On measures to further improve the conduct of anti-corruption examination of normative legal acts and their drafts (RP-5263-son)

of the President of the Republic of Uzbekistan
Large-scale reforms aimed at comprehensively improving the system of combating corruption, identifying and eliminating the causes and factors of corruption offenses, preventing and combating corruption in all spheres of life of society and the state is being carried out in the country.
At the same time, practice of enforcement of law requires taking measures to improve the quality and efficiency of the system for identifying and eliminating norms in legislation acts that create conditions for corruption.
In order to further improve the system of anti-corruption examination of normative legal acts and their drafts hereby decide:
1. To take into account that the Ministry of Justice, together with the relevant ministries and departments, conducted an anti-corruption examination of 226 acts of legislation regulating the spheres of construction, healthcare, higher education and public procurement, as a result of which 302 corruption factors were identified in 75 of them.
To approve the “Roadmap” for the elimination of corruption factors identified as a result of the anti-corruption examination of normative legal acts in the areas of construction, healthcare, higher education and public procurement, in accordance with Appendix No. 1.
2. To support the proposal of the chambers of the Oliy Majlis of the Republic of Uzbekistan, the National Anti-Corruption Council, the Ministry of Justice and the Anti-Corruption Agency on the development of normative legal acts based on the principle of “legislation free from corruption” with the introduction of the procedure for conducting anti-corruption examination, providing for:
stage-by-stage complete anti-corruption examination of the existing normative legal acts;
wide involvement of the public, scientific organizations and independent experts in the anti-corruption examination of normative legal acts and their drafts;
filling by the developer of a questionnaire of the standard form to identify corruption factors when developing draft normative legal acts (hereinafter referred to as the checklist) and attaching it to the draft at all stages until the adoption of the draft;
non-proceeding with a legal examination and return to the developer by the justice authorities of draft normative legal acts for which the checklist was not completed;
considering corruption-generating factors identified by the justice authorities in legal acts and their drafts as one of the main criteria for assessing the activities of the relevant state bodies and organizations.
3. To approve:
Plan-Schedule for conducting anti-corruption examination of existing normative legal acts in 2022 — 2026 in accordance with Appendix No. 2;
Plan for conducting anti-corruption examination of existing normative legal acts in 2021 in accordance with Appendix No. 3.
To establish that starting from 2022, annually until March 20, the plan for conducting an anti-corruption examination of existing normative legal acts shall be approved by a decision of the Cabinet of Ministers.
In this respect, this plan shall include, first of all, acts of legislation regulating socio-economic relations with the highest level of corruption, including those that caused wide discussion among the public.
4. To grant from January 1, 2022, representatives of scientific organizations and higher educational institutions, as well as individuals - independent experts, the right to conduct scientific and independent anti-corruption examination of normative legal acts and their drafts.
To establish the procedure according to which:
conducting scientific and independent anti-corruption examination of normative legal acts and their drafts shall be carried out by individuals included in the Register of Experts for Anti-Corruption Examination of Legislative Acts and Their Draft (hereinafter referred to as the Register of Experts) at their own expense and (or) funds of customers;
Register of Experts shall be maintained by the Ministry of Justice;
conclusions based on the results of scientific and independent anti-corruption examination of normative legal acts and their drafts shall be subject to mandatory review by the relevant state bodies and organizations, and a certificate drawn up based on the results of their review shall be sent to the persons who conducted the examination and to the Ministry of Justice.
To Ministry of Justice (R. Davletov) within three months to develop and approve in accordance with the established procedure the requirements for the creation and maintenance of the Register of Experts, as well as for persons conducting scientific and independent anti-corruption examination.
5. To the Ministry of Innovative Development (I. Abdurakhmonov), when formulating the state order for the implementation of research projects, to take into account projects related to the conduct of anti-corruption examination of normative legal acts, and within three months – to announce competitions for research projects, including targeted ones, in the following areas:
development of science-based proposals for the scientific solution of problems related to the conduct of anti-corruption examination of normative legal acts and their drafts, as well as improving the efficiency of this activity;
development of science-based integrated solutions to eliminate corruption factors identified as a result of anti-corruption examination of normative legal acts and their drafts.
6. To recommend to the Public Fund for the Support of Non-Governmental Non-Profit Organizations and Other Institutions of Civil Society under the Oliy Majlis to hold state grant competitions for the best proposals for scientific and independent anti-corruption examination of normative legal acts and their drafts starting from 2022.
7. To establish that when organizing work on the basis of the Schedule for conducting anti-corruption examination of existing normative legal acts in 2022 — 2026 (hereinafter referred to as the Schedule):
a) state bodies and organizations shall conduct an anti-corruption examination of existing normative legal acts, following which they submit to the Ministry of Justice a completed checklist and proposals for eliminating identified corruption factors;
b) Ministry of Justice shall:
summarize the checklist and proposals of state bodies and organizations submitted as a result of the anti-corruption examination, and develop a “Roadmap” to eliminate the identified corruption factors;
submit, as a rule, every six months an analytical report on the results of the analysis of the state of the anti-corruption examination of existing normative legal acts to the Administration of the President of the Republic of Uzbekistan and the Cabinet of Ministers;
develop and submit, together with the relevant state bodies and organizations, annually by December 15, to the Cabinet of Ministers a “Roadmap” to eliminate corruption factors identified as a result of an anti-corruption examination of existing normative legal acts, as well as a plan for conducting an anti-corruption examination of existing normative legal acts for next year within the scopes defined in the Schedule;
c) The Cabinet of Ministers shall annually, by March 20, approve a plan for conducting an anti-corruption examination of existing normative legal acts within the areas defined in the Schedule, as well as a “Roadmap” to eliminate corruption factors.
8. To establish a procedure in accordance with which:
relevant state bodies and organizations shall carry out an anti-corruption examination of the existing normative legal acts according to their jurisdiction within the areas defined in the Schedule;
in order to ensure the high-quality and full-fledged performance of work on the anti-corruption examination of existing normative legal acts within the areas defined in the Schedule, the Ministry of Justice may create a Special Working Group to conduct an anti-corruption examination of existing normative legal acts (hereinafter referred to as the Special Working Group), consisting of employees of state bodies and organizations, non-governmental non-profit organizations, academia and independent experts;
members of the Special Working Group, including employees of state bodies and organizations, scientific organizations and higher educational institutions, shall be involved without interruption from their main place of work, their remuneration shall be carried out on the basis of a civil law contract concluded with the Ministry of Justice;
technical assistance funds and grants from international financial institutions and foreign donors, as well as extrabudgetary funds from state bodies and organizations shall be sources of funding for the activities of the Special Working Group, including remuneration of members of the Special Working Group and the provision of computers and stationery necessary for the effective organization of their work;
state bodies and organizations can apply to the Ministry of Justice for involvement of the Special Working Group for anti-corruption examination of the current normative legal acts within the areas defined in the Schedule. In this respect, the costs associated with the examination shall be covered by extra-budgetary funds of state bodies and organizations on a contractual basis.
9. To the Ministry of Investments and Foreign Trade (L. Kudratov) and the Ministry of Justice (R. Davletov) to take measures to attract technical assistance funds and grants from international financial institutions and foreign donors to organize an anti-corruption examination of existing normative legal acts in 2022 — 2026.
10. To determine that the Ministry of Justice shall:
coordinate and provide methodological assistance to the activities of state bodies and organizations in the field of anti-corruption examination of normative legal acts and their drafts;
submit to state bodies and organizations submissions on compliance with the requirements for conducting anti-corruption examination of normative legal acts and their drafts, elimination of corruption factors and norms;
submit proposals for improving the qualifications and skills of employees of state bodies and organizations who are responsible for conducting anti-corruption examination of normative legal acts and their drafts, including organizing training events for them.
11. To establish the procedure in accordance with which:
Ministry of Justice, every six months, shall evaluate the activities of employees of legal services of state bodies and organizations in conducting anti-corruption examination of normative legal acts and their drafts, and based on the results of the evaluation, shall submit proposals to the relevant state bodies and organizations on the application of incentive measures or disciplinary action against them;
heads of state bodies and organizations shall consider the issue of incentives through a lump-sum payment of money funds in the amount of 100 percent of the official salary of employees of legal services or bringing them to disciplinary liability in the prescribed manner.
Expenses related to the implementation of the measures provided for in this paragraph shall be financed from extrabudgetary funds of state bodies and organizations, as well as other sources not prohibited by legislation.
12. To assign personal responsibility to the heads of state bodies and organizations for the timely, high-quality and complete conduct of anti-corruption examination of normative legal acts and their drafts.
To approve the criteria for assessing the activities of state bodies and organizations for conducting anti-corruption examination of normative legal acts and their drafts (hereinafter referred to as assessment criteria) in accordance with Appendix No. 4.
To take into account the assessment criteria in the annual formation of a rating for evaluating the effectiveness of anti-corruption work in state bodies and organizations based on the results of each year.
13. To the Ministry of Justice (R. Davletov), the Anti-Corruption Agency (A. Burhanov) together with the Ministry of Foreign Affairs (A. Kamilov) and the Ministry of Investments and Foreign Trade (L. Kudratov) within two months to submit proposals for organizing visits of specialists to developed countries in order to study the experience of these states in the field of anti-corruption examination and regulatory impact assessment of the normative legal acts and their drafts.
14. To the Ministry of Justice (R. Davletov) and the Anti-Corruption Agency (A. Burkhanov):
a) together with the Agency for Information and Mass Communications (A. Khodzhaev), the National Television and Radio Company of Uzbekistan (A. Khadzhaev) and the National News Agency of Uzbekistan (A. Kuchimov) on an ongoing basis, to:
conduct briefings for the general public and representatives of the media on the issues of anti-corruption examination of normative legal acts and their drafts with the participation of non-governmental non-profit organizations;
highlight the essence and content, the significance of this resolution, as well as the work carried out in the country to conduct an anti-corruption examination of normative legal acts and their drafts;
b) within three months:
to ensure the improvement of the Portal for Discussion of Draft Legal Acts and the Unified Electronic System for the Development and Approval of Draft Legal Acts, with providing for the creation of the possibility for state bodies, organizations and the public to fill out and post a checklist based on the results of the anti-corruption examination of normative legal acts and their drafts;
c) to submit, within two months, together with the departments concerned, proposals to the Cabinet of Ministers on amendments and additions to legislation acts arising from this resolution.
15. To assign to the Minister of Justice R.K. Davletov personal responsibility for the effective organization of the implementation of this resolution.
To impose conduct of discussion of the implementation of this resolution, coordination and control over the activities of departments and organizations responsible for its implementation, to the Prime Minister of the Republic of Uzbekistan A.N. Aripov.
