Article 167. Refusal to Approve Settlement Agreement by Court

On insolvency (LRU-763-son) · Date: 12.04.2022 · In force

In case of failure to fulfill the obligation to pay expenses and satisfy the requirements specified in the first part of Article 165 of this Law, the court shall refuse to approve the settlement agreement.

The court shall also refuse to approve a settlement agreement in the following cases:

violation of the procedure for concluding a settlement agreement established by this Law;

non-compliance with the form of a settlement agreement;

violation of the rights of third parties;

contradictions of conditions of the settlement agreement to the legislation.

The court shall issue a ruling on refusal to approve a settlement agreement, which may be appealed (protested against).
