On next reforms to create conditions for stable economic growth by improving business environment and developing private sector (DP-101-son)

of the President of the Republic of Uzbekistan

In order to implement the Development Strategy of New Uzbekistan for 2022 — 2026, reduce poverty by half by achieving inclusive and stable economic growth, ensuring competition in the economy, creating equal conditions for business entities, accelerating a full transition to market relations, increasing the competitiveness of the national economy, and also sharply increasing private investment and further strengthening the trust of the business community, I hereby decree:

1. To determine the following as the main directions for enhancing the role of the private sector in ensuring economic growth, creating favorable conditions for the development of the private sector in all sectors and industries:

continuation of institutional and administrative reform in the field of guaranteeing the inviolability of private property and freedom of entrepreneurial activity, as well as ensuring the rule of law in this direction;

use of mechanisms for the privatization of non-agricultural land plots on a transparent basis, primarily as an important factor for attracting investors, as well as the creation of infrastructure and other necessary conditions for increasing the attractiveness of land plots when they are put up for auction;

liberalization of the market for goods and services, in which state participation is preserved, creation of conditions for the promotion of the private sector in these areas, as well as the formation of a healthy competitive environment by strengthening the institutional capacity and powers of the antimonopoly authority;

abolition of benefits, exclusive rights and advantages through the targeted application of the “regulatory guillotine” method;

accelerating the transformation and privatization of enterprises and commercial banks with the participation of the state, stimulating an increase in qualitatively new, in particular, based on the principles of environmental, social and corporate governance (ESG), investments and highly efficient production technologies by reducing the share of inefficiently functioning enterprises in the economy;

giving impetus to the development of various segments of the financial market through further liberalization of the monetary market and the capital market, thus creating conditions for the formation of alternative sources of financing for enterprises that have been privatized and are in the process of transformation;

accelerating the involvement of foreign investors in geological exploration, mining and processing in order to provide a guaranteed raw material base for industries that drive the economy, in particular the mining, oil and gas, chemical industries, building materials industries and other areas, as well as supporting the increase in reserves of the mineral resource base;

development of the market for energy resources, transport, communications and creation of conditions for attracting private investment to these areas;

sharp increase of public-private partnership projects in the field of drinking water and sewerage, heat supply, landscaping, road construction and aviation infrastructure;

intolerant attitude to any manifestations of corruption and uncompromising fight against it in all spheres and sectors;

prevention of corruption through the widespread introduction at enterprises and commercial banks with the participation of the state of modern methods of corporate governance, including the system of “compliance control”, ensuring the transparency of the procurement system.

2. In order to speed up privatization processes, increase the attractiveness of the investment climate and create additional amenities for investors who have acquired state assets (state packs of shares, participations, real estate objects):

In the sale of non-agricultural land plots based on ownership rights via auction, the right to installment payment shall be granted in accordance with the procedure established by legislation;

to provide buyers of state assets and non-agricultural land plots sold with the condition of payment in installments, who made a lump sum initial payment of not less than 35 percent, the right to pledge these state assets and land plots as a loan security.

For business entities with an "AA" rating or higher operating in category 4 and 5 districts, in cases where the initial payment for state assets sold on an installment basis is less than 35 percent, no annual interest at the rate of the Central Bank's key rate shall be charged on the remaining amount, and the installment payment period shall be set at 7 years (in equal installments), excluding cases where the purchasers are business entities with a state share of 50 percent or more in their authorized capital.

Purchasers who have paid an initial payment of at least 35 percent (at least 15 percent for land plots based on ownership rights located in category 4 and 5 districts) for state assets and non-agricultural land plots sold on an installment basis, within one month from the date of the conclusion of the sales contract, shall be granted the right to pledge such state assets and land plots as collateral for credit security.

To the Cabinet of Ministers within a month to develop and approve the procedure for granting the right to pledge state assets and land plots as a loan security, introduced by the third subparagraph of this paragraph.

3. From May 1, 2022, to grant citizens of foreign states the right to make investments in the form of acquiring the following new real estate objects under construction (with the exception of land plots), the list of which is approved by the Cabinet of Ministers, without requiring a residence permit in the Republic of Uzbekistan:

in the Tashkent region, the cities of Tashkent and Samarkand — real estate objects, the value of which, in accordance with contracts concluded during the construction period, is not less than the equivalent of 150,000 US dollars, real estate objects accepted for operation, the value of which not less than the equivalent of 180,000 US dollars ;

in other regions — real estate objects, the value of which, in accordance with contracts concluded during the construction period, is not less than the equivalent of 70,000 US dollars, real estate objects accepted for operation, the value of which not less than the equivalent of 85,000 US dollars.

In this case, the purchase of the immovable property referred to in this paragraph by foreign nationals shall not constitute grounds for registration at a place of residence in the Republic of Uzbekistan or for obtaining a residence permit.

4. To reduce the amount of the value of real estate required to obtain a residence permit in the Republic of Uzbekistan by citizens of foreign countries, subject to the acquisition of real estate in accordance with Appendix No. 6 to the Decree of the President of the Republic of Uzbekistan dated January 5, 2019 No. UP-5611 in the city of Tashkent and Tashkent region from 400,000 US dollars to 300,000 US dollars.

5. With the aim of further improving the competitive environment in the economy and reducing bureaucratic barriers facing the private sector, the following proposals of the Ministry of Economic Development and Poverty Reduction, the Committee for Competition Promotion and Consumer Protection, the Ministry of Finance, and the Ministry of Justice shall be approved:

a) non-recognition as occupying a dominant position in the commodity or financial market and non-application of antimonopoly measures to legal entities or individual entrepreneurs or a group of persons (with the exception of subjects of natural monopolies, participants in public procurement and exchange trading, as well as business entities whose product price is regulated by the state ), the proceeds from the sale of goods (services) of which for the last calendar year does not exceed the ten thousandth of the base calculation value;

b) application from September 1, 2022 of financial sanctions against economic entities that have committed anti-competition actions:

agreements (concerted actions) and coordination of economic activities that led to the restriction of competition in the commodity and financial markets;

abuse of a dominant (monopoly) position in the commodity and financial markets and excellent bargaining power, unreasonable overpricing of products of social and strategic importance, as well as unfair competition;

violations of competition law in the event of a merger, acquisition, as well as the conclusion of agreements on the acquisition of shares (stakes) in the authorized fund (authorized capital) of economic entities;

committing anti-competitive actions in public biddings and violating antitrust requirements.

To the Cabinet of Ministers, by July 1, 2022, to submit to the Legislative Chamber of the Oliy Majlis a draft law “On Competition” in a new edition, which shall provide for specific amounts and procedures for applying financial sanctions. In this respect, to provide for the full direction of the collected amounts from financial sanctions to the State budget, as well as liability for other types of anti-competitive actions;

c) strengthening from September 1, 2022 administrative liability for:

illegal restriction by public authorities and administration of free movement and sale of raw materials, goods and services;

adoption of decisions restricting competition by state unitary enterprises or institutions, associations of legal entities empowered to license, register, accredit and issue permits;

failure to submit the necessary documents and data at the request of the antimonopoly authority, as well as the submission of false or inaccurate information.

To the Cabinet of Ministers, by July 1, 2022, to submit a draft of the relevant law to the Legislative Chamber of the Oliy Majlis;

d) Starting from January 1, 2023, the introduction of a Competition Development Index, regarding which the Committee for Competition Promotion and Consumer Protection shall report annually to the Senate of the Oliy Majlis.

e) introduction from January 1, 2023 of the Competition Development Index with the annual submission of information by the Antimonopoly Committee to the Senate of the Oliy Majlis.

6. To the Ministry of Economic Development and Poverty Reduction, together with the Antimonopoly Committee, the Ministry of Finance and the Ministry of Justice, within two months, to submit a draft resolution on accelerating the wide involvement of the private sector in the provision of public services and the implementation of public functions.

7. To the Ministry of Finance and the Agency for State Assets Management, together with interested departments, by the end of 2022, to create the possibility of remote opening of securities accounts for clients who are residents and non-residents of the Republic of Uzbekistan, without their personal participation, with account taken of the requirements of the legislation on combating legalization of proceeds from crime and financing of terrorism.

8. To approve the proposal of the Ministry of Finance to establish from May 1, 2022 the tax rate on personal income on income received by non-resident natural persons from sources in the Republic of Uzbekistan (excluding dividends, interest and freight income), in the amount of 12 percent.

To the Ministry of Finance, together with the departments concerned, within two months, to submit to the Cabinet of Ministers a draft law on amendments and additions to the Tax Code arising from this clause.

9. In order to create equal competitive conditions for business entities, as well as to regulate the provision of benefits for tax and customs payments:

a) starting May 1, 2022:

to extend tax and customs benefits applicable to a limited number of entities to all entities of the industries provided for in Annex No. 2 with the aim to create equal competitive conditions for business entities;

cancel tax and customs benefits for goods (services) purchased at the expense of funds (loans, credits) of international financial institutions and foreign government financial organizations under international treaties of the Republic of Uzbekistan, approved before July 1, 2020, refinanced or reloaned through commercial banks of the Republic of Uzbekistan. This rule shall apply to goods (services) purchased on the basis of newly concluded agreements (regardless of the form and method of formalization) between commercial banks and business entities;

b) abolish in stages certain tax and customs benefits in accordance with Appendix No. 3;

c) to the Cabinet of Ministers to critically review the need to prolong the validity of certain tax and customs benefits provided by the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan, identified as a result of the inventory, and, by August 1, 2022, submit proposals for their cancellation;

d) starting from July 1, 2022:

to provide benefits for customs duties solely on the basis of the laws of the Republic of Uzbekistan. In this respect, obtaining the opinion of the Council on Tariff and Non-Tariff Regulation shall be considered mandatory;

to heads of sectoral ministries and departments, local public authorities annually, by March 1, to submit reports to the Ministry of Finance and the State Tax Committee on the effectiveness of certain tax and customs benefits provided for the development of the sector and (or) territories, based on the results of each year.

10. To the Ministry of Finance, together with the State Assets Management Agency, the Ministry of Energy, the Ministry of Economic Development and Poverty Reduction, the Ministry of Transport and the Antimonopoly Committee:

a) by May 1, 2022, to begin work on the privatization of Uzbekneftegaz JSC by the end of 2022, including through a public offering (IPO) of shares in the amount of at least 49 percent, as well as a state share in the amount of 51 percent and more in “Teploviye Elektricheskiye Stansii” JSC, with the involvement of an experienced investment bank;

b) by September 1, 2022, to submit for approval to the Cabinet of Ministers the Strategy for Reforming Uzbekhydroenergo JSC, on the basis of the conclusions of an international consulting company.

In this respect, to consider as a priority the implementation of projects with the participation of the private sector, including on the basis of public-private partnership conditions, in the process of building new small and medium-sized hydroelectric power plants;

c) by September 1, 2022, to start work on putting up for bidding a state share of 51 percent or more in the authorized capital of Uzbekistan Airways JSC, including through a public offering (IPO) of shares;

d) by August 1, 2022, to ensure a public offering (IPO) on the local stock market of up to 10 percent of a block of shares of UzAuto Motors JSC and to submit to the Cabinet of Ministers a Strategy for the sale to strategic investors of the remaining share of this enterprise, as well as UzAuto Motors Powertrain JSC, Samarqand Avtomobil zavodi LLC, with the involvement of an international investment bank and consultants.

11. To the Cabinet of Ministers within two months to ensure:

obtaining an international credit rating for JSC “National Electric Grids of Uzbekistan” — until the end of 2023, JSC “Uztransgaz” — until the end of 2024, with providing for the preservation of the main networks of JSC “National Electric Grids of Uzbekistan” and JSC “Uztransgaz” at the full disposal of the state, as well as achievement of independent attraction of funds from international banks and the capital market with strict observance of financial discipline;

by September 1, 2022, based on the conclusions of international financial institutions and consultants, to improve the activities of Khududgaztaminot JSC and Regional Electric Grids JSC, including increasing operational efficiency and attracting the private sector to these areas, while to adopt a decision to transfer to a private operator the functions of wholesale purchase and sale of natural gas and electricity, without increasing the tariffs set for the population, initially on an experimental basis in fourteen cities and districts of the country.

12. To the Ministry of Economic Development and Poverty Reduction, the Ministry of Finance, the Ministry of Transport, the State Assets Management Agency and the Antimonopoly Committee:

a) within two months, to submit to the Cabinet of Ministers a draft resolution on the transfer of regional international airports and the international airport of Tashkent, which are under the jurisdiction of Uzbekistan Airports JSC, for management to the private sector on the basis of public-private partnership conditions for modernization and increasing their operational efficiency. In this respect, to provide for measures for the efficient operation of airports in the Ferghana Valley by optimizing them;

b) within a month, to involve the World Bank and ensure the development by June 1, 2022 of the Strategy for the transformation, development and privatization of Uzbekistan Temir Yollari JSC.

To approve the Special Working Group on the transformation of Uzbekiston temir yullari JSC in the composition in accordance with Annex No. 4 .

To the working group (D.A. Kuchkarov) by August 1, 2022, to submit a draft resolution on the transformation of Uzbekistan Temir Yollari JSC, which shall provide for:

improving the tariff policy by creating a transparent and flexible tariff system aimed at developing the activities of private operators with their own passenger and freight wagons, as well as developing competition in the rail transport services market;

improving the efficiency of operational and business processes at railway transport enterprises, including the integration of relationships between service organizations and consumers through digital transformation;

transfer to the private sector of domestic and international rail freight and passenger traffic on the basis of public-private partnerships or franchises;

c) by August 1, 2022, together with international financial institutions, within the framework of the Concept for the Development of the Public Transport System of the City of Tashkent until 2025, to ensure the development and submission to the Cabinet of Ministers of proposals on attracting the private sector to the operation of public transport, including the implementation of projects based on the conditions of the public-private partnership.

To the Cabinet of Ministers, by December 1, 2022, using the example of the city of Tashkent, to develop and start implementing the Strategy for the Development of Public Transport Infrastructure in the city of Nukus and in all regional centers.

13. To approve the Special Working Group on Reforming the Committee on Roads, composed in accordance with Annex No. 5 .

To the Working Group (T.A. Ishmetov) within two months to submit to the Cabinet of Ministers a draft resolution on reforming the Committee on Roads by removing contracting and manufacturing enterprises from its composition in order to specifically distinguish between regulatory and economic functions, demonopolization, attracting private sector enterprises and increasing the effectiveness of the use of budgetary funds in this sector.

14. To the Ministry for the Development of Information Technologies and Communications, together with the Ministry of Finance, the State Assets Management Agency and engaged professional consultants, by September 1, 2022, to ensure the development and submission for approval to the Supervisory Boards of the Strategy for Reforming Uzbektelecom JSC and Uzbekiston Pochtasi JSC.

15. In order to increase the efficiency and responsibility of the management bodies of business entities with a state share of 50 percent or more and state unitary enterprises (hereinafter referred to as enterprises with state participation), to establish that:

starting from April 1, 2022, a person appointed (reappointed) as the head of the executive body cannot be the head of the executive body for more than two consecutive terms;

starting May 1, 2022, the Strategy and Investment Committee, the Audit Committee, the Appointment and Remuneration Committee, the Anti-Corruption and Ethics Committee shall be formed from among the members of the Supervisory Board;

activities of the members elected to the Supervisory Board for the state share shall be evaluated on the basis of such criteria as the effective organization of transformation processes at the enterprise, optimization of the external debt of the enterprise, the introduction of a modern procurement system, the fulfillment of the requirements provided for by this Decree, as well as the attraction of alternative funds for financing investment projects.

17. To agree with the proposal of the Ministry of Finance and the Ministry of Economic Development and Poverty Reduction on the introduction of a special management system aimed at the effective organization of transformation and privatization processes in joint-stock companies specified in Annex No. 6. Wherein:

chairperson of the Committee for Strategy and Investments of the Supervisory Board of the company shall be appointed from among its independent members and this committee shall be entrusted with the tasks of constant management of the processes of transformation and privatization of the enterprise;

position of the first deputy head of the executive body of the company for transformation issues shall be introduced and a project office reporting to them shall be created;

all deputy heads and structural subdivisions of the executive body of the company shall be accountable to the first deputy head of the executive body for transformation issues on issues related to the transformation;

cost estimate of the first deputy head of the executive body for transformation and the project office of the company shall be approved by the Supervisory Board separately;

Supervisory Board shall establish a separate remuneration to the head of the executive body for the timely and high-quality implementation of privatization processes, including public offering of shares (IPO) (with the exception of incentives provided for in paragraph 16 of this Decree), or measures of liability for failure to implement them.

18. In order to limit and reduce the participation in the economy of enterprises with the participation of the state, in cases where decisions of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan do not provide otherwise, to prohibit them to:

acquire or construct new real estate objects that do not correspond to their main activity;

engaging in additional activities unrelated to the main activity in a sector where competition is developed;

take part in or acquire shares in the authorized capital of business entities that do not correspond to the specifics of their core business.

To determine that the acquisition or construction of new real estate objects, the acquisition of shares in the authorized capital of business entities and the implementation of additional activities corresponding to the main activities of enterprises with state participation, shall be carried out on the basis of a decision of the Supervisory Board.

19. To establish an order in accordance with which:

agreements (transactions, contracts, memorandums, etc.) of enterprises with the participation of the state and commercial banks with a state share of 50 percent or more on the alienation, forms and mechanisms for the sale of property, making investments in the authorized capital of enterprises with the participation of the state and enterprises in their composition by third parties persons shall be concluded after mandatory agreeing with the Supervisory Board of these enterprises;

annual expenses of enterprises with the participation of the state for charity should not exceed three percent of their net profit received for the previous year, and shall be carried out upon meeting the indicators of their business plan in terms of net profit for the previous reporting year (except for cases provided for by decisions of the President of the Republic of Uzbekistan and Government of the Republic of Uzbekistan).

20. To entrust the state tax service authorities with the task of exercising control over the correct formation of financial results when determining the amount of dividends for the state share in business entities.

21. To approve the “Roadmap” for the projects planned for implementation on the basis of the conditions of public — private partnership by industries in 2022 — 2024 in accordance with Annex No. 7.

22. To the Ministry of Finance, together with the State Customs Committee, the State Tax Committee, the Central Bank and the Department for Combating Economic Crimes under the General Prosecutor's Office, by June 1, 2022, to submit to the Cabinet of Ministers a draft resolution on a set of measures aimed at combating and reducing the shadow economy .

23. In order to ensure the fulfillment of the tasks established by this Decree:

to create a Coordinating Working Group headed by Prime Minister A.N. Aripov and approve its composition in accordance with Annex No. 8;

to approve the Plan of Additional Measures to Increase the Role of the Private Sector in Improving the Business Environment and Ensuring Economic Growth in accordance with Annex No. 9.

24. To Coordinating working group (A.N. Aripov):

within a month, to develop and approve sectoral schedules of work to be carried out in the context of each enterprise, with a specific definition of deadlines and tasks of responsible persons;

to regularly discuss the work carried out by the chairpersons of the supervisory boards and first deputy heads of the executive bodies for the transformation of enterprises, provided for in Annex No. 6, to coordinate and control their activities;

to regularly hear reports from the heads of each enterprise on ensuring the unconditional fulfillment of the tasks defined by this Decree within the scheduled time frame, upon necessity, to submit proposals to the Administration of the President of the Republic of Uzbekistan on their suitability for their positions;

to hold a quarterly critical discussion of the reports of the heads of ministries and departments on the progress of the implementation of projects based on the conditions of public-private partnership;

upon necessity, to initiate an assessment with the involvement of independent audit companies of the effectiveness and efficiency of certain investment projects implemented at the expense of state external borrowings;

25. To amend and make additions to certain acts of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan in accordance with Annex No. 10.

26. To invalidate certain acts of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan in accordance with Annex No. 11.

27. To impose control over the execution of this Decree on the Prime Minister of the Republic of Uzbekistan A.N. Aripov.

Amendments and additions to certain acts of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan

1. In the Decree of the President of the Republic of Uzbekistan dated January 17, 2017 No. UP-4933 “On measures to further simplify procedures and accelerate the sale of state-owned objects for business purposes”:

a) in clause 1 :

the third paragraph shall be stated in the following wording:

8. In the Decree of the President of the Republic of Uzbekistan dated January 14, 2019 No. UP-5630 “On measures to radically improve the system for managing state assets, antimonopoly regulation and the capital market”:

a) in paragraph 3 of clause 5 the words “rights to land plots and” shall be replaced by the words “lease rights and ownership rights to non-agricultural land plots and”;

b) in paragraph 6 :

In the second paragraph of clause 11 of the Decree of the President of the Republic of Uzbekistan dated February 19, 2019 No. UP-5666 “On additional measures for the effective use of state-owned objects”, the words “(with the exception of objects not subject to privatization)” shall be replaced by the words “(with the exception of objects not subject to privatization in accordance with legislative acts), motor vehicles, as well as other fixed assets.

10. In paragraph 4 of the Decree of the President of the Republic of Uzbekistan dated June 17, 2019 No. UP-5742 “On measures for the efficient use of land and water resources in agriculture”:

Of the funds received from the sale of state assets specified in this annex (net of costs associated with the bidding and sale of assets), 95 percent shall be directed to the republican budget of the Republic of Uzbekistan, 5 percent shall remain at the disposal of the Fund for Management, Transformation and privatization of state assets.

2. Objects shall be put up for auction in the form of a share or property complexes. When exhibited as a share, the objects specified in this appendix shall be transferred to the authorized fund of the company at their book value.

3. The conditions and methods of implementation (including the need to involve professional organizations) shall be determined by the State Commission for the conduct of tenders for the sale of state property.

4. The areas of objects will be specified on the basis of cadastral documents.

5. The objects specified in this appendix shall be put up for auction by transferring them to the State Assets Management Agency on the basis of decisions of the management bodies of legal entities with a state share in the charter fund (authorized capital) of 50 percent or more, as well as legal entities in the charter fund (authorized capital) of which 50 percent or more belongs to a legal entity with a state share of 50 percent or more in the charter fund (authorized capital), by reducing the share of the state and business entities by the book value of objects.

* The state share in the authorized capital of Poytakht Business Majmuasi LLC and the state-owned real estate object transferred to it for operational management shall be transferred to the State Assets Management Agency at the book value to increase the state's share in the company's authorized capital.

** Of the funds received from the sale of state-owned assets of the Beldirsoy Oromgokhi recreation area, the Chorvok Oromgokhi recreation area and Kizil Suv Sport Soglomlashtirish LLC (net of costs associated with the bidding and sale of assets), 90 percent shall be directed to the republican budget of the Republic of Uzbekistan, 5 percent — to the Fund for the Development of Tourism Infrastructure in Mountainous and Remote Areas, 5 percent shall remain at the disposal of the Fund for the Management, Transformation and Privatization of State Assets.

*** Of the funds received from the sale of state-owned assets of the hotel complex "Ichan Kal'a" (excluding the costs associated with the bidding and sale of assets), 90 percent shall be directed to the republican budget of the Republic of Uzbekistan, 5 percent — to the Tourism Support Fund, 5 percent remains at the disposal of the Fund for Management, Transformation and Privatization of State Assets.

13. In the list of socially significant information to be placed as open data, approved by Decree of the President of the Republic of Uzbekistan dated June 16, 2021 No. UP-6247:

a) in position 14:

the column “Type of information, name of categories (parameters)” after the words “motor vehicles” shall be supplemented with the words “and other information”;

the column "Resource on which information shall be placed" before the words "Official websites" shall be supplemented with the words "Open Data Portal,";

b) in position 15, the column “Type of information, name of categories (parameters)” after the words “other real estate” shall be supplemented with the words “objects of construction in progress”;

c) add position 34 with the following content:

" 34. Information about the name, type of activity, functions and powers of state institutions that are part of them, as well as information about their heads. Official websites Quarterly State bodies and organizations ”.

14. In paragraph 4 of the Regulations on the State Commission for conducting tenders for the sale of state property, approved by the Decree of the President of the Republic of Uzbekistan dated July 21, 2006 No. PP-423:

a) add the twentieth paragraph of the following wording:

“make instructions and proposals to the founders for adopting decisions on the transformation of state institutions (with the exception of state institutions not subject to privatization) into business companies, as well as decisions on the liquidation of state institutions”;

b) paragraphs twenty-twenty-five shall be considered paragraphs twenty-one-twenty-six, respectively.

15. Paragraph 4 of the Decree of the President of the Republic of Uzbekistan dated May 27, 2013 No. PP-1975 “On measures to expand the production of phosphorite raw materials” shall be stated as follows:

"4. To release within the framework of the project "Expansion of the existing production for the enrichment of phosphorite raw materials on the basis of the existing Kyzylkum phosphorite complex of the State Enterprise" Navoi MMC ":

from customs payments (except for value added tax and customs fees) of machinery, equipment and spare parts for them, as well as materials not produced in the Republic of Uzbekistan, imported by SE "Navoi MMC", according to the lists formed in the prescribed manner;

Qizilqum fosforit kompleksi LLC in terms of the production of washed calcined phosphorite concentrate, for a period up to January 1, 2024, from the payment of tax for the use of water resources, property tax for legal entities and land tax for legal entities.

16. The third paragraph of clause 5 and clause 7 of the Decree of the President of the Republic of Uzbekistan dated September 19, 2014 No. PP-2237 "On attracting foreign investment in the development of information systems and software products" shall be considered invalid.

17. In the Decree of the President of the Republic of Uzbekistan dated February 14, 2017 No. PP-2776 “On the organization of the activities of the State Committee of the Republic of Uzbekistan on highways”:

a) paragraph 4 shall be considered invalid;

b) in paragraph 6 :

the second paragraph in the text in the state language shall be supplemented with the words “ozod qilinsin”;

Delete the third paragraph .

18. In paragraph 7 of the Decree of the President of the Republic of Uzbekistan dated March 29, 2017 No. PP-2856 “On measures to organize the activities of the Uzbekipaksanoat Association”:

a) in the second paragraph , the words "single tax payment for legal entities" shall be replaced by the words "turnover tax";

b) in the third paragraph , the words “organizations for the production of grena, harvesting and processing of silkworm cocoons and organizations that are part of the Uzbekipaksanoat Association” shall be replaced by the words “to the Republic of Uzbekistan”;

c) in paragraph 5 the words "single social payment" shall be replaced by the words "social tax".

19. Paragraph 16 of the Decree of the President of the Republic of Uzbekistan dated May 1, 2017 No. PP-2939 “On measures to improve the management system of the fishing industry” shall be stated as follows:

"16. To exempt until January 1, 2023, legal entities from paying turnover tax in terms of income received from the production of larvae, juveniles and marketable fish, harvesting and processing of fish products.

20. In paragraph 16 of the Decree of the President of the Republic of Uzbekistan dated May 23, 2017 No. PP-2992 “On measures to radically improve the activities of fire rescue units of the Ministry of Emergency Situations of the Republic of Uzbekistan”, after the words “customs clearance fees”, add the words “and value added tax".

21. Paragraph three of clause 5 of the Decree of the President of the Republic of Uzbekistan dated June 19, 2017 No. PP-3068 “On improving the organization of the activities of the Chamber of Commerce and Industry of the Republic of Uzbekistan” shall be excluded.

22. Paragraphs four and five of clause 8 of the Decree of the President of the Republic of Uzbekistan dated October 4, 2017 No. PP-3309 “On improving the system for organizing the construction and operation of road bridges, overpasses and other artificial structures” shall be excluded.

23. In paragraph 10 of the Decree of the President of the Republic of Uzbekistan dated January 12, 2018 No. PP-3472 “On measures for the further development of the silk industry in the republic”:

a) from the first paragraph of subparagraph “a”, the words “members of the Association “Uzbekipaksanoat” shall be excluded;

b) subparagraph "b" shall be stated in the following wording:

“b) organizations from paying land tax levied on legal entities in part of land plots occupied by mulberry plantations”;

c) subparagraph "c" shall be recognized as invalid.

24. In Resolution of the President of the Republic of Uzbekistan dated February 27, 2018 No. PP-3570 “On measures to ensure the effective use of state property located abroad”:

a) in paragraph 1 , the words “state unitary enterprise “Center for State Assets Management” under the State Committee of the Republic of Uzbekistan for the Promotion of Privatized Enterprises and Development of Competition (hereinafter referred to as the Center)” shall be replaced by the words “State Assets Management Agency (hereinafter referred to as the Agency)”;

b) in the first paragraph of clause 2 the word "Center" shall be replaced by the word "Agency";

c) in paragraph 3 :

from the first paragraph the word "Center" shall be deleted;

in the second paragraph , the word "Center" shall be replaced by the word "Agency";

in paragraph three , the words “funds of the Fund for the Promotion of Privatized Enterprises” shall be replaced by the words “funds of the off-budget Fund for the Management, Transformation and Privatization of State Assets under the State Assets Management Agency of the Republic of Uzbekistan (hereinafter referred to as the Fund)”;

in paragraph seven the word "Center" shall be replaced by the word "Agency";

add the following paragraph:

“Funds from the sale of state property objects located abroad shall be distributed by the Agency in a general manner, unless otherwise established by decisions of the President of the Republic of Uzbekistan or the Government of the Republic of Uzbekistan”;

d) clause 4 shall be stated in the following wording:

"4. To release the Agency from paying taxes, fees and other obligatory payments on the territory of the Republic of Uzbekistan related to the registration and exercise of the owner's right to property”;

e) in clause 5 :

in the first paragraph , the word "To the Center" shall be replaced by the word "To the Agency";

the third and fourth paragraphs shall be stated in the following wording:

“The Ministry of Foreign Affairs, the Ministry of Finance and the Prosecutor General's Office ensure the inventory and registration of property in the ownership of the Republic of Uzbekistan after the enforcement of decisions of the courts of the Republic of Uzbekistan in foreign states;

submit proposals to the Cabinet of Ministers on further effective disposal of property, including its sale, transfer to state bodies of the Republic of Uzbekistan for rent or trust management in the prescribed manner”;

f) clause 6 shall be stated in the following wording:

“6. Establish that in case of occurrence of court and other expenses related to the protection of the rights of the Republic of Uzbekistan on property, claims, judicial, arbitration and other proceedings, as well as the involvement of foreign audit, lawyer, consulting and other organizations, independent experts, the corresponding costs shall be carried out at the expense of funds accumulated on special accounts of the Agency, and in case of insufficient funds — at the expense of the reserve fund of the Cabinet of Ministers of the Republic of Uzbekistan, allocated on the basis of reasonable applications of the Agency";

g) in clause 7 the words "To the Center together with the State Competition Committee" shall be replaced by the word "Agency";

h) in clause 9 :

in the second paragraph , the words “, the State Competition Committee of the Republic of Uzbekistan at the request of the Center” shall be replaced by the words “at the request of the Agency”;

in the third paragraph , the word "To the Center" shall be replaced by the word "To the Agency".

25. In clause 12 of the Decree of the President of the Republic of Uzbekistan dated February 28, 2018 No. PP-3573 “On measures to radically improve the wine industry and the sale of alcoholic products”:

the second paragraph shall be deleted;

the third paragraph shall be considered the second paragraph.

26. From the third paragraph of clause 10 of the Decree of the President of the Republic of Uzbekistan dated May 3, 2018 No. PP-3693 “On measures to further stimulate the development and growth of the export potential of the leather and footwear and fur industries”, the words “exclusively to organizations — members of the Association” shall be deleted.

27. In clause 4 of the Decree of the President of the Republic of Uzbekistan dated May 4, 2018 No. PP-3694 “On measures to improve the financial condition and further improve the activities of the joint-stock commercial People's Bank of the Republic of Uzbekistan and the joint-stock commercial bank “Microcreditbank”:

a) in the text in the state language, the fourth paragraph shall be supplemented with the words “tughrisidagi takliflariga rozilik berylsin”;

b) the fifth paragraph shall be excluded.

28. In clause 2 of the Decree of the President of the Republic of Uzbekistan dated May 8, 2018 No. PP-3701 "On the organization of the construction of buildings of Public Service Centers at the People's Reception Offices of the President of the Republic of Uzbekistan in districts (cities) on the terms of public-private partnership":

the eighth paragraph shall be deleted;

the ninth and tenth paragraphs shall be considered as the eighth and ninth paragraphs, respectively.

29. Paragraph two of clause 9 of the Decree of the President of the Republic of Uzbekistan dated June 26, 2018 No. PP-3802 “On measures to radically improve the activities of the state tax service bodies” shall be excluded.

30. Paragraph two of clause 7 of the Decree of the President of the Republic of Uzbekistan dated November 6, 2018 No. PP-4005 “On additional measures for the further development of the fish farming industry” shall be excluded.

31. Paragraph 7 of the Decree of the President of the Republic of Uzbekistan dated December 4, 2018 No. PP-4047 “On additional measures to support the accelerated development of the silk industry in the republic” shall be stated as follows:

“7. To exempt organizations from paying property tax on legal entities and land tax on legal entities in terms of real estate and land plots on which silkworm cocoons are grown, for a period up to January 1, 2023 with the targeted use of the released funds for the modernization of production, including acquisition of technological equipment”.

32. Paragraph 14 of the Decree of the President of the Republic of Uzbekistan dated January 5, 2019 No. PP-4095 “On measures to accelerate the development of the tourism industry” after the words “customs clearance fees” should be supplemented with the words “and value added tax”.

33. In paragraph 3 of the Decree of the President of the Republic of Uzbekistan dated September 16, 2019 No. PP-4453 “On measures to further develop light industry and stimulate the production of finished products”:

a) paragraphs three and five shall be deleted;

b) the fourth paragraph shall be considered the third paragraph.

34. Paragraph 1 of the Decree of the President of the Republic of Uzbekistan dated February 1, 2021 No. PP-4969 “On additional measures to create a healthy competitive environment in the agricultural engineering industry” shall be stated as follows:

"1. To permit domestic manufacturers of agricultural machinery operating in the agricultural machinery industry to defer the payment of value added tax for a period of 270 days, starting from the date of placement in the customs regime "release for free circulation" (import) of goods when importing components, raw materials and materials for production and service maintenance of agricultural machinery.

35. In the fourth paragraph of subparagraph “b” of clause 2 of the Decree of the President of the Republic of Uzbekistan dated October 4, 2021 No. PP-5252 “On additional measures to improve the use of cash registers in the field of retail trade and the provision of services”, before the words “self-reading”, add the words "for business entities engaged in the retail sale of products -".

36. In Appendix No. 4 to the Decree of the President of the Republic of Uzbekistan dated March 18, 2022 No. PP-168 “On additional measures to further reduce state participation in the economy and accelerate privatization”:

add position 17 1 with the following content:

“ 17 1 . UzPaynet LLC JSCB "Hulk banks" 100 ”.

37. Decree of the Cabinet of Ministers of September 30, 2015 No. 279 “On measures to complete the construction of an international class hotel in the city of Tashkent” shall be supplemented with paragraph 11 1 of the following content:

“11 1. To establish that when changing the organizational and legal form of the State Unitary Enterprise "Poytakht Qurilish va Khizmat" (Hotel "Hyatt Regency"), all the rights and obligations of the reorganized unitary enterprise, including all the tax benefits and preferences provided, shall be transferred to the newly emerged legal entity.

38. In the resolution of the Cabinet of Ministers dated February 22, 2016 No. 49 “On measures to ensure the timely completion of construction and organization of the effective functioning of an international class hotel under the Hyatt Regency trademark in the city of Tashkent”:

a) add paragraph 4 1 as follows:

“4 1. To establish that:

when changing the legal form of the State Unitary Enterprise “Poytakht qurilish va hizmat” (Hotel “Hyatt Regency”), all the rights and obligations of the reorganized unitary enterprise, including all the benefits and preferences provided, shall be transferred to the newly established legal entity;

The Ministry of Finance, together with the khokimiyat of the city of Tashkent, to provide in the parameters of the State Budget of the Republic of Uzbekistan the annual allocation of funds for the repayment of the principal debt and the payment of interest on the attracted loan from the Fund for Reconstruction and Development of the Republic of Uzbekistan, taking into account the approved forecast schedules in accordance with Appendix No. 2";

b) the third paragraph of clause 8 shall be excluded.

39. In paragraph 6 of the Resolution of the Cabinet of Ministers dated January 25, 2018 No. 53 “On measures to introduce modern forms of organization of cotton and textile production”:

a) the fifth paragraph shall be deleted;

b) the sixth paragraph shall be considered the fifth paragraph.

40. In paragraph 15 of the Resolution of the Cabinet of Ministers dated January 27, 2018 No. 63 “On measures to further develop the production and industrial processing of licorice and other medicinal plants in the Republic of Uzbekistan”:

the second paragraph shall be deleted;

the third paragraph shall be considered the second paragraph.

41. Paragraph 11 of the Resolution of the Cabinet of Ministers dated January 4, 2019 No. 5 “On additional measures to improve the management of the housing and communal infrastructure of the city of Tashkent” shall be stated as follows:

"11. To release the income of management companies received under the contract for the maintenance, operation and repair of multi-apartment housing stock from paying value added tax and income tax.

42. Clause 9 of the Resolution of the Cabinet of Ministers dated February 15, 2019 No. 138 “On additional measures for the effective organization of production and industrial processing of licorice and other medicinal plants” shall be stated as follows:

"9. Provide business entities that create plantations of licorice and other medicinal plants, as well as process licorice and other medicinal plants, for a period until January 1, 2024, benefits in the form of:

a) exemption from payment:

land tax on legal entities, property tax on legal entities, tax on profit and turnover tax in terms of objects (profit, income) used (received) in the cultivation and (or) processing of licorice and other medicinal plants;

customs fees for technological equipment imported for own production needs, specialized agricultural machinery, components and spare parts for them not produced in the republic, seeds and seedlings of licorice and other medicinal plants, according to lists formed in the prescribed manner;

b) deferred payment of the fee for issuing a permit for the harvesting (collection) of planting material (seeds, cuttings) for the creation of plantations.

43. In paragraph 9 of the Resolution of the Cabinet of Ministers dated July 23, 2019 No. 619 “On measures to create an agro-industrial cluster for meat and dairy in the Jizzakh region”:

a) in subparagraph "a" the words "single social payment" shall be replaced by the words "social tax";

b) in the second paragraph of subparagraph “b”, after the words “customs fees”, add the words “and value added tax”.

44. In subparagraph “e” of paragraph 3 of the text in the state language of the Resolution of the Cabinet of Ministers dated August 10, 2019 No. 656 “On additional measures for the efficient use of production areas, the implementation of new production projects”, after the words “bozhkhona rasmiylashtiruvi yigimlari” add the words “va kushilgan kiymat soligi".

45. In paragraph 3 of the Resolution of the Cabinet of Ministers dated February 17, 2021 No. 77 “On the effective organization of the activities of the Agency for Entrepreneurship Development under the Ministry of Economic Development and Poverty Reduction of the Republic of Uzbekistan” in the text in the state language:

a) the first paragraph shall be deleted;

b) the second paragraph is considered the first paragraph.

Note:

in this annex, subparagraph "b" of paragraph 1, paragraphs 5 — 7, 15, 16, 20, 21, 25, 28, 29, 39, 40 and 43 shall come into force from July 1, 2022, paragraphs 2, 4, 10, 17, 22, 32 — 34, 41 and 44 , subparagraph "b" of paragraph 38 — from January 1, 2023.

For business entities using the benefit, canceled in accordance with paragraph 30 of this annex, the period of its validity shall remain.
