Article 67. Consequences of Invalidity of Transaction
On insolvency (LRU-763-son) · Date: 12.04.2022 · In force
Where the transaction concluded by the debtor is declared invalid by the court and the consequences of the invalidity of this transaction are applied, the party shall be obliged to return to the other party everything received under the transaction, and if it is impossible to return what was received in kind (including when the received is expressed in the use of property, performed work or service provided) to reimburse its value in money, unless other consequences of the invalidity of the transaction are provided by law.
In this respect, the party that concluded the transaction with the debtor shall have the right to bring a claim against the debtor, the requirements of which must be satisfied in accordance with this Law.
If, in the cases provided for by this article, it is impossible to return the property in kind due to the loss, damage or unjustified acquisition of property by third parties, the original buyer of the property shall be liable to the debtor to compensate for the value of such property.
Where it is impossible to return the value of the property, the person who made the decision to alienate the debtor's property may be held subsidiary liable in the manner prescribed by this Law.
