Article 116. Claims of Creditors
On insolvency (LRU-763-son) · Date: 12.04.2022 · In force
Creditors shall have the right to present their claims against the debtor at any time during the term of the external management procedure. These claims shall be forwarded to the external manager at the postal address of the location and (or) the electronic postal address of the debtor. Claims of creditors recognized as established in accordance with paragraph four of this article shall be sent to the external manager with documents attached, which make it possible to determine the said claims as established.
The external manager shall consider the claims of creditors and, based on the results of their consideration, make an appropriate entry in the register of creditors' claims no later than two weeks after receiving the respective claim. The external manager shall notify the relevant creditor of the results of the consideration within a period not exceeding one month from the date of receipt of the creditor's claims.
Objections based on the results of consideration by the external manager of the creditors' claims may be filed by the creditor with the court considering the insolvency case within one month from the date of receipt of the notification.
Claims of creditors for which no objections have been filed within the period provided for by part three of this article shall be considered established in the amount, composition and priority of satisfaction determined by the external manager.
The creditor may independently transfer the right of claim from the debtor to other persons in a notarial procedure. In this respect, the person who has acquired the right to claim must apply to the debtor's external manager within ten days to include the claim in the register of creditors' claims.
