport (identification ID-card) are issued based on a certificate/act with the person's photograph attached, provided by the educational institution where the person studies or by the local "Mahalla" citizens' assembly at their place of residence.
184. The application for a duplicate certificate must indicate the applicant's surname, first name, patronymic, and address; the series and number of their identity document; the surname, first name, and patronymic of the person whom the certificate concerns (and in the case of a marriage certificate request—the surnames, first names, and patronymics of both spouses); when and by which CSRO body the act record was registered; and the reason for requesting the duplicate certificate.
185. A person wishing to obtain a duplicate certificate may apply through any CSRO body, regardless of their place of permanent (temporary) registration.
If the act record is registered at another CSRO body, the CSRO body that accepted the application shall send it for execution to the CSRO body that registered the act record via the "Single Electronic Archive of CSRO" information system.
When an applicant applies directly to the CSRO body where the act record is registered, the duplicate certificate shall be issued on the same day.
In cases where complete information regarding the act record specified in the application is unavailable, the CSRO body shall consider the application within a period not exceeding five days.
Duplicate certificates for persons performing military service shall be sent to their respective military units.
If the act record is not found in the CSRO body where the duplicate certificate was requested, the CSRO body shall send the application and a notice regarding the absence of the act record to the CSRO archive of the territorial justice body to conduct a relevant search and issue a duplicate certificate.
186. Upon receiving the application, the CSRO archive of the territorial justice body shall verify the original and restored act records and send the duplicate certificate.
If the act record does not exist, a corresponding notice shall be sent to the applicant.
187. When an application for a duplicate certificate is received, the search is conducted for the year specified in the application, and if not found in that year, for the previous and subsequent 3 years.
188. An identity document must be presented when obtaining a duplicate certificate.
189. If certain columns of the act record were not filled out, dashes shall be placed in those sections.
The word "Duplicate" (Takroriy) shall be marked on the upper part of the issued certificates.
190. A state duty and a stamp fee (with the exception of death certificates) are collected for the issuance of duplicate certificates.
191. Officials and other employees of the CSRO bodies performing actions, as well as persons who become aware of such actions in connection with the performance of their official duties, are prohibited from disclosing information known to them, including after the termination of their employment contract.
Copies of act records are issued (sent) upon the request of the Ministry of Justice of the Republic of Uzbekistan, courts, law enforcement agencies, notaries in connection with cases in their proceedings, as well as CSRO bodies, tutelage and guardianship authorities, and consular missions of the Republic of Uzbekistan.
The issuance of copies of act records to citizens is not permitted.
In necessary cases, representatives of the Khokimiyat (mayor's office), the defense department, healthcare institutions, the Employment Assistance Center, and the "Inson" Social Services Center of the National Social Protection Agency under the President of the Republic of Uzbekistan may, with the permission of the territorial justice bodies, extract certain information from act records for the purpose of collecting, summarizing, or comparing data.
Persons guilty of violating the secrecy of performed actions shall be held liable in the manner prescribed by legislation.
Chapter 14. Departmental Archive of CSRO Bodies
192. The archives of CSRO departments and the CSRO archives of territorial justice bodies are considered the archives of CSRO bodies.
The archives of CSRO departments consist of registers containing act records compiled within the territory of the relevant district (city).
In order to ensure the preservation of documents and archival materials, CSRO bodies enter act records into the "Single Electronic Archive of CSRO" information system, which is under the jurisdiction of the Ministry of Justice of the Republic of Uzbekistan.
193. The chairperson of a citizens' assembly involved in death registration must submit the death act records they have registered to the CSRO body.
Consular missions of the Republic of Uzbekistan must submit act records to the Ministry of Justice of the Republic of Uzbekistan through the Ministry of Foreign Affairs of the Republic of Uzbekistan.
194. Act records kept in the archives of CSRO departments are bound in the form of books and accounted for in the archive fund.
195. Act records registered by the consular missions of the Republic of Uzbekistan abroad are kept in the CSRO archive of the Tashkent City Justice Department. Subsequent actions regarding these act records are carried out by the CSRO archive of the Tashkent City Justice Department in the manner prescribed by these Rules.
196. In the absence of a separate room for the archive of the CSRO bodies, the registers of act records may be kept in iron cabinets (safes) within the workrooms.
197. The archives of CSRO bodies and the cabinets for registers must be sealed by an official of the CSRO body during non-working hours.
198. The responsibility for creating the necessary conditions for the storage of act record registers in the archives of CSRO bodies is assigned to the territorial justice bodies.
199. All marks regarding amendments introduced into the act records based on notifications received from CSRO bodies must be certified by the signature of the official of the CSRO archive of the territorial justice body and sealed with a seal bearing the coat of arms.
200. Outgoing notifications must be registered in the register of outgoing letters and notifications of the CSRO body.
201. Responsibility for the complete preservation of the act record registers in the archive of the CSRO body is assigned to the head of the CSRO department or the employee responsible for the archive of the CSRO body.
202. Territorial justice bodies provide the archives of the CSRO bodies with the necessary funds for binding the act records into book form.
203. The CSRO archives of the territorial justice bodies must have a room for visitors, a workroom, and rooms where the act record registers are stored.
The room allocated for the archive must be equipped with iron shelving and iron cabinets, and iron bars must be installed on its doors and windows.
204. The entry of unauthorized persons into the archive, their familiarization with act records, taking copies or photocopies of them, and the handing over of act record registers to them is strictly prohibited.
205. Act records are kept in the archives of the CSRO bodies for 75 years from the date they were compiled. Upon the expiration of this period, the act record registers are handed over to the CSRO archives of the territorial justice bodies.
The CSRO archives of the territorial justice bodies compare both copies of the act records with each other, introduce necessary amendments, corrections, additions, and marks, replace act records that are unfit for use, formalize them in the established manner, and hand them over to the state archive for permanent storage.
In cases where the act records were compiled in a single copy, they are handed over by the territorial justice body to the state archive for permanent storage.
206. After the expiration of the period, the second copies of the act records remaining in the CSRO archives of the territorial justice bodies are destroyed by way of burning based on a formal act.
The act regarding the destruction of act record registers due to the expiration of storage periods must be approved by the head of the territorial justice body.
207. In the event that the first copy of an act record is unavailable, the departmental CSRO archive of the justice department where the second copy of said record is kept shall send a copy of the act record or an extract from it to the relevant CSRO department.
If necessary, this departmental CSRO archive of the justice department shall introduce amendments, corrections, and additions to said act record in the manner prescribed by these Rules and send a notification regarding this to the departmental archive of the relevant CSRO department.
This excludes cases where the act record was registered in a single copy.
Chapter 15. The "Single Electronic Archive of CSRO" Information System
208. The "Single Electronic Archive of CSRO" information system is a state electronic information system that contains data on civil status acts, amendments related to act records, their restoration and annulment, as well as information on the issuance of certificates and extracts regarding the registration of civil status acts.
209. CSRO bodies ensure the timely and correct entry of civil status acts, as well as amendments, corrections, and additions to them, into the "Single Electronic Archive of CSRO" information system.
210. CSRO bodies may exchange information with each other and with other interested organizations through the "Single Electronic Archive of CSRO" information system. Information exchanged through the "Single Electronic Archive of CSRO" information system is accepted by CSRO bodies and interested organizations in their record-keeping as an official document.
Chapter 16. Reporting by CSRO Bodies, Consular Missions of the Republic of Uzbekistan, and Citizens' Assemblies
211. Consular missions of the Republic of Uzbekistan, by the 15th day of the month following each half-year, shall submit a report to the Ministry of Justice of the Republic of Uzbekistan through the Ministry of Foreign Affairs of the Republic of Uzbekistan on the registered act records and the consumed certificates bearing the coat of arms.
212. Act records registered by the chairpersons of citizens' assemblies shall be submitted to the CSRO body no later than the 2nd day of the following month. The second copy of the report is kept at the citizens' assembly.
213. Reports of CSRO bodies on act records and certificates bearing the coat of arms are obtained from the "Single Electronic Archive of CSRO" information system.
214. Act records registered by the consular missions of the Republic of Uzbekistan abroad must be submitted to the Ministry of Justice of the Republic of Uzbekistan through the Ministry of Foreign Affairs of the Republic of Uzbekistan no later than the 20th day of the month following the quarter.
Chapter 17. Accounting and Storage of Certificates with the Coat of Arms
215. Based on act records, certificates with the coat of arms are issued, which contain a serial number and series, the seal of the CSRO body and the signature of the official, as well as an imprinted QR-code (matrix barcode).
216. The heads of CSRO bodies are responsible for the accounting and storage of certificates; in citizens' self-government bodies—their chairpersons; and in the consular missions of the Republic of Uzbekistan—the consuls.
217. If the person responsible for the storage of certificates with the coat of arms is absent for valid reasons, the certificates shall be handed over based on a formal act to the official temporarily performing their duties.
218. A special notification regarding shortages, defects, loss, or theft of certificates with the coat of arms shall be sent to the Ministry of Justice of the Republic of Uzbekistan.
In every case of loss of certificates with the coat of arms, a service investigation must be conducted by the territorial justice body, and strict measures must be taken against the guilty persons in accordance with the legislation.
219. Registers for the accounting and consumption of certificates with the coat of arms must be filled out clearly and legibly.
When consuming certificates with the coat of arms, it is strictly prohibited to violate the sequence of their numbers or to cross out or erase entries in the register. Every correction made to these registers must be explained.
220. Certificates with the coat of arms must be kept in sealed safes.
Chapter 18. Inspection of the Activities of CSRO Bodies
221. The Ministry of Justice of the Republic of Uzbekistan studies the law enforcement practice of CSRO bodies.
222. The Ministry of Justice of the Republic of Uzbekistan shall inspect the activities of CSRO bodies once every two and a half years, and territorial justice bodies shall inspect them annually.
223. The activities of citizens' assemblies that report to CSRO bodies regarding act records shall be inspected by the CSRO bodies once a year.
ANNEX 4 to the Resolution of the Cabinet of Ministers No. 550 dated October 20, 2023
ADMINISTRATIVE REGULATIONS
on the Provision of Composite State Services Related to the Registration of Birth
Chapter 1. General Provisions
1. These Regulations determine the procedure for providing composite state services (hereinafter — state services) to the parents or guardian (tutor) of a newborn child, adoptive parents, persons acting in their stead, or their close relatives, or other persons authorized by one of the parents (hereinafter — applicants) regarding:
obtaining a medical certificate of birth;
registration of birth;
registration at a polyclinic;
receiving a one-time childbirth allowance;
registration of the child at the permanent residential address of the father, mother, guardian (tutor), or adoptive parent;
placing the child on the waiting list for a state preschool education organization.
2. Participants in the provision of state services:
a) Medical Institution (maternity hospital, maternity ward of a hospital, family polyclinic): enters all information about the child (surname, first name, and patronymic), parents and their marriage, the polyclinic and internal affairs department where the child will be registered, and the state preschool education organization for the waiting list into a special electronic form to generate an electronic medical birth certificate. This is automatically sent to the Civil Status Registration Office (hereinafter — CSRO department) via the "Electronic Registration of Births and Deaths, including Perinatal Deaths" automated information system.
b) CSRO department:
registers the act record of birth or refuses registration based on Clause 8 of these Regulations and sends a medical birth certificate with a QR code (matrix barcode) to the medical institution, ensuring composite access to other state services;
upon the request of applicants at any time, issues a birth certificate with the coat of arms based on the extraterritorial principle.
c) National Social Protection Agency under the President of the Republic of Uzbekistan (hereinafter — National Social Protection Agency):
formalizes the one-time allowance given at the birth of a child and sends an SMS notification to the applicant regarding the service result;
at the beginning of each payment month, finances funds to the account of the Joint-Stock Commercial "Xalq Banki" (hereinafter — Xalq Bank) in an amount not less than the total sum of one-time birth allowances paid in the previous month;
sends an SMS notification to the applicant confirming payment after the allowance is paid by Xalq Bank or transferred to the applicant's bank card.
d) Register the child at the polyclinic where the mother is registered (if not registered, at the polyclinic corresponding to her permanent or temporary residential address) and send an SMS notification to the applicant regarding the assigned polyclinic.
e) Register the child at the permanent residential address of the father, mother, guardian (tutor), or adoptive parent via the "Manzil" automated information system and send an SMS notification to the applicant regarding the service result.
f) Places the child on the waiting list for the state preschool education organization specified in the questionnaire and sends an SMS notification to the applicant regarding the service result.
g) Transfers the one-time allowance amount to the applicant's bank card at their request or performs the payment of the one-time birth allowance to a citizen who applies, after confirming the citizen's right to the allowance through an electronic request to the National Social Protection Agency.
Costs associated with sending SMS notifications to the applicant are covered by the extra-budgetary funds of ministries and agencies or other funds not prohibited by legislation.
3. The requirements of these Regulations shall not apply in the following cases:
registration of a birth born to unmarried parents based on their joint application (establishment of paternity);
registration of a birth based on the application of an unmarried mother (single mother);
registration of the birth of a foundling (abandoned child);
registration of a stillborn child, a child who died in the first week of life (perinatal death), or the registration of a living twin when one of the twins was stillborn or died in the first week of life (perinatal death).
4. Information exchange between the CSRO body, medical institutions, district (city) internal affairs departments, the National Social Protection Agency, Xalq Bank, and the Ministry of Preschool and School Education (hereinafter — authorized bodies) is carried out exclusively through inter-agency electronic interaction.
In the provision of state services, a fee is collected for the permanent registration of the child and the formalization of the birth certificate as established in Clause 11 of these Regulations; other state services are provided free of charge.
5. The provision of the state service is carried out according to the scheme in Annex 1 of these Regulations.
Chapter 2. Procedure for the Provision of State Services
6. An employee of the medical institution where the child was born, within 1 working day after the birth, enters information about the child and the surname, first name, and patronymic assigned to them, as well as data regarding the parents and their marriage, into the "Electronic Registration of Births and Deaths, including Perinatal Deaths" information exchange system.
In this process:
information regarding the child's parents is entered based on their identity documents;
information regarding their marriage is entered based on the marriage certificate.
In the absence of identity documents for the parents, the registration of the child's birth is carried out based on written applications from the medical institution or the tutelage and guardianship authority.
If no more than 300 days have passed from the time of the father's death, the date of divorce, or the date the marriage was declared void by a court prior to the birth, the applicant shall present a divorce certificate, an extract (copy) of the court decision on divorce, an extract (copy) of the legally binding court decision declaring the marriage void, or the father's death certificate.
At the request of the father or mother, the medical institution employee fills out a questionnaire, in the form according to Annex 2 of these Regulations, to utilize the composite services specified in Clause 10 of these Regulations via the "Electronic Registration of Births and Deaths, including Perinatal Deaths" information exchange system.
Parents may, at their discretion, use all of these composite services simultaneously or select specific ones, with the exception of the permanent registration of the child.
Data is automatically sent to the "Single Electronic Archive of CSRO" information system, and a certificate is generated in the "Electronic Registration of Births and Deaths, including Perinatal Deaths" system on a form equipped with a QR code (matrix barcode).
If the CSRO department refuses to register the birth, the medical institution employee shall rectify the deficiencies within 3 working hours and resubmit the questionnaire.
7. The CSRO department:
Within 1 working day, verifies the information about the child, the parents, and their marriage in accordance with the Rules for the Registration of Civil Status Acts, registers the birth act record in the "Single Electronic Archive of CSRO" information system, and sends a birth certificate equipped with a QR code (matrix barcode) according to Annex 3 of these Regulations to the medical institution. To ensure composite access to the state services specified in Clause 10 of these Regulations, it sends the child's information to the information systems of the authorized bodies;
In cases where the data received through the electronic system contradicts legislative acts, refuses to register the act record based on Clause 9 of these Regulations and sends a notification equipped with a QR code, indicating the specific reasons for refusal, in the form according to Annex 4 of these Regulations to the medical institution;
Within 1 working hour after the resubmission of the questionnaire, registers the birth act record and sends the birth certificate equipped with a QR code (matrix barcode) to the medical institution.
Upon the request of applicants at any time, the CSRO department issues a birth certificate with the coat of arms based on the extraterritorial principle.
8. The formalization of a birth act record may be refused in the following cases:
if the registration of birth contradicts the legislation;
if the submitted information does not comply with the requirements established for them in legislative acts;
if the person applying for the registration of birth is not authorized to do so or has been declared legally incompetent by a court.
9. After receiving information from the CSRO department through information systems:
a) District (city) internal affairs departments shall, within 1 working day, register the child at the permanent residential address of the father, mother, guardian (tutor), or adoptive parent via the "Manzil" (Address) information exchange system of the Ministry of Internal Affairs and send an SMS notification to the applicant regarding the service result. In cases where the child is registered at an address where neither the father nor the mother is permanently registered, registration shall be carried out in accordance with the procedures established by the Cabinet of Ministers Resolution No. 845 dated October 22, 2018, and Resolution No. 320 dated May 22, 2020.
b) The Preschool Education Management Information System of the Preschool Education Agency under the Ministry of Preschool and School Education shall automatically place the child on the waiting list for the state preschool education organization specified in the questionnaire and send an SMS notification to the applicant regarding the service result.
c) The "Single National Social Protection" information system of the National Social Protection Agency shall automatically formalize the one-time childbirth allowance and send an SMS notification to the applicant.
Effective from April 1, 2024, the one-time childbirth allowance is formalized for:
the first child: for all women;
the second child: for women who are members of a family registered in the "Social Register" at the time of the child's birth.
In all other cases, the formalization of the one-time childbirth allowance shall be denied. To receive the allowance, the father or mother must apply to any branch of JSC "Xalq Banki" within 6 months of the child's birth, presenting their identity documents.
d) The Xalq Bank branch confirms the citizen's right to the allowance by sending an electronic request to the National Social Protection Agency and processes the payment from pre-financed funds. Information confirming the payment is sent to the applicant via SMS.
The payment of the one-time allowance shall be denied if:
the person applying has no legal right to it;
the person is declared legally incompetent by a court;
the application is made more than 6 months after the birth;
the allowance has already been paid to one of the parents.
e) The "Electronic Polyclinic" information exchange system of the Ministry of Health registers the child at the polyclinic where the mother is registered (or the polyclinic at the permanent or temporary residential address if she is not registered) and sends an SMS notification confirming the enrollment.
10. Applicants may obtain the formal Birth Certificate at any time based on the birth notice equipped with a QR code (matrix barcode). To do so, applicants fill out an electronic request via the Single Interactive State Services Portal (my.gov.uz) or apply directly to a CSRO department.
11. Within 1 working day of receiving the request, the CSRO department formalizes the birth certificate and provides it to the applicant.
The birth certificate with the coat of arms is issued upon payment of the established stamp fee (gerb yig'imi).
At the applicant's request, the certificate may be delivered via postal service. Postal expenses are covered by the applicant, and the service fee is determined by the postal provider.
12. The state service for the permanent registration of the child is carried out without collecting a state duty from the amount of the one-time allowance.
Chapter 3. Final Provisions
13. The authorized bodies must ensure the confidentiality of information regarding applicants obtained as a result of their activities.
14. The Ministry of Justice of the Republic of Uzbekistan, the Ministry of Justice of the Republic of Karakalpakstan, the justice departments of the regions and Tashkent city, and the Public Service Centers shall carry out constant monitoring over the activities of state bodies and other organizations regarding the implementation of the requirements of these Regulations.
15. The applicant may appeal against the actions or omissions of the employees of state bodies and other organizations in the manner prescribed by legislative acts.
16. Persons guilty of violating the requirements of these Regulations shall be held liable in the manner prescribed by legislative acts.
ANNEX 5 to the Resolution of the Cabinet of Ministers No. 550 dated October 20, 2023
ADMINISTRATIVE REGULATIONS
on the Provision of Composite State Services Related to the Registration of Death
Chapter 1. General Provisions
1. These Regulations determine the procedure for providing composite state services (hereinafter — state services) to the husband (wife), parents, children, and other relatives or the legal representative of the deceased, or in their absence, to any other person who has undertaken the obligation to carry out the burial (hereinafter — applicants) regarding:
issuing a medical certificate of death;
registration of death;
issuing a certificate to the cemetery for burial;
granting a burial allowance.
2. Participants in the provision of state services:
a) Medical Institutions, specialized hospitals for convicts, and medico-social institutions (hereinafter — medical institutions): Enter information about the deceased person into a special electronic form to generate an electronic medical death certificate. This is automatically sent via the "Electronic Registration of Births and Deaths, including Perinatal Deaths" automated information system (hereinafter — automated information system) to the Civil Status Registration Office (hereinafter — CSRO department) located in the area where the medical institution is situated, for the purpose of registering the death act record.
Note: Upon the request of applicants, the electronic medical death certificate may be provided in paper form, and they may apply directly to any CSRO body.
b) CSRO department:
upon receipt of a medical certificate of death from a medical institution, automatically registers a death act record via the "Single electronic archive of CSRO" information system and sends an electronic death certificate to the medical institution, as well as to the information systems of the Off-budget Pension Fund under the Ministry of Economy and Finance of the Republic of Uzbekistan (hereinafter — the Pension Fund) and the “Single National Social Protection” information system of the National Social Protection Agency under the President of the Republic of Uzbekistan (hereinafter — the National Social Protection Agency);
formalizes and issues a death certificate with the coat of arms based on the extraterritorial principle upon the request of the deceased's next of kin and heirs (or, in their absence, other persons who have undertaken the obligation of burial) at any time, or sends it via postal service to the address specified in the application. Postal expenses shall be covered by the applicant.
In this case:
information about the applicant (Full name, degree of kinship to the deceased, or status as an heir) shall be entered into a special electronic form in the "Single electronic archive of CSRO" information system;
if persons who are not the next of kin or heirs of the deceased apply for a death certificate with the coat of arms, a certificate from the citizens' self-government body (mahalla) confirming the absence of next of kin and heirs and stating that the applicant has undertaken the obligation of burial shall be required;
the amount of the fee for the service provided by the postal service shall be determined by the postal service;
c) Medical Institution: Prints the death notice received automatically via the CSRO system, equipped with a QR code (matrix barcode), and provides it to the applicants for submission to the cemetery.
d) National Social Protection Agency:
By the 5th day of each month, finances funds to the account of a commercial bank or other specialized organization (hereinafter — commercial bank) in an amount not less than the total sum of burial allowances paid in the previous month.
Confirms the citizen's right to the allowance by comparing the electronic request from the commercial bank with the data entered in the CSRO system regarding the person who received the official death certificate.
e) Commercial Bank: Processes the payment of the burial allowance based on the official death certificate issued by the CSRO department and the identity documents of the applicant, after confirming the applicant's eligibility via an electronic request to the National Social Protection Agency.
3. The requirements of these Regulations DO NOT apply in the following cases:
If a birth act record was never registered for a deceased minor in a CSRO department;
When registering a death based on a court decision declaring a citizen deceased;
When registering deaths that were not recorded within the timeframes established by law;
When registering the death of unidentified persons;
When registering the death of foreign citizens or stateless persons who do not have a Personal Identification Number (PINFL) in accordance with the legislation of the Republic of Uzbekistan. Note: Registration for these categories is carried out according to the general procedures established by law.
4. Inter-agency Information Exchange: Information exchange between the medical institution, CSRO department, Pension Fund, National Social Protection Agency, and the commercial bank (hereinafter — authorized bodies) is carried out exclusively through inter-agency electronic interaction. No fee is collected for the provision of these state services.
5. The provision of state services is carried out according to the scheme in Annex 1* of these Regulations.
Chapter 2. Procedure for the Provision of State Services
6. After the state of biological death is confirmed in the established manner (pathological-anatomical, forensic medical examination, etc.), a medical institution employee shall, within one hour, enter information about the deceased into the automated information system in the form of a questionnaire according to Annex 2* of these Regulations to generate an electronic medical death certificate. This information is automatically sent to the CSRO department located in the area of the medical institution to register the death act record.
In this process:
information regarding the deceased is entered based on their identity documents;
the medical death certificate is automatically sent to the "single electronic archive of csro" information system;
upon the request of applicants, the medical death certificate may be provided to them with a QR code (matrix barcode), and they may also apply directly to a CSRO department.
7. The CSRO Department:
upon receipt of the medical death certificate from the medical institution, automatically registers the death act record via the "single electronic archive of CSRO" and sends an electronic death notice in the form according to annex 3* of these regulations to the medical institution, the pension fund, and the national social protection agency;

upon the request of close relatives and heirs (or other persons who have undertaken burial obligations) at any time, formalizes and issues a death certificate with the coat of arms based on the extraterritorial principle or sends it via postal service to the address specified in the application.
8. The medical institution prints the death notice equipped with a QR code (matrix barcode) and provides it to the applicants for submission to the cemetery.
9. Based on the information received through the "Single Electronic Archive of CSRO," the Pension Fund automatically terminates the pension payments assigned to the deceased in the information system.
9.1. The National Social Protection Agency:
Automatically terminates any allowance payments assigned to the deceased in the information system based on the data received via the "Single Electronic Archive of CSRO";
Forms and maintains a list of paid burial allowances based on electronic data from the commercial bank;
Finances the commercial bankʼs account by the 5th day of each month with an amount not less than the total burial allowances paid in the previous month. If the final day of financing falls on a weekend or public holiday, the next working day shall be considered the final day of the term.
Applicants may apply to any branch of the commercial bank within 60 days of the death registration to receive the burial allowance, presenting the official death certificate with the coat of arms and their identity documents.
10. The Commercial Bank: Confirms the citizen's right to the burial allowance by sending an electronic request to the National Social Protection Agency based on the official death certificate issued by the CSRO department and processes the payment from pre-financed funds.
The burial allowance is paid to individuals who have been issued the official death certificate by the CSRO department;
The burial allowance may be paid via a power of attorney in the manner prescribed by law;
The burial allowance is financed by the State Budget of the Republic of Uzbekistan in the amount of four times the base pension calculation amount;
If the burial was delayed for justified reasons (searching for the deceased, bringing the body from a foreign country, etc.), the allowance amount is calculated based on the base pension calculation amount effective on the day of burial, supported by relevant documents;
Payment of the burial allowance is denied if the applicant has no legal right to it, is declared legally incompetent by a court, or applies more than 60 days after the death was registered.
Staff of the organizations providing these composite services or commercial bank employees are strictly prohibited from formalizing the burial allowance in their own name on behalf of a citizen.
Chapter 3. Final Provisions
11. Authorized bodies must ensure the confidentiality of information regarding applicants obtained during their activities.
13. The Ministry of Justice of the Republic of Uzbekistan, the Ministry of Justice of the Republic of Karakalpakstan, and the justice departments of the regions and Tashkent city shall carry out constant monitoring over the implementation of the requirements of these Regulations.
14. The applicant may appeal against the actions or omissions of the employees of state bodies and other organizations in the manner prescribed by legislation.
