Article 179. Special Considerations with Respect to Sale (Assignment) of Property and Property Rights of Agricultural Enterprises
On insolvency (LRU-763-son) · Date: 12.04.2022 · In force
When selling (assigning) the debtorʼs property, the judicial manager or the head of the debtor must put up for sale in the first bidding in the form of an electronic online auction an agricultural enterprise as a property complex.
The pre-emptive right to acquire the debtor's property, as well as the right to own land, shall be held by persons engaged in the production of agricultural products and owning a land plot directly adjacent to the debtor's land plot. When selling (assigning) the said property, as well as property rights, the judicial manager or the head of the debtor shall be obliged to organize an assessment of the value of the said property and property rights and offer persons to purchase this property at the appraised value.
If the persons referred to in the second part of this article have not declared their desire to acquire the property and property rights of an agricultural enterprise within one month, the judicial manager or the head of the debtor shall sell the property in accordance with the legislation.
In case of liquidation of an agricultural enterprise due to insolvency, the right to use the land plots granted to it may be alienated or transferred to another person in the manner prescribed by legislation.
