On insolvency (LRU-763-son) · Date: 12.04.2022 · In force
The candidature of the rehabilitation manager shall be submitted to the court by the meeting of creditors or by the persons who have provided security for the fulfillment of obligations.
The rehabilitation manager shall act from the moment the judicial rehabilitation procedure is introduced and until the end of the judicial rehabilitation procedure or its early termination.
The rehabilitation manager may be released by the court at his own request or at the request of a meeting of creditors or persons who provided security for the fulfillment of obligations, as well as in other cases provided for by this Law.
The ruling of the court on the release of the Rehabilitation manager from the performance of duties with the simultaneous appointment of a new Rehabilitation manager may be appealed (protested against). An appeal (protest) against the said ruling shall not suspend its execution.
Termination of insolvency proceedings in connection with the restoration of the debtor's solvency during the judicial rehabilitation procedure shall entail the termination of the rights and obligations of the rehabilitation manager.
If a court has issued a ruling on the introduction of an external management procedure or a decision has been adopted on declaring the debtor bankrupt and initiating liquidation proceedings, and another person has been appointed as an external manager or liquidation manager, the rehabilitation manager shall continue to perform duties until the affairs are transferred to an external manager or liquidation manager.
