On additional measures to further improve the activities of citizensʼ self-government bodies (380-son)

In accordance with the Law of the Republic of Uzbekistan “On citizensʼ self-government bodies”, as well as for the purpose of ensuring the implementation of the Decree of the President of the Republic of Uzbekistan No. DP-5938 dated 18 February 2020 “On measures to improve the socio-spiritual environment in society, further support the mahalla institution, and elevate the system of working with families and women to a new level”, the Cabinet of Ministers resolves:

1. The following shall be approved:

the Model Regulation on the citizensʼ assembly, providing for the categories of citizensʼ assemblies, the basic principles of their activities, their legal status, bodies, commissions and public structures, the powers of the chairperson of the assembly, his/her deputies and advisers, the procedure for accounting and reporting of the activities of assemblies, as well as their reorganization and liquidation, in accordance with Annex 1;

the Model Regulation on commissions of citizensʼ assemblies, providing for the legal status, main tasks, rights and obligations of commissions, requirements for their members, and the procedure for organizing their activities, in accordance with Annex 2;

the Model Regulation on public structures under citizensʼ assemblies, defining the purpose, main tasks, rights and obligations of public structures, as well as the procedure for organizing their activities, in accordance with Annex 3;

the Regulation on the certificate and badge of the chairperson of the citizensʼ assembly, defining the procedure for issuing the certificate and badge, their forms, as well as the procedure for preparation, registration, use and storage of certificate forms, in accordance with Annex 4;

the Regulation on the procedure for organizing and maintaining record management in citizensʼ assemblies, governing the organization of record management, preparation of administrative documents, ensuring their execution, and registration of incoming documents, in accordance with Annex 5.

2. The Ministry of Mahalla and Family Support of the Republic of Uzbekistan, together with the Council of Ministers of the Republic of Karakalpakstan, khokimiyats of regions and Tashkent city, and interested ministries and agencies shall:

within ten days, take measures to allocate separate premises in social sector facilities (educational institutions, family polyclinics, family doctor points, mahallas) located within each citizensʼ assembly territory, by conducting a targeted study and analysis of existing opportunities, fully equip them with necessary equipment, and create required conditions for the effective organization of the activities of the “Womenʼs Advisory Council” of citizensʼ assemblies;

within one month, ensure the approval of relevant regulations by citizensʼ self-government bodies on the basis of the approved model regulations and assist them in organizing their activities in accordance with these regulations;

within three months, conduct training seminars aimed at improving the qualifications of employees of citizensʼ self-government bodies.

3. The proposal of the Ministry of Mahalla and Family Support of the Republic of Uzbekistan and the “Mahalla” charitable public fund to finance the costs of producing the certificate and badge of the chairperson of the citizensʼ assembly at the expense of additional sponsorship funds received by the “Mahalla” charitable public fund shall be approved.

4. Certain decisions of the Government of the Republic of Uzbekistan according to Annex 6* shall be deemed invalid.

5. Control over the execution of this Resolution shall be assigned to the Deputy Prime Minister of the Republic of Uzbekistan on issues of social development B.A. Musaev and the Minister of Mahalla and Family Support of the Republic of Uzbekistan R.T. Mamatov.

Model

Regulation on the citizensʼ assembly

Chapter 1. General provisions

1. This Regulation defines the status, purpose and main powers, rights and obligations of citizensʼ assemblies, the procedure for organizing their activities, as well as the powers of employees of the citizensʼ assembly and the mahalla womenʼs activist.

2. The citizensʼ assembly shall have:

3. For the purpose of developing and introducing effective mechanisms for organizing the activities of citizensʼ assemblies, all citizensʼ assemblies shall be categorized according to their geographical location and population size.

Citizensʼ assemblies shall be divided into the following categories by geographical location:

in a city;

in a district center;

within a distance of up to 30 km from a district center;

at a distance of 30 km and more from a district center, in mountainous and desert areas;

citizensʼ assemblies located in border (or enclave) areas.

Citizensʼ assemblies shall be divided into the following categories by population size:

with a population of up to 1,000;

with a population from 1,001 to 2,000;

with a population from 2,001 to 4,000;

with a population from 4,001 to 6,000;

with a population from 6,001 to 8,000;

with a population exceeding 8,000.

4. Citizens, regardless of gender, race, nationality, language, religion, social origin, beliefs and social status, shall have equal rights to self-government, either directly or through their elected representatives.

Restriction of citizensʼ rights to self-government shall be prohibited. Interference in the activities of citizensʼ self-government bodies by state bodies and organizations, as well as their officials, shall not be allowed.

5. The main principles of the activities of citizensʼ assemblies shall include legality, priority of human rights, freedoms and legitimate interests, democracy, transparency, social justice, independence in resolving issues of local significance, collegiality, accountability to the population, mutual assistance on a public basis, social partnership, and consideration of local customs and traditions.

6. A citizensʼ assembly shall not be included in the system of state authorities and shall exercise its powers within the relevant territory in accordance with the legislation, and from the date of registration with public service centers in the prescribed manner shall acquire the status of a legal entity, have a seal bearing its name and a bank account.

7. In exercising the rights and freedoms guaranteed by the Constitution and laws of the Republic of Uzbekistan, the citizensʼ assembly shall independently resolve issues of local significance based on the interests of citizens, historical features of development, as well as national values, local customs and traditions, represent the interests of the population and adopt decisions acting on its behalf within the relevant territory.

8. The council of the citizensʼ assembly, commissions on the main areas of activity of the citizensʼ assembly, and the audit commission shall be the bodies of the citizensʼ assembly.

The bodies of the citizensʼ assembly shall be formed within one month by the assembly (meeting of citizensʼ representatives) based on the results of the election of the chairperson of the citizensʼ assembly.

The model structure of citizensʼ self-government bodies shall be determined in the form set out in the annex to this Model Regulation.

9. The citizensʼ assembly shall carry out its activities within its territory.

10. The establishment, merger, division and liquidation of citizensʼ assemblies of settlements, villages and auls, as well as the determination and change of their boundaries, and the assignment and change of their names shall be carried out in accordance with the procedure established by legislation.

11. The establishment, merger, division and liquidation of mahalla citizensʼ assemblies in cities, district centers, settlements, villages and auls, as well as the determination and change of their boundaries, and the assignment and change of their names shall be carried out by local state authorities in accordance with the procedure established by legislation, based on petitions of citizensʼ self-government bodies.

Chapter 2. Purpose and powers of the citizensʼ assembly

12. The main purpose of the activities of the citizensʼ assembly shall be to resolve issues of local significance based on the interests of citizens residing in the relevant territory, the historical features of development, as well as national values, local customs and traditions, to enhance their legal culture and social activity, and to ensure the stability of the socio-spiritual environment on the basis of the principle “Prosperous and safe mahalla”.

13. The citizensʼ assembly shall exercise the following powers:

(a) in the field of organizing its activities:

adopt decisions on incentivizing or relieving the chairperson of the citizensʼ assembly from office;

elect and dismiss advisers to the chairperson of the citizensʼ assembly acting on a public basis, members of commissions on the main areas of activity of the citizensʼ assembly, as well as the chairperson and members of the audit commission;

form the council of the citizensʼ assembly and organize the work of commissions on the main areas of activity of the citizensʼ assembly;

approve the regulation of the citizensʼ assembly and the code of ethics of its employees;

adopt decisions on expressing no confidence in the chairperson of the citizensʼ assembly;

approve the activity program and expenditure estimate of the citizensʼ assembly;

hear, at least once every quarter, reports of the chairperson and advisers of the citizensʼ assembly, the mahalla womenʼs activist, and at least once a year the report of the chairperson of the audit commission, and adopt relevant decisions;

form its own funds, own, use and dispose of the property of the citizensʼ assembly, and organize control over the expenditure of financial resources;

submit petitions to authorized state bodies and district (city) Councils of Peopleʼs Deputies on changing the boundaries of administrative-territorial units and mahalla citizensʼ assemblies, assigning and renaming mahalla citizensʼ assemblies, streets, squares and other objects;

submit substantiated proposals on targeted programs and “roadmaps” within its competence, which shall be subject to mandatory consideration by state bodies and organizations;

provide recommendations for including qualified and proactive employees of citizensʼ assemblies and the mahalla womenʼs activist, whose activities are recognized as exemplary based on rating assessment results, in the personnel reserve of state authorities;

(b) in the field of strengthening the socio-spiritual environment and supporting families and women:

implement measures aimed at strengthening families and comprehensive support of women;

implement targeted measures to support women socially and legally in families, mahallas and labor collectives, increase their socio-political activity, enhance spirituality, prepare youth for family life, form a modern model family, and strengthen its moral environment and traditional family values;

assist women in need of social protection in learning entrepreneurship, developing model business plans and obtaining loans, and carry out targeted work with women included in the “Womenʼs notebook”;

identify womenʼs problems in a timely manner, conduct individual and targeted work with women in difficult social situations, including women with disabilities, and organize provision of socio-legal, psychological and material assistance;

familiarize the population, including youth, with national and spiritual values, local customs and traditions and promote them;

provide recommendations on conducting weddings and other ceremonies;

implement measures aimed at increasing the role of the older generation in the upbringing of youth and strengthening families;

assist state authorities in maintaining interethnic harmony and religious tolerance;

develop and implement necessary measures aimed at social support of unorganized youth in the mahalla;

(c) in the field of law and order:

assist state authorities and administration bodies in strengthening law and order;

exercise public control over the implementation of laws and other legislative acts;

take measures to ensure full and effective implementation of the principle “Prosperous and safe mahalla”;

organize effective work on prevention of offenses, especially among minors, youth and women;

together with social adaptation centers, implement measures for social and labor rehabilitation of persons released from places of deprivation of liberty, as well as persons under probation supervision, and prevention of crime;

(d) in the field of environmental protection and improvement:

assist state authorities and administration bodies in environmental protection;

adopt decisions on the development of social infrastructure, improvement, landscaping and sanitary cleaning of the relevant territory, including organizing public assistance (hashar), holding reviews and competitions;

within its competence, hear reports of heads of organizations located in the relevant territory on environmental protection, sanitary condition, improvement and landscaping, and adopt decisions based on their results;

cooperate with management bodies of multi-apartment buildings on organizing improvement and landscaping of adjacent territories and other matters;

(e) in the socio-economic sphere:

approve plans of measures aimed at ensuring comprehensive development of the territory, improvement, landscaping and enhancement of sanitary condition based on its specific features and “growth points”;

assist in the development of family entrepreneurship, handicrafts, home-based work and other types of entrepreneurial activity, as well as activities of household land plot owners;

form and use funds and sponsorship donations from individuals and legal entities on a voluntary basis;

consider issues of establishment of mahalla centers and guzars and submit proposals;

develop proposals on programs of socio-economic development of territories and draft normative legal acts;

together with authorized state bodies, consider the expediency of construction of buildings planned within the territory of the citizensʼ assembly;

hear, at least once every quarter, reports of heads of family polyclinics, family doctor points, preschool educational organizations and educational institutions;

submit recommendations on candidates for membership in district (city) election commissions conducting elections to district (city) Councils of Peopleʼs Deputies;

submit candidates for membership in precinct election commissions for consideration at sessions of district (city) Councils of Peopleʼs Deputies;

submit candidates for membership in precinct referendum commissions to relevant district referendum commissions;

send observers from citizensʼ self-government bodies to election commissions;

ensure issuance of relevant documents to citizens in accordance with the procedure established by legislation;

hear, on a quarterly basis, reports of heads of executive authorities of the Republic of Karakalpakstan, regions, Tashkent city, districts and cities on issues falling within the competence of citizensʼ assemblies. Copies of minutes of such reports shall be sent, respectively, to the Ministry of Mahalla and Nuroniy Support of the Republic of Karakalpakstan, and to the territorial departments of mahalla and nuroniy support of regions and Tashkent city for the purpose of maintaining records and monitoring consideration of appeals of citizensʼ assemblies.

(f) powers in the field of cooperation with state bodies and officials:

implement measures aimed at supporting socially vulnerable segments of the population;

assist internal affairs bodies in exercising control over the use of residential premises owned by individuals and legal entities on the basis of private property rights within the relevant territory, including compliance with passport regulations, registration of residents at their permanent or temporary place of residence, and the availability of relevant agreements;

identify and maintain records of low-income families, single elderly citizens, pensioners and persons with disabilities in need of social support, jointly with territorial subdivisions of the Agency for the Development of Medical and Social Services;

ensure the maintenance of primary personal records of citizens in citizensʼ assemblies, and approve a specialist responsible for military registration in coordination with defense departments;

assist in mobilizing citizens to combat natural disasters and eliminate their consequences;

assist tax authorities on a contractual basis, providing for remuneration, in ensuring timely collection of taxes and fees from the population;

assist on a contractual basis, providing for remuneration, in ensuring collection of utility payments and in conducting measures for the rational use of heat and electric energy, as well as hot and cold water;

assist relevant state bodies on a contractual basis in exercising control over compliance with sanitary and environmental conditions of the territory, water supply sources, residential premises and educational institutions, as well as compliance with fire safety requirements, veterinary rules, sanitary rules and hygiene standards, trade rules and service culture;

assist in providing patronage care to single elderly citizens in need of care, as well as in providing assistance financed from the State budget of the Republic of Uzbekistan for this purpose;

submit information on orphans and children deprived of parental care to guardianship and trusteeship bodies, and assist in placing such children in relevant state institutions;

develop proposals on socio-economic development programs of territories and draft normative legal acts;

identify problems in improvement and landscaping of territories, as well as in the activities of citizensʼ assemblies and organizations managing multi-apartment buildings, and submit proposals for their resolution;

assist in organizing the targeted use of household land plots by the population;

assist state bodies in ensuring compliance with rules for construction of buildings and maintenance of adjacent territories of houses and yards;

assist in ensuring employment of the population, including youth and women, as well as in employment of persons discharged from military service and released from penal institutions.

Citizensʼ assemblies shall have the right to apply to the court in cases of violations identified during the consideration of appeals.

Failure to consider proposals subject to mandatory consideration by citizensʼ assemblies shall entail liability in accordance with legislation.

Citizensʼ self-government bodies shall cooperate with sectors for comprehensive socio-economic development of territories (hereinafter — sectors) and Peopleʼs Receptions in identifying and resolving population issues. The most pressing problems reflected in the information submitted quarterly by chairpersons of citizensʼ assemblies shall be recommended for consideration by sector leaders and Peopleʼs Receptions in the development of relevant programs.

Peopleʼs Receptions shall submit representations to relevant organizations, as well as proposals on incentivizing or bringing to disciplinary liability officials and employees, based on the information provided by chairpersons of citizensʼ assemblies regarding the results of activities carried out in the territory by responsible officials assigned to the territory, members of sector headquarters, and representatives of road construction, electricity, gas, water supply, sewerage, utilities and social sectors.

13. The citizensʼ assembly shall have the following obligations:

to carry out its activities in compliance with legislation and this Model Regulation;

to pay taxes and other mandatory payments to the State budget of the Republic of Uzbekistan and state targeted funds in accordance with the procedure established for non-governmental non-profit organizations;

to submit reports to tax and statistical authorities in the prescribed manner;

to ensure fulfillment of obligations agreed in employment contracts with its employees;

to maintain accounting in accordance with legislation.

The citizensʼ assembly may assume other obligations in accordance with legislation.

14. Citizensʼ self-government bodies shall be subjects of public control.

Citizensʼ self-government bodies shall have the right to:

apply to state bodies with applications, complaints and proposals, as well as send requests;

participate in open collegial meetings of state bodies;

conduct public discussions on socially significant issues, as well as draft normative legal acts and other decisions of state bodies;

conduct public hearings on issues related to the activities of state bodies and their officials that are of public significance or affect the rights and legitimate interests of citizens, legal entities and society;

carry out public monitoring by collecting, summarizing and analyzing information related to the activities of state bodies and their officials that affect public interests;

conduct public expertise of draft normative legal acts and other decisions of state bodies;

study public opinion by collecting, summarizing and analyzing information in order to assess the views of various social groups regarding draft normative legal acts, compliance of state bodies and their officials with legislative requirements, and their activities in ensuring the rights and legitimate interests of citizens, legal entities and society;

hear reports and information of officials of state bodies.

Citizensʼ self-government bodies shall exercise public control on the basis of the Laws of the Republic of Uzbekistan “On public control”, “On citizensʼ self-government bodies” and this Regulation.

State bodies shall assist citizensʼ self-government bodies in exercising public control and shall take timely measures on their appeals in accordance with legislation.

Chapter 3. Procedure for convening the meeting of the citizensʼ assembly (meeting of citizensʼ representatives)

15. Persons who have reached the age of eighteen and permanently, temporarily or predominantly reside within the territory of the citizensʼ assembly shall participate in the meeting of the citizensʼ assembly.

The meeting of the citizensʼ assembly shall be convened by the council of the citizensʼ assembly as necessary, but at least once every quarter.

The meeting of the citizensʼ assembly may be convened extraordinarily upon the recommendation of the district (city) Council of Peopleʼs Deputies or the district (city) department of the Ministry of Mahalla and Nuroniy Support, submitted to the council of the citizensʼ assembly, or on the initiative of at least one-third of the population entitled to participate in the meeting.

The meeting of the citizensʼ assembly shall be competent if more than half of the population entitled to participate in the citizensʼ assembly is present.

16. If it is not possible to convene the meeting of the citizensʼ assembly, the council of the citizensʼ assembly shall adopt a decision to hold a meeting of citizensʼ representatives. At general meetings of residents of each street and multi-apartment building within the relevant territory, a citizensʼ representative shall be elected by a simple majority vote.

A meeting of citizensʼ representatives held on a quarterly basis shall be competent if at least two-thirds of the total number of citizensʼ representatives are present in citizensʼ assemblies with a population of up to 6,000, and at least one-third in citizensʼ assemblies with a population exceeding 6,000 (except for the election of the chairperson of the citizensʼ assembly).

Employees of the citizensʼ assembly and their close relatives, as well as street heads and house heads, may not be elected as citizensʼ representatives.

17. A presidium shall be elected to conduct the meeting of the citizensʼ assembly. The meeting of the citizensʼ assembly shall be chaired by the chairperson of the citizensʼ assembly or one of the advisers of the chairperson (except for meetings convened for the early termination of the powers of the chairperson of the citizensʼ assembly). Decisions on all issues shall be adopted by a simple majority vote through open or secret voting.

The meeting of the citizensʼ assembly (meeting of citizensʼ representatives) convened for the early termination of the powers of the chairperson of the citizensʼ assembly shall be convened and conducted in accordance with the procedure established by the Law of the Republic of Uzbekistan “On the election of the chairperson of the citizensʼ assembly”.

18. Minutes of the meeting of the citizensʼ assembly shall be kept, indicating the date of the meeting, the number of citizens present, the agenda and the decisions adopted. The minutes and decisions of the meeting shall be signed by the chairperson of the citizensʼ assembly, or in his/her absence, by one of the advisers who chaired the meeting.

19. Representatives of enterprises, institutions and organizations located within the relevant territory shall have the right to participate in the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) with an advisory vote on matters related to their activities.

Chapter 4. The council of the citizensʼ assembly

20. In order to ensure the execution of decisions of the citizensʼ assembly and to carry out the current activities of citizensʼ self-government bodies in the period between meetings of the citizensʼ assembly, the council of the citizensʼ assembly shall be formed by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

The council of the citizensʼ assembly shall be a collegial body consisting of the chairperson of the citizensʼ assembly, his/her advisers (including advisers on youth issues and on issues of the elderly and veterans), the mahalla womenʼs activist, street heads, house heads, as well as heads of preschool and educational institutions, family doctor points and family polyclinics located within the territory.

21. The council of the citizensʼ assembly shall:

convene meetings of the citizensʼ assembly (meeting of citizensʼ representatives);

hear, on a monthly basis, reports of commissions on the main areas of activity of the citizensʼ assembly and coordinate their work;

assist deputies of the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan, and of regional, district and city Councils of Peopleʼs Deputies in organizing meetings with voters, receiving citizens, and exercising their other powers in their electoral districts;

assist in organizing mass political, cultural, educational, sports and other events;

take measures aimed at protecting the rights, freedoms and legitimate interests of women, increasing their role in society, in forming the moral environment in families, and in raising the younger generation;

take measures to prevent the activities of unregistered religious organizations, ensure observance of the right of citizens to freedom of religion, and prevent the forced imposition of religious views, and cooperate with law enforcement bodies in this regard;

cooperate with relevant state bodies in preventing illegal activities of religious organizations;

together with relevant state bodies, implement targeted and preventive measures for social adaptation of persons released from penal institutions or pardoned;

cooperate with educational institutions on issues of upbringing the younger generation;

assist in ensuring employment of citizens residing in the relevant territory, including through the organization of family entrepreneurship and home-based work;

organize voluntary participation of the population in improvement and landscaping of the territory, preservation of material cultural heritage objects in proper condition, establishment, reconstruction, repair and maintenance of cemeteries, using funds allocated by district (city) executive authorities and other resources, as well as own funds, organize public assistance (hashar), and conduct reviews and competitions;

assist in the development of activities of household land plot owners;

assist law enforcement bodies in ensuring public order and public safety within the relevant territory, including in organizing registration of arrivals and departures of citizens, prevention of neglect and offenses among minors, and protection of their rights;

use funds transferred on a contractual basis to the citizensʼ self-government body for ensuring full payment of utility services by the population to provide assistance to low-income families in paying for utility services, to incentivize employees of citizensʼ assembly bodies, and to carry out improvement and landscaping works;

adopt decisions on collecting funds from individuals on a voluntary basis and using funds of legal entities on a contractual basis to assist low-income families in repairing their houses and apartments, as well as in paying for utility services;

take measures to preserve ownerless property, property inherited by citizensʼ self-government bodies, as well as property of single persons temporarily absent due to being in medical institutions, and property of orphans and children deprived of parental care who are in specialized educational institutions or under guardianship and trusteeship or placed in foster care;

provide additional material assistance to youth from low-income families, including by attracting sponsors for conducting marriage and other ceremonies, as well as funeral ceremonies;

send its representative to the district (city) commission to participate in consideration of issues related to allocation (realization) of land plots.

22. Meetings of the council of the citizensʼ assembly shall be held by the chairperson of the citizensʼ assembly as necessary, but at least once a month.

23. A meeting of the council of the citizensʼ assembly shall be competent if at least two-thirds of its members participate.

24. Meetings of the council of the citizensʼ assembly shall be chaired by the chairperson of the citizensʼ assembly, and in his/her absence — by one of his/her advisers.

25. Decisions of the council of the citizensʼ assembly shall be adopted by open voting.

A decision shall be considered adopted if more than half of the members present vote in favor.

26. Minutes of the meeting of the council of the citizensʼ assembly shall be kept in accordance with the Regulation on the procedure for organizing record management in citizensʼ assemblies. The minutes shall indicate the date of the meeting, the number of council members and citizens present, the agenda and the decisions adopted. The minutes and decisions shall be signed by the chairperson of the citizensʼ assembly, and in his/her absence — by the deputy who chaired the meeting.

27. Decisions of the council of the citizensʼ assembly adopted within its competence shall be binding for execution by employees of the citizensʼ assembly, commissions on the main areas of activity of the citizensʼ assembly and other public structures.

28. Failure to execute or improper execution of decisions of the council of the citizensʼ assembly shall entail liability in accordance with the law.

29. Decisions of the council of the citizensʼ assembly may be repealed by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) or by the council itself, or may be declared invalid by a court decision.

Chapter 5. Commissions on the main areas of activity of the citizensʼ assembly and the audit commission

30. The following commissions on the main areas of activity of the citizensʼ assembly shall be established in citizensʼ assemblies:

commission on strengthening family values;

commission on working with women;

commission on social support and public control;

commission on ecology and environmental protection, improvement and landscaping.

Depending on the relevance of issues in the respective territory, other commissions on the main areas of activity of the citizensʼ assembly may also be established by the citizensʼ assembly.

31. The chairperson of the citizensʼ assembly shall organize and coordinate the activities of the commission on strengthening family values, while the mahalla womenʼs activist shall organize and coordinate the activities of the commission on working with women and the commission on ecology and environmental protection, improvement and landscaping.

32. For the purpose of auditing the financial and economic activities of the citizensʼ assembly, an audit commission consisting of at least three members shall be formed from among the members of the citizensʼ assembly.

The audit commission shall be independent in its activities and accountable only to the citizensʼ assembly.

Members of the audit commission may not simultaneously be members of another body of the citizensʼ assembly.

33. Commissions on the main areas of activity of the citizensʼ assembly and the audit commission shall carry out their activities in accordance with regulations approved by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

34. The procedure for the establishment, reorganization and termination of the activities of commissions on the main areas of activity of the citizensʼ assembly and the audit commission, as well as their powers and the procedure for electing (removing) members of commissions, shall be determined in the model regulations of the respective commissions.

Chapter 6. Public structures assisting the activities of the citizensʼ assembly

35. In order to improve the socio-spiritual environment in the mahalla, assist in enhancing parentsʼ skills in matters of child upbringing, and further improve efforts to address existing family issues, a public structure “Parentsʼ University” shall be established under the citizensʼ assembly.

The activities of the “Parentsʼ University” public structure shall be organized and coordinated by the mahalla womenʼs activist.

36. In order to effectively use the rich life experience of representatives of the older generation and retired employees of law enforcement bodies in maintaining the stability of the socio-spiritual environment in the mahalla, an “Eldersʼ Council” group shall be established under citizensʼ assemblies.

The activities of the “Eldersʼ Council” group shall be organized and coordinated by the chairperson of the citizensʼ assembly.

37. The council shall be headed by an active, capable woman residing in the mahalla, possessing life experience and authority among the population.

The womenʼs activist shall organize and coordinate the activities of the council on working with women.

38. In order to strengthen efforts in ensuring public safety, prevention of offenses and combating crime in the mahalla, a public patrol group “Devoted Youth” shall be formed from among conscripts, candidates for higher military educational institutions and internal affairs bodies.

The activities of the “Devoted Youth” public patrol group shall be organized and coordinated by the deputy chairperson of the citizensʼ assembly for law-and-order issues.

39. In order to support the development of entrepreneurship in the mahalla, including family entrepreneurship and handicrafts, an advisory center on entrepreneurship may be established under the citizensʼ assembly.

As a rule, the activities of the advisory center on entrepreneurship shall be organized and coordinated by the deputy chairperson of the citizensʼ assembly for improvement, household land plots and entrepreneurship issues.

40. The procedure for the establishment, reorganization and termination of public structures assisting the activities of the citizensʼ assembly, as well as their powers and the procedure for electing (removing) members of such public structures, shall be determined in their model regulations.

Chapter 7. Powers of the chairperson of the citizensʼ assembly, his/her advisers and the mahalla womenʼs activist

41. The following:

(a) the chairperson of the citizensʼ assembly shall exercise the following powers for the performance of the duties assigned to him/her:

ensure the proper organization and effective conduct of record management within the activities of the citizensʼ assembly and its bodies, as well as the timely execution of adopted decisions;

direct the activities of the assistant to the district (city) khokim on issues of entrepreneurship development, employment and poverty reduction, the youth leader in the mahalla, the womenʼs activist, and prevention (senior) inspectors of internal affairs bodies towards addressing priority issues in the territory, and establish public control in this regard;

evaluate the activities of the assistant to the district (city) khokim, the youth leader, the womenʼs activist, and prevention (senior) inspectors of internal affairs bodies, and submit relevant information on the results to the respective Councils of Peopleʼs Deputies;

submit representations, subject to mandatory consideration, to higher organizations of the relevant officials on incentivizing them or applying disciplinary measures up to dismissal from office;

submit to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) candidates for election as advisers of the chairperson acting on a public basis, members of commissions on the main areas of activity of the citizensʼ assembly, as well as the chairperson and members of the audit commission;

organize the work of advisory centers within the relevant territory;

file applications with the court to declare a citizen as having limited legal capacity due to abuse of alcohol, narcotic drugs or psychotropic substances, or as legally incapable due to mental disorder (mental illness or intellectual disability);

submit proposals to relevant state bodies on improving the material, housing and living conditions of low-income families, orphans, children deprived of parental care, as well as citizens affected by natural disasters and man-made emergencies;

submit proposals to local state authorities on the establishment of new cemeteries and reconstruction of existing ones;

organize public work on protection of the rights of minors;

take measures to study and address the problems of elderly citizens, especially single elderly persons, and organize the provision of material assistance and legal, methodological and practical support;

organize mass events in the territory related to public holidays and significant dates;

organize work to prevent activities of unregistered religious organizations and the forced imposition of religious views, and resolve other issues related to compliance with legislation on freedom of conscience and religious organizations;

receive individuals and legal entities and their representatives, and consider their appeals;

submit proposals to the council of the citizensʼ assembly on evaluating the activities of employees and on incentivizing them or applying disciplinary measures;

request and obtain from relevant state bodies information on protected natural areas and objects of material cultural heritage, and conduct explanatory work among the population on their preservation;

submit, on a quarterly basis, information on the most pressing problems in the territory to the heads of sectors for comprehensive socio-economic development (hereinafter — sectors) and to the Peopleʼs Receptions of the President of the Republic of Uzbekistan, as well as request reports from relevant state bodies on measures taken in response to appeals, and in case of non-performance, submit information to the district (city) Council of Peopleʼs Deputies for consideration;

regularly submit written information to sector leaders and Peopleʼs Receptions on the results of activities carried out in the territory by responsible officials assigned to the territory, members of sector headquarters, and representatives of road construction, electricity, gas, water supply, sewerage, utilities and social sectors;

receive reports from representatives of state bodies assigned to the citizensʼ assembly regarding activities carried out in the territory;

organize and coordinate the activities of the adviser on issues of the elderly and veterans, the commission on strengthening family values, and the “Eldersʼ Council” group;

ensure the targeted use of attracted funds and sponsorship donations in accordance with legislation, proper maintenance of accounting and submission of reports, and report quarterly to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on the use of such funds;

request from state bodies and organizations necessary documents, statistical and other data, analytical materials, conclusions and other information related to the performance of assigned duties, except for information restricted or prohibited from dissemination by law;

represent the interests of the citizensʼ assembly in state bodies, including courts, and in relations with legal entities and individuals, and conclude contracts on behalf of the citizensʼ assembly, including employment contracts;

submit proposals to state bodies and other organizations on issues related to the activities of the citizensʼ assembly and participate in their consideration;

submit to district (city) Councils of Peopleʼs Deputies issues related to the activities of the citizensʼ assembly that are subject to mandatory consideration;

submit proposals to the general meeting of homeowners on termination of contracts concluded with a management organization, manager or chairperson of a homeownersʼ association;

enter into relations with management organizations, managers or chairpersons of homeownersʼ associations on behalf of homeowners with their consent on issues related to the management of multi-apartment buildings;

submit representations to relevant state bodies, enterprises, institutions and organizations on bringing officials to liability for failure or improper performance of decisions adopted by citizensʼ self-government bodies within their competence;

submit proposals to the council of the citizensʼ assembly on nominating active citizens who have demonstrated initiative and made a significant contribution to solving problems in the mahalla for the “Mahalla pride” badge;

submit proposals to the council of the citizensʼ assembly on evaluating the activities of the deputy chairperson for law and order (prevention inspector) and on applying incentive measures or disciplinary measures up to dismissal, by sending representations subject to mandatory consideration to the Ministry of Internal Affairs of the Republic of Karakalpakstan, the Main Departments of Internal Affairs of Tashkent city and Tashkent region, and regional internal affairs bodies;

certify powers of attorney for receiving correspondence, including money and parcels, wages and other payments related to employment relations, remuneration payable to authors and inventors, pensions, allowances and scholarships, as well as funds from banks, and register deaths;

be obliged to strictly observe ethical standards in relations with citizens and ensure confidentiality of information that becomes known in the course of his/her activities.

(b) the deputy chairperson of the citizensʼ assembly for law-and-order issues shall exercise the following powers for the performance of the duties assigned to him/her:

organize activities aimed at maintaining public order and ensuring safety within the relevant territory, and cooperate with other law enforcement bodies and public organizations in this area;

study the criminogenic situation in the territory, the causes of offenses and conditions facilitating their commission, and submit relevant information and proposals to the chairperson of the citizensʼ assembly, the district (city) internal affairs body, and the district (city) department for mahalla and nuroniy support;

implement preventive measures aimed at detecting and suppressing offenses, eliminating their causes and conditions, and conduct preventive work with persons prone to committing offenses;

maintain preventive records, including records of offenses, offenders and victims, in accordance with the procedure established by legislation, and implement measures aimed at providing them with legal, social, psychological, medical, pedagogical and other assistance;

conduct activities, with the involvement of representatives of state bodies, organizations and civil society institutions, aimed at preventing offenses, raising legal awareness and culture of citizens, and fostering respect for the law;

submit representations to heads of state bodies, public and other organizations on eliminating causes and conditions of offenses;

identify and keep records of persons who have left their place of permanent residence for a long period, regularly work with their relatives to determine their place and duration of stay abroad, and conduct preventive work with persons who have returned after a long stay abroad;

submit proposals on incentivizing or bringing to disciplinary liability employees of cooperating law enforcement bodies engaged in suppressing crime in areas with a difficult criminogenic situation;

study each family in the territory, identify dysfunctional families and carry out preventive work with them, including assisting in resolving their domestic and other problems together with relevant organizations;

exercise supervision, in accordance with legislation, over persons sentenced to non-custodial criminal penalties and those under probation supervision, and conduct preventive work with them;

monitor the behavior of persons sentenced for the first time to deprivation of liberty but transferred directly to probation supervision with a milder punishment, assist in their social adaptation and prevention of reoffending;

implement educational and preventive measures in respect of persons released from penal institutions and placed under administrative supervision, and monitor compliance with restrictions established by legislation;

monitor attendance of students in educational institutions, conduct preventive work with minors and youth in socially dangerous situations who do not attend educational institutions, as well as with their parents;

identify persons residing without registration at their permanent or temporary place of residence or otherwise violating passport and visa regime requirements, and verify the existence of lease or free-use agreements for residential premises;

take measures to ensure compliance with safety rules in the use of housing stock and adjacent territories by homeowners and homeownersʼ associations, including attics, basements and other auxiliary premises of multi-apartment buildings;

take measures in accordance with legislation to identify ownerless residential premises and ensure their preservation;

study the condition of educational work with minors in educational, cultural-entertainment, sports and recreational institutions and other organizations (clubs, circles, etc.);

assist guardianship and trusteeship bodies in placing orphans and children deprived of parental care;

participate in implementing measures to ensure compliance with legislation in the fields of sanitation, environmental protection, improvement and fire safety;

participate in ensuring public order during the execution of court decisions and acts of other bodies;

implement measures aimed at providing psychological and social assistance to persons prone to violence in order to prevent repeated violence against women and ensure the safety of victims, including organizing their participation in corrective programs;

report monthly to the council of the citizensʼ assembly and at least once every quarter to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on the state of prevention of offenses and submit relevant proposals;

organize and coordinate the activities of the adviser on youth issues and the “Devoted Youth” public patrol group;

ensure public order during the elimination of consequences of natural disasters and other emergencies;

organize targeted preventive measures aimed at promoting modest and cost-effective conduct of weddings, family celebrations and ceremonies, instilling accepted norms of behavior in society, and preventing extravagance and ostentation;

issue protection orders to women victims of harassment and violence and ensure their enforcement;

consider appeals of individuals and legal entities and receive their representatives;

draw up protocols on administrative offenses and consider cases of administrative offenses within his/her competence in accordance with the Code of the Republic of Uzbekistan on Administrative Responsibility;

in exercising his/her powers, verify identity documents of citizens, conduct personal searches and inspect belongings where there are grounds to suspect possession of prohibited items, and seize items and documents that are instruments or direct objects of an offense in accordance with legislation;

be obliged to strictly observe ethical standards in relations with citizens and ensure confidentiality of information obtained in the course of his/her activities.

(c) the mahalla womenʼs activist shall exercise the following powers for the performance of the duties assigned to her:

implement targeted measures aimed at providing social and legal support to women in families, mahallas and labor collectives, increasing their socio-political activity, enhancing spirituality, preparing youth for family life, forming a modern model family, and strengthening its moral environment and traditional family values;

cooperate with the assistant to the district (city) khokim on issues of entrepreneurship development, employment and poverty reduction in attracting loans, subsidies and other support measures for the implementation of womenʼs entrepreneurial initiatives;

in close cooperation with “Womenʼs Advisory Councils”, assist socially vulnerable women in learning entrepreneurship, developing model business plans and obtaining loans, and carry out targeted work with women included in the “Womenʼs notebook”;

identify womenʼs problems in a timely manner, conduct individual and targeted work with women in difficult social situations, including women with disabilities, and organize the provision of social, legal, psychological and material assistance;

report monthly to the council of the citizensʼ assembly and at least once every quarter to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on issues of strengthening families, supporting women and socio-spiritual matters;

organize and coordinate the activities of the commission on working with women, the public structure “Parentsʼ University”, and the “Womenʼs Advisory Council”;

consider appeals of individuals and legal entities and receive their representatives;

establish active cooperation with state bodies and other organizations on issues related to her activities;

apply to the council of the citizensʼ assembly and authorized state bodies to resolve womenʼs issues, and in case of non-performance of submitted appeals, submit representations to higher organizations or law enforcement bodies through the chairperson of the mahalla;

provide motivation and support to women affected by harassment and violence, teach them to overcome life difficulties, and involve psychologists when necessary;

submit proposals to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on nominating women who have demonstrated initiative and made a significant contribution to strengthening families and resolving womenʼs issues for the “Moʻtabar ayol” badge;

submit proposals to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on nominating families that have made a worthy contribution to strengthening the family institution and preserving and developing family values for the “Ibratli oila” badge;

the mahalla womenʼs activist shall be obliged to strictly observe ethical standards in relations with citizens and ensure confidentiality of information obtained in the course of her activities;

the mahalla womenʼs activist shall be subordinate to and accountable to the Committee on Family and Women of the Republic of Uzbekistan and its territorial subdivisions in the course of her activities.

(d) the adviser to the chairperson of the citizensʼ assembly on youth issues shall exercise the following powers for the performance of the duties assigned to him/her:

ensure effective cooperation with state bodies, non-governmental non-profit organizations and other institutions of civil society in the implementation of state youth policy;

maintain records of youth in the mahalla and monitor their family and social status, education and employment, abilities and interests;

implement targeted measures aimed at protecting the rights, freedoms and legitimate interests of youth, studying their problems on-site, organizing dialogue and meetings with them, and resolving identified issues;

take measures to develop youth infrastructure in the mahalla, organize clubs in science, culture and arts, and ensure broad involvement of youth in such activities;

implement effective measures aimed at promoting a healthy lifestyle and the sanctity of family among youth, preventing early marriages and divorces among young families;

assist in increasing the social activity of youth, encouraging their initiatives, and enabling the realization of their intellectual and creative potential;

in cooperation with educational institutions, identify students who fail to attend classes without valid reasons or do not attend regularly, and implement measures to return them to education;

organize support, both moral and material, for youth with disabilities and those in need of social protection, and assist in placing children deprived of parental care in relevant state institutions;

carry out individual work with youth from dysfunctional and troubled families, as well as with children of parents who have gone abroad for work or other reasons, are serving sentences, or are under the influence of harmful ideologies, and regularly study the lifestyle and behavior of children of persons registered for preventive supervision by internal affairs bodies;

implement measures aimed at protecting youth from various ideological threats, including extremism, terrorism, “mass culture” and other alien ideas, preventing neglect and other antisocial behavior, and identifying and eliminating causes and conditions contributing thereto;

assist in the social and pedagogical rehabilitation and adaptation of youth released from penal institutions or returned from specialized educational institutions;

carry out awareness-raising activities aimed at preparing youth for military service and instilling in them the understanding that defending the Motherland is a sacred duty;

organize visits and excursions for youth to historical monuments, educational institutions established during the years of independence, as well as nature sites, museums and exhibitions;

implement preventive, sanitary and hygienic measures aimed at promoting a healthy lifestyle among youth, engaging them in sports clubs and improving their medical culture;

conduct awareness activities aimed at forming ecological culture among youth, fostering respect for and protection of the environment and nature;

assist the deputy chairperson of the citizensʼ assembly for law and order issues in effectively organizing the activities of the “Devoted Youth” public patrol group;

(e) the adviser to the chairperson of the citizensʼ assembly on issues of the elderly and veterans shall exercise the following powers for the performance of the duties assigned to him/her:

submit proposals and recommendations on resolving issues in the mahalla through increasing the social activity of representatives of the older generation, as well as on organizing and conducting national customs, traditions and ceremonies;

participate in activities aimed at increasing parental responsibility and awareness in child upbringing, promoting effective enlightenment against ignorance, ensuring dress culture in general education schools and studentsʼ attendance;

assist the chairperson of the citizensʼ assembly in effectively organizing the activities of the commission on strengthening family values and the “Eldersʼ Council” group;

assist state and public organizations in supporting low-income and large families, single elderly citizens and persons with disabilities;

take measures to involve elderly persons, veterans, exemplary families and respected individuals residing in the mahalla in activities related to youth upbringing;

organize discussions among the population with participation of elderly persons and veterans on issues of religious enlightenment and moral education, as well as meetings with respected members of society and cultural-educational events;

organize educational events with participation of elderly persons and veterans in cooperation with state bodies and non-governmental non-profit organizations on the occasion of public holidays;

submit proposals for nominating active elderly persons and veterans participating in the activities of the citizensʼ assembly for state awards;

facilitate the formation of physical training groups among the population and promote the broad involvement of elderly persons in mass sports events;

actively participate in the implementation of the five important initiatives aimed at establishing a new system in social and spiritual-educational spheres;

organize measures aimed at preventing indifference, family conflicts and the spread of negative phenomena among youth in the form of “mass culture”;

organize awareness activities among elderly persons on sports, health improvement and increasing personal responsibility for health;

assist in organizing medical examinations of socially protected single elderly persons, providing outpatient, inpatient and home-based treatment for unattended citizens, and ensuring medical and social services for single elderly persons, pensioners and persons with disabilities;

assist in the social adaptation of persons of retirement age released from penal institutions;

take measures to provide comprehensive assistance to needy and unsupported single elderly persons;

conduct awareness activities aimed at organizing weddings and other family events in a modest manner without allowing social stratification;

organize events among the population with participation of elderly persons possessing extensive life and professional experience in fields such as science, art, handicrafts, home-based work, household farming and entrepreneurship;

submit proposals regarding citizens recommended for Hajj and Umrah pilgrimages;

assist in organizing trips for single elderly persons and pensioners to historical sites and pilgrimage places;

42. The organization of the activities of the bodies of the citizensʼ assembly shall be carried out by its council and the chairperson of the citizensʼ assembly.

43. The chairperson of the citizensʼ assembly shall be elected for a term of five years. Elections shall be organized and conducted in accordance with the Law of the Republic of Uzbekistan “On the election of the chairperson of the citizensʼ assembly”.

44. The chairperson of the citizensʼ assembly and his/her advisers shall be responsible for the proper and effective performance of the duties and functions assigned to them.

Chapter 8. Economic basis of the activities of the citizensʼ assembly

45. Public, social and domestic (social-service) facilities and other objects intended for various purposes, as well as vehicles, utility equipment and other movable and immovable property created, acquired or transferred to citizensʼ assemblies in accordance with the procedure established by law shall constitute their property.

46. The financial sources of the activities of self-government bodies of citizens shall be formed from:

their own funds;

funds of local budgets;

income from grants and investments;

income derived from the property of citizensʼ assemblies;

sponsorship and charitable contributions of legal entities and individuals;

other sources not prohibited by legislation.

47. Self-government bodies of citizens shall independently dispose of the financial resources in their bank accounts.

Financial resources of a citizensʼ assembly shall not be subject to seizure.

48. The council of the citizensʼ assembly shall report quarterly to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on the use of financial resources.

Chapter 9. Final provisions

49. Self-government bodies of citizens shall maintain records of their activities and submit reports to state statistics and tax authorities.

50. Proposals on introducing amendments and additions to the regulation on the citizensʼ assembly may be submitted to the citizensʼ assembly by its chairperson, council or audit commission.

51. Amendments and additions to the regulation on the citizensʼ assembly shall enter into force after being approved at the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) and registered with the relevant Public Service Centers.

52. Reorganization and termination of the activities of the citizensʼ assembly shall be carried out in accordance with legislation based on the decision of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) in cases of merger, division, liquidation or change of boundaries of administrative-territorial units and mahallas.

53. Upon adoption of a decision on termination of the activities of the citizensʼ assembly, a liquidation commission shall be established by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

54. Upon liquidation of the citizensʼ assembly, its funds and property shall be used for the purposes of this Regulation in accordance with the decision of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

MODEL STRUCTURE

Note. In accordance with the Law of the Republic of Uzbekistan “On self-government bodies of citizens”, depending on the relevance of issues in the respective territory, other commissions on the main directions of activity of the citizensʼ assembly may also be established by the citizensʼ assembly.

Model Regulation

on the commissions of the citizensʼ assembly

Chapter 1. General provisions

1. This Model Regulation, in accordance with the Law of the Republic of Uzbekistan “On self-government bodies of citizens”, regulates the activities of the commissions under the citizensʼ assembly (hereinafter — commissions).

2. The commissions shall carry out their activities on a public basis in accordance with the Constitution of the Republic of Uzbekistan, laws, other regulatory legal acts, the Regulation on the citizensʼ assembly, decisions of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) and its council, as well as this Model Regulation.

3. The following commissions shall operate under the citizensʼ assembly:

the commission of the citizensʼ assembly on strengthening family values;

the commission of the citizensʼ assembly on working with women;

the commission of the citizensʼ assembly on social support and public control;

the commission of the citizensʼ assembly on ecology and environmental protection, improvement and landscaping;

the audit commission under the citizensʼ assembly.

Chapter 2. Organization of the activities of the commission on strengthening family values of the citizensʼ assembly

§ 1. Main tasks, rights and obligations of the commission on strengthening family values of the citizensʼ assembly

4. The following shall be the main tasks of the commission on strengthening family values of the citizensʼ assembly (hereinafter — the commission on strengthening family values):

promotion of national, universal and family values in the territory;

participation in the effective implementation of state policy on family support, development and implementation of measures aimed at strengthening families;

conducting awareness-raising activities among the population that family conflicts, neglect of youth upbringing, exposure of citizens, especially youth, to harmful ideologies, alcoholism, drug addiction and commission of offences are among the main causes of family breakdown;

organization of targeted advocacy aimed at preparing young men and women for family life, supporting young families and preventing disruption of family relations, as well as promoting the sanctity of the family;

upon receiving information on spouses who have applied to the court or civil registry office for divorce, taking appropriate measures for reconciliation and notifying the relevant court or civil registry office ten days prior to the expiry of the reconciliation period about the work carried out;

studying the lifestyle and environment of families causing disturbances of peace in the territory and developing and implementing measures to eliminate factors negatively affecting peace and harmony;

popularization of exemplary families, their experience in child upbringing and model relations among family members;

promotion among young girls of respect for national, universal and family values, as well as knowledge, etiquette and spiritual and educational qualities;

conducting advocacy among the population on organizing weddings and other ceremonies in a modest manner, taking into account public interests, national values and exemplary traditions, and popularizing best practices in this regard.

5. In carrying out its tasks, the commission on strengthening family values shall cooperate with primary organizations of the Youth Union of Uzbekistan in enterprises, organizations and institutions in the territory, primary organizations on womenʼs issues, members of the council of the citizensʼ assembly, employees of the citizensʼ assembly, other commissions on the main areas of activity of the citizensʼ assembly, as well as public structures assisting the activities of the citizensʼ assembly.

6. The commission on strengthening family values shall have the right to:

submit proposals to the council of the citizensʼ assembly on obtaining necessary information from relevant organizations in accordance with the established procedure and, where necessary, studying such information on-site;

submit its decisions on issues within its competence to the council of the citizensʼ assembly for consideration;

obtain necessary information from educational institutions where children study, in compliance with information security requirements, in order to study the moral environment in mahallas and families;

identify factors negatively affecting peace, stability and cohesion in mahallas and families, as well as persons responsible, and submit proposals to the council of the citizensʼ assembly on eliminating causes and consequences of such negative situations;

within its competence, participate in disputes between spouses and close relatives concerning division of property and inheritance;

express its opinion, in accordance with the established procedure, on issues related to determining with which parent children shall reside after divorce, adoption of children or their placement in specialized institutions, including “Mehribonlik” and “Muruvvat” homes;

submit proposals to the council of the citizensʼ assembly to invite responsible officials of state bodies, representatives of non-governmental non-profit organizations, specialists and other persons to its meetings to obtain necessary information and explanations;

provide recommendations on conducting weddings and other ceremonies in a modest manner, taking into account public interests, national values and exemplary traditions;

submit proposals to the council of the citizensʼ assembly and the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on implementing measures provided for in this Model Regulation, including targeted support for young families.

7. The obligations of the commission on strengthening family values shall include:

strict compliance in its activities with legislative acts and the requirements of this Model Regulation;

active participation in the activities of the citizensʼ assembly and implementation of decisions of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) and its council;

regular and effective implementation of advocacy activities aimed at strengthening family values;

ensuring improvement of the moral environment in families and early prevention of negative phenomena such as early marriages and divorces;

not allowing violations of dignity, rights and freedoms of citizens in its activities;

submitting proposals to the council of the citizensʼ assembly on informing relevant authorities in cases of identified violations of law;

not disclosing information related to personal life that becomes known to members of the commission.

8. The chairperson and members of the commission on strengthening family values shall:

apply an individual approach in working with families, taking into account the environment of each family and using modern effective methods;

act politely and impartially in relations with citizens;

continuously improve their knowledge, especially in the field of human rights and freedoms and family law.

§ 2. Formation of the commission on strengthening family values and organization of its activities

9. Members of the commission on strengthening family values shall be elected by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) for a term of five years, within one month after the election of the chairperson of the citizensʼ assembly, in a composition of 8 — 12 members.

The composition of the commission on strengthening family values may include the mahalla womenʼs activist, the adviser on issues of the elderly and veterans, the imam-khatib, heads of educational institutions or their deputies for spiritual and educational affairs, a representative of the family doctor point (family polyclinic), psychologists, heads of exemplary families with life experience, and active members of the mahalla who enjoy public respect and are capable of exerting educational influence.

The commission on strengthening family values shall be headed by the chairperson of the citizensʼ assembly.

A candidate nominated for membership in the commission shall be considered elected if more than half of those present at the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) vote in favor.

In the event of early withdrawal of a member of the commission, a new member shall be elected by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) within one month.

10. The chairperson of the commission on strengthening family values shall:

organize and coordinate the activities of the commission;

ensure the implementation by commission members of the tasks established by this Model Regulation;

directly participate in activities aimed at improving the moral and ethical environment in families;

convene and conduct meetings;

represent the commission at meetings of the citizensʼ assembly (meeting of citizensʼ representatives) and the council of the citizensʼ assembly;

sign documents issued on behalf of the commission.

At its first organizational meeting, the commission shall elect from among its members a deputy chairperson and a secretary of the commission.

11. Annual and quarterly work plans of the commission on strengthening family values shall be discussed at commission meetings and approved by the council of the citizensʼ assembly.

Reports of commission members on the implementation of the work plan shall be heard monthly at commission meetings, and relevant decisions shall be adopted.

A meeting of the commission on strengthening family values shall be considered competent if at least two-thirds of its members are present. A decision shall be deemed adopted if more than half of the members present vote in favor.

12. The secretary of the commission on strengthening family values shall keep minutes of meetings and monitor the implementation of decisions.

13. The commission on strengthening family values shall report on its activities monthly to the council of the citizensʼ assembly and quarterly to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

Chapter 3. Organization of the activities of the commission on working with women of the citizensʼ assembly

§ 1. Main tasks, rights and obligations of the commission on working with women of the citizensʼ assembly

14. The following shall be the main tasks of the commission on working with women of the citizensʼ assembly (hereinafter — the commission on working with women):

providing social and legal support to women, increasing their socio-political activity and enhancing their spirituality;

in cooperation with primary organizations on womenʼs issues in enterprises, organizations and institutions located in the mahalla, implementing targeted measures to support women socially and legally in labor collectives and to increase their socio-political activity and spirituality;

widely promoting among women the essence of reforms being implemented in the country, opportunities being created and benefits provided for them;

protecting the rights and legitimate interests of women;

organizing spiritual and educational activities among women and ensuring their targeted involvement in events held jointly by the district (city) department for family and women with partner organizations;

implementing measures aimed at protecting womenʼs health, forming healthy families, developing family and womenʼs sports, and promoting a healthy lifestyle;

preparing proposals on increasing womenʼs socio-political activity;

conducting advocacy aimed at preventing negative phenomena among women (including crime, suicide, prostitution, drug addiction, and early marriage of underage girls);

assisting the council of the citizensʼ assembly in organizing national and religious customs and ceremonies in an orderly, modest and modern manner, taking into account public interests;

based on compiled lists, studying the family environment, needs and interests of girls, their involvement in clubs, and assisting the youth leader in organizing their free time effectively;

involving adolescent girls wishing to develop personal skills in “Bibikhonim schools”;

organizing individual discussions with girls requiring special upbringing, involving commission members, laureates of the “Exemplary family”, “Moʻtabar ayol”, “Mahalla iftikhori” badges and winners of the “Promoter of girlsʼ etiquette” competitions, and involving their mothers or guardians in “Parentsʼ University” activities;

ensuring participation of active women in district (city) stages of the “Girlsʼ etiquette promoter” competition;

organizing visits of women to theatres, cultural and educational institutions;

conducting preventive awareness activities in families where there is a risk of physical or psychological violence against women;

assisting in ensuring protection of women and children affected by threats and violence and in bringing perpetrators to accountability;

assisting in employment and social reintegration of women released from penal institutions, registered with probation services or returned from specialized educational institutions;

maintaining records of women leaving for abroad and returning from abroad, monitoring the condition of their families, and assisting such women in undergoing medical examinations and employment upon return.

15. In carrying out its tasks, the commission on working with women shall cooperate with primary organizations on womenʼs issues, educational and healthcare institutions, employees of the citizensʼ assembly, other commissions on the main areas of activity of the citizensʼ assembly, as well as public structures assisting the activities of the citizensʼ assembly.

16. The commission on working with women shall have the right to:

submit proposals to the district (city) department for family and women and the council of the citizensʼ assembly on obtaining necessary information from relevant organizations in accordance with the established procedure and, where necessary, studying such information on-site;

submit its decisions on issues within its competence for consideration to the district (city) department for family and women and the council of the citizensʼ assembly;

submit proposals to the district (city) department for family and women, the council of the citizensʼ assembly and the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on encouraging exemplary mothers, socially active women and talented girls, as well as providing broad material and moral support to young families;

submit proposals on protecting the rights, freedoms and legitimate interests of women to the district (city) department for family and women, the council of the citizensʼ assembly and the meeting of the citizensʼ assembly (meeting of citizensʼ representatives);

submit proposals on implementing measures provided for in this Model Regulation to the district (city) department for family and women, the council of the citizensʼ assembly and the meeting of the citizensʼ assembly (meeting of citizensʼ representatives);

submit proposals to invite representatives of state bodies, non-governmental non-profit organizations, specialists and other persons to its meetings for the purpose of obtaining necessary information and explanations.

17. The obligations of the commission on working with women shall include:

strict compliance in its activities with legislative acts and the requirements of this Model Regulation;

not allowing violations of dignity, rights and freedoms of citizens in the course of its activities;

active participation in the activities of the citizensʼ assembly and implementation of decisions of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives), the council of the citizensʼ assembly, as well as documents adopted by the Committee on Family and Women and its territorial subdivisions;

regular and effective implementation of advocacy activities within its area of competence;

submitting proposals to the district (city) department for family and women and the council of the citizensʼ assembly on informing relevant authorities in cases of identified violations of law;

not disclosing information related to personal life that becomes known to members of the commission.

18. The chairperson and members of the commission on working with women shall:

act politely and impartially in relations with citizens;

continuously improve their knowledge, especially in the field of human rights and freedoms and family law.

§ 2. Formation of the commission on working with women and organization of its activities

19. The commission on working with women shall be elected by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) for a term of five years, within one month after the election of the chairperson of the citizensʼ assembly, in a composition of 8 — 12 members.

The composition of the commission on working with women may include the deputy chairperson of the citizensʼ assembly for law and order issues — prevention inspector, representatives of educational institutions, family doctor points (family polyclinics), primary organizations of the Youth Union of Uzbekistan in enterprises and organizations in the territory, primary organizations on womenʼs issues, psychologists, as well as active women possessing life experience, enjoying public respect and capable of exerting educational influence.

The commission shall be headed by the mahalla womenʼs activist.

A candidate nominated for membership in the commission shall be considered elected if more than half of those present at the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) vote in favor.

In the event of early withdrawal of a member of the commission, a new member shall be elected by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) within one month.

20. The chairperson of the commission on working with women shall:

organize and coordinate the activities of the commission;

ensure implementation by commission members of the tasks established by this Model Regulation;

convene and conduct meetings;

represent the commission at meetings of the citizensʼ assembly (meeting of citizensʼ representatives) and the council of the citizensʼ assembly;

sign documents issued on behalf of the commission.

At its first organizational meeting, the commission shall elect from among its members a deputy chairperson and a secretary.

The duties of the deputy chairperson shall be determined by the chairperson of the commission in agreement with the council of the citizensʼ assembly. In the absence of the chairperson for valid reasons, the deputy chairperson shall perform his/her duties.

21. Distribution of duties and, on this basis, annual and quarterly work plans of the commission on working with women shall be discussed at commission meetings and approved by the council of the citizensʼ assembly.

Reports of commission members on the implementation of the work plan shall be heard monthly at commission meetings, and relevant decisions shall be adopted.

A meeting of the commission on working with women shall be considered competent if at least two-thirds of its members are present. A decision shall be deemed adopted if more than half of the members present vote in favor.

22. The secretary of the commission on working with women shall keep minutes of meetings and monitor the implementation of decisions.

23. The commission on working with women shall report on its activities monthly to the council of the citizensʼ assembly and quarterly to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

Chapter 4. Organization of the activities of the commission on social support and public control of the citizensʼ assembly

§ 1. Main tasks, rights and obligations of the commission on social support and public control of the citizensʼ assembly

24. The following shall be the main tasks of the commission on social support and public control of the citizensʼ assembly (hereinafter — the commission on social support and public control):

assisting in studying families, identifying and maintaining records of low-income families and single persons in need of care;

submitting proposals to the citizensʼ assembly and its council on implementing measures to support socially vulnerable segments of the population;

assisting in providing patronage support to single persons in need of care, as well as in implementing measures for their social protection, rehabilitation and improvement of living conditions;

exercising public control over the implementation of legislative acts, as well as decisions of the citizensʼ assembly;

exercising public control over observance of the rights and legitimate interests of business entities;

exercising public control over the quality of utility services provided by utility service organizations;

exercising public control over compliance with rules for construction of buildings and maintenance of adjacent territories;

exercising public control over the use and protection of land;

participating in exercising public control over compliance by members of the citizensʼ assembly with recommended standards for conducting weddings and other ceremonies;

exercising public control over the consideration and resolution of identified issues by responsible executors within the framework of the “mahalla — sector — Peopleʼs Reception — mahalla” cooperation system;

conducting awareness-raising activities among the population on the essence of legislation in the field of public control exercised by self-government bodies of citizens.

25. In carrying out its tasks, the commission on social support and public control shall cooperate with state bodies, mass media, territorial departments and district (city) branches of the Chamber of Commerce and Industry of the Republic of Uzbekistan, other non-governmental non-profit organizations, as well as employees of the citizensʼ assembly, other commissions on the main areas of activity of the citizensʼ assembly, and public structures assisting the activities of the citizensʼ assembly.

26. The commission on social support and public control shall have the right to:

submit its decisions on issues within its competence to the council of the citizensʼ assembly for consideration;

submit proposals to the citizensʼ assembly on supporting low-income families and single persons in need of care, including attracting voluntary funds of individuals and legal entities for these purposes;

submit proposals to the citizensʼ assembly on applying to relevant organizations and non-governmental non-profit organizations regarding free summer recreation of children from low-income families and families with minor children in health camps, as well as on conducting other social events;

initiate, organize and participate in activities related to the exercise of public control;

request from state bodies, in accordance with legislation, information necessary for exercising public control;

prepare proposals and recommendations based on the results of public control and submit them to relevant state bodies for consideration;

file complaints against unlawful decisions of state bodies and actions (inaction) of their officials to higher authorities or officials, or to a court in accordance with the procedure established by law;

submit proposals to the council of the citizensʼ assembly to involve representatives of state bodies, non-governmental non-profit organizations, specialists and other persons in its meetings for the purpose of obtaining necessary information and explanations;

submit proposals to the council of the citizensʼ assembly and the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on implementing measures provided for this Model Regulation.

27. The obligations of the commission on social support and public control shall include:

strict compliance in its activities with legislative acts and the requirements of this Model Regulation;

not allowing violations of honor, dignity, rights and freedoms of citizens;

ensuring strict compliance with procedures established by legislation in assigning and paying social benefits and material assistance to low-income families;

compliance with the requirements of legislation on public control;

observance of legally established restrictions related to the activities of state bodies when exercising public control;

non-interference in activities carried out by state bodies and their officials within their competence;

not creating obstacles to the functioning of state bodies and the activities of their officials;

active participation in the activities of the citizensʼ assembly and implementation of decisions of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) and its council;

regular and effective implementation of advocacy activities within its area of competence;

submitting proposals to the council of the citizensʼ assembly on informing relevant authorities in cases of identified violations of law;

not disclosing information related to personal life that becomes known to members of the commission.

28. The chairperson and members of the commission on social support and public control shall:

act politely and impartially in relations with citizens;

continuously improve their knowledge, especially in the field of human rights and freedoms, social protection and public control.

§ 2. Formation of the commission on social support and public control and organization of its activities

29. Members of the commission on social support and public control shall be elected by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) for a term of five years, within one month after the election of the chairperson of the citizensʼ assembly, in a composition of at least 15 members.

The composition of the commission on social support and public control shall include an employee of the district (city) Employment Promotion Center assigned to the territory of the citizensʼ assembly, representatives of non-governmental non-profit organizations, as well as active citizens possessing life experience, enjoying public respect and capable of exerting educational influence.

The commission on social support and public control shall be headed by the deputy chairperson of the citizensʼ assembly for improvement, household land and entrepreneurship issues.

A candidate nominated for membership in the commission shall be considered elected if more than half of those present at the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) vote in favor.

In the event of early withdrawal of a member of the commission, a new member shall be elected by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) within one month.

30. The chairperson of the commission on social support and public control shall:

organize and coordinate the activities of the commission;

ensure implementation by commission members of the tasks established by this Model Regulation;

convene and conduct meetings;

represent the commission at meetings of the citizensʼ assembly (meeting of citizensʼ representatives) and the council of the citizensʼ assembly;

sign documents issued on behalf of the commission.

31. Annual and quarterly work plans of the commission on social support and public control shall be discussed at commission meetings and approved by the council of the citizensʼ assembly.

32. In carrying out its activities, the commission on social support and public control shall hold meetings and adopt relevant decisions based on citizensʼ appeals, proposals of the chairperson and members of the commission, as well as the emergence of social issues in the territory.

33. A meeting of the commission on social support and public control shall be considered competent if at least two-thirds of its members are present. A decision shall be deemed adopted if more than half of the members present vote in favor.

34. The secretary of the commission on social support and public control shall keep minutes of meetings and monitor the implementation of decisions.

35. The commission on social support and public control shall report on its activities monthly to the council of the citizensʼ assembly and quarterly to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

Chapter 5. Organization of the activities of the commission of the citizensʼ assembly on ecology and environmental protection, improvement and greening

§ 1. Main tasks, rights and obligations of the commission of the citizensʼ assembly on ecology and environmental protection, improvement and greening

36. The following shall be the main tasks of the commission of the citizensʼ assembly on ecology and environmental protection, improvement and greening (hereinafter — the commission on ecology, environmental protection, improvement and greening):

participation in ensuring the implementation of measures provided for in legislation, as well as national and territorial programs in the field of environmental protection, improvement and greening;

assisting the council of the citizensʼ assembly in organizing voluntary participation of the population in improvement and greening of houses, yard buildings, adjacent territories of houses (including multi-apartment buildings), equipping childrenʼs and sports grounds, construction, reconstruction, repair and maintenance of roads, bridges, streets and utility networks, as well as restoration of historical and cultural monuments and cemeteries, including organizing hashar activities, reviews and competitions;

submitting proposals to hear reports of heads of organizations located in the territory on issues of environmental protection and improvement within the competence of the citizensʼ assembly;

submitting proposals to the citizensʼ assembly and its council on adopting decisions on repairing houses and households of low-income families, including raising voluntary funds from the population for this purpose;

assisting in organizing measures on rational use of fuel, electricity, heat energy and water resources, and reduction of their waste;

assisting in monitoring the sanitary and ecological condition of settlements, water supply sources, residential premises, schools and other educational institutions;

monitoring compliance by the population with waste disposal in designated places and conducting awareness activities aimed at preventing seasonal burning of leaves;

raising ecological culture of members of the citizensʼ assembly, developing environmental education among youth, and conducting awareness activities on careful attitude of citizens towards the environment;

carrying out public control over the quality of utility services provided by service organizations, compliance with rules for construction of buildings and maintenance of adjacent territories, as well as use and protection of land.

37. In performing its tasks, the commission on ecology, environmental protection, improvement and greening shall cooperate with district (city) environmental protection inspections, utility service organizations, non-governmental non-profit organizations, educational institutions, primary organizations of the Youth Union of Uzbekistan in enterprises and organizations located in the territory, employees of the citizensʼ assembly, other commissions on main areas of activity of the citizensʼ assembly, as well as public structures assisting the activities of the citizensʼ assembly.

38. The commission on ecology, environmental protection, improvement and greening shall have the right to:

submit proposals to the council of the citizensʼ assembly to obtain necessary information from relevant organizations in accordance with the established procedure, and, if necessary, to study such information on-site;

submit its decisions on issues within its competence for consideration by the council of the citizensʼ assembly;

develop plans of measures on improvement and greening of the territory and submit them to the council of the citizensʼ assembly for consideration and approval by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives);

submit proposals to the council of the citizensʼ assembly on organizing activities related to environmental protection, improvement and greening;

submit proposals to the council of the citizensʼ assembly to involve representatives of state bodies, non-governmental non-profit organizations, specialists and other persons in its meetings;

submit proposals to the council of the citizensʼ assembly on dissemination of best practices and exemplary activities of members of the citizensʼ assembly in maintaining environmental cleanliness, greening, improvement and rational use of natural resources;

submit proposals to the council of the citizensʼ assembly and the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on implementation of measures provided by this Model Regulation.

39. The obligations of the commission on ecology, environmental protection, improvement and greening shall include:

strict compliance in its activities with legislation and the requirements of this Model Regulation;

not allowing any infringement of the honor and dignity of citizens, as well as violation of their rights and freedoms;

active participation in the activities of the citizensʼ assembly, and implementation in practice of the decisions of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) and its council;

regular, effective and targeted implementation of awareness-raising activities within its area of competence;

submission of proposals to the council of the citizensʼ assembly on notifying the relevant authorities in cases where violations of legislation are identified;

non-disclosure of information relating to private life that has become known to members of the commission on ecology, environmental protection, improvement and greening.

40. The chairperson and members of the commission on ecology, environmental protection, improvement and greening shall:

be polite and impartial in relations with citizens during their activities;

continuously improve their knowledge, especially legal knowledge in the field of human rights and freedoms and environmental protection.

§ 2. Formation of the commission on ecology and environmental protection, improvement and greening and organization of its activities

41. The commission on ecology and environmental protection, improvement and greening shall be elected by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) for a term of five years, within one month after the election of the chairperson of the citizensʼ assembly, in a composition of 8 — 12 members.

The composition of the commission may include representatives of educational institutions, utility service organizations, primary organizations of the Youth Union of Uzbekistan in enterprises, organizations and institutions located in the territory, the deputy chairperson of the citizensʼ assembly for law and order issues (prevention inspector), as well as active citizens, including initiative youth, possessing life experience, enjoying public respect and capable of exerting educational influence.

The commission on ecology and environmental protection, improvement and greening shall be headed by the deputy chairperson of the citizensʼ assembly for entrepreneurship, household land and improvement issues.

A candidate nominated for membership in the commission shall be considered elected if more than half of those present at the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) vote in favor.

In the event of early withdrawal of a member of the commission, a new member shall be elected by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) within one month.

42. The chairperson of the commission on ecology and environmental protection, improvement and greening shall:

organize and coordinate the activities of the commission;

ensure implementation by commission members of the tasks established by this Model Regulation;

convene and conduct meetings;

represent the commission at meetings of the citizensʼ assembly (meeting of citizensʼ representatives) and the council of the citizensʼ assembly;

sign documents issued on behalf of the commission.

45. The commission shall report on its activities monthly to the council of the citizensʼ assembly and quarterly to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

Chapter 6. Organization of the activities of the audit commission of the citizensʼ assembly

§ 1. Legal status, main tasks, rights and obligations of the audit commission of the citizensʼ assembly

46. The audit commission shall carry out its activities on a public basis and shall be elected by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) from among members of the citizensʼ assembly who possess sufficient knowledge and experience in the field of financial and economic activities, in a composition of at least three persons, by secret or open voting.

47. The purpose of the audit commission shall be to examine the financial and economic activities of the citizensʼ assembly.

48. The audit commission shall carry out its activities in accordance with the Constitution and laws of the Republic of Uzbekistan, other normative legal acts, the Regulation on the citizensʼ assembly, decisions of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives), as well as this Model Regulation.

49. The audit commission shall conduct its inspections in accordance with the decision of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

Unscheduled inspections shall be carried out upon request of at least one-third of the members of the citizensʼ assembly.

50. The audit commission shall be independent in its activities and accountable only to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

51. The following shall be the main tasks of the audit commission:

verification of the preservation and use of the property of the citizensʼ assembly by its bodies, including targeted and адресное use of monetary funds;

verification of the maintenance of accounting documents by the bodies of the citizensʼ assembly in accordance with legislation;

verification of compliance of financial and economic activities of business entities established by the citizensʼ assembly with legislation, analysis of results and submission of proposals and conclusions to the citizensʼ assembly;

control over targeted use of attracted sponsorship and charitable funds;

development of measures to eliminate deficiencies and violations identified in financial and economic activities and submission thereof for approval to the meeting of the citizensʼ assembly.

52. The audit commission shall examine the financial and economic activities of the citizensʼ assembly based on the results of a one-year or other reporting period in accordance with the decision of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

Inspection of the financial and economic activities of the citizensʼ assembly shall be carried out mandatorily upon completion of the term of office of the chairperson of the citizensʼ assembly.

53. In carrying out its tasks, the audit commission shall have the right to:

prepare annual work plans for inspections and submit them for approval to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives);

independently determine forms and methods of inspections in accordance with legislation;

obtain written information necessary for inspections, including information on the activities of business entities established by the citizensʼ assembly;

involve independent auditors and specialists in accordance with the established procedure;

examine financial, economic and accounting documents, and, where necessary, verify data by visiting households;

verify compliance of contracts concluded on behalf of the citizensʼ assembly, transactions carried out and settlements with counterparties with legislation;

verify compliance with established normative indicators and rules in financial and economic activities;

study the use of property of the citizensʼ assembly;

obtain explanations from materially responsible persons regarding facts identified during inspections;

submit proposals to convene a meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on deficiencies and violations identified in financial and economic activities;

verify the correctness of decisions adopted by the council or the chairperson of the citizensʼ assembly, their compliance with legislation and decisions of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives);

verify correctness of reporting documents prepared for tax authorities, statistical bodies and other authorized state bodies;

compare financial documents and inventory data of property with primary accounting records;

analyze compliance of accounting practices with established normative rules;

provide recommendations on maintaining financial and economic reporting in accordance with established procedure;

submit proposals to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on amendments and additions to the Regulation on the citizensʼ assembly.

At the request of the audit commission, the person responsible for the financial and economic activities of the citizensʼ assembly shall provide the necessary documents.

54. The audit commission shall have the following obligations:

strict compliance with legislation and requirements of this Model Regulation during inspections;

ensure proper storage of copies of conclusions based on inspection results;

timely submit written reports on inspection results to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives);

not disclose confidential information that became known to members of the audit commission in the course of their duties.

During inspections, members of the audit commission shall be obliged to thoroughly examine all documents and materials related to the subject of inspection.

Responsibility for ensuring the safekeeping of documents during inspections shall rest with the chairperson of the audit commission.

§ 2. Organization of the activities of the audit commission under the citizensʼ assembly

55. The meeting of the citizensʼ assembly (meeting of citizensʼ representatives) shall, within one month after the election of the chairperson of the citizensʼ assembly, establish the audit commission and elect its members and chairperson.

Candidates for membership and for the position of chairperson of the audit commission shall be nominated by the citizensʼ assembly (chairperson).

A candidate nominated to the audit commission shall be considered elected if more than half of those present at the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) vote in favor.

Voting shall be conducted separately for each candidate for membership in the audit commission.

If a candidate nominated by the citizensʼ assembly (chairperson) is not elected, another candidate shall be nominated on the same day from among members of the citizensʼ assembly and elected in accordance with the established procedure.

The chairperson and members of the audit commission shall be elected for a term of five years.

The number of members of the audit commission shall be odd.

56. The chairperson or a member of the audit commission shall be removed from the composition of the audit commission by decision of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) in the following cases:

resignation from his/her powers;

systematic failure, without valid reasons, to perform duties provided for by this Model Regulation;

systematic absence, without valid reasons, from meetings of the citizensʼ assembly (meeting of citizensʼ representatives) on issues related to the activities of the audit commission three or more times, or failure to fulfill assigned tasks;

commission of actions discrediting the citizensʼ assembly;

recognition as legally incapable in established procedure;

entry into legal force of a court conviction;

recognition by a court decision that has entered into legal force as missing or declaration as deceased;

loss of citizenship of the Republic of Uzbekistan;

change of permanent or principal place of residence;

inability to perform duties for more than three months due to health condition or other valid reasons;

death.

In case of removal of the chairperson or a member of the audit commission, the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) shall elect a new chairperson or member within one month.

57. A meeting of the audit commission shall be considered competent if at least two-thirds of its members are present.

Each member of the audit commission shall have one vote.

Acts and conclusions of the audit commission shall be approved by a simple majority vote of those present at the meeting. In case of a tie, the vote of the chairperson of the audit commission shall be decisive.

Members of the audit commission who disagree with a decision shall have the right to record their dissenting opinion in the minutes and to submit it to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) and to the council of the citizensʼ assembly.

58. The chairperson of the audit commission shall:

convene and conduct meetings of the audit commission;

organize the current activities of the audit commission;

represent the audit commission at meetings of the citizensʼ assembly (meeting of citizensʼ representatives) and the council of the citizensʼ assembly;

sign documents issued on behalf of the audit commission;

report on the work performed to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) once every quarter.

59. Members of the audit commission may not simultaneously be members of other bodies of the citizensʼ assembly.

§ 3. Conclusion of the audit commission

60. Based on the results of the inspection of the financial and economic activities of the citizensʼ assembly, the audit commission shall prepare a conclusion containing the following:

an assessment of the reliability and accuracy of the data contained in reports and other financial documents;

information on violations of the procedure for maintaining accounting records and submitting financial reporting, as well as facts of violations of legislation;

recommendations for elimination identified violations, as well as proposals aimed at improving the efficiency of the financial activities of the citizensʼ assembly.

61. The conclusion of the audit commission shall be signed by the chairperson and members of the audit commission, the chairperson of the citizensʼ assembly, and the person responsible for maintaining accounting records of the citizensʼ assembly, designated by decision of the council of the citizensʼ assembly upon recommendation of the chairperson.

62. If the chairperson of the citizensʼ assembly or the person responsible for maintaining accounting records expresses objections to the conclusion of the audit commission, such objections may be attached simultaneously with signing the conclusion.

63. The audit commission shall provide its opinion on objections submitted regarding the conclusion prepared based on the results of the inspection.

64. The report of the audit commission may not be provided to third parties until it is considered at the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

65. The liquidation and reorganization of the audit commission shall be carried out in accordance with the decision of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) in cases of merger, division, liquidation or change of boundaries of the respective citizensʼ assembly.

Chapter 7. Final provisions

66. The liquidation and reorganization of commissions shall be carried out in accordance with the decision of the self-government body of citizens in cases of merger, division, liquidation or change of boundaries of the respective citizensʼ assembly.

67. Persons guilty of violating the requirements of this Model Regulation shall be held liable in accordance with the legislation.

ANNEX 3 to the Resolution of the Cabinet of Ministers dated June 18, 2021 No. 380

Model Regulation

on public structures under the citizensʼ assembly

Chapter 1. General provisions

1. This Model Regulation defines the purpose and main tasks, rights and obligations, as well as the procedure for organizing the activities of public structures under the citizensʼ assembly (hereinafter — public structures).

2. In carrying out their activities, public structures shall cooperate with state bodies, educational and medical institutions, non-governmental non-profit organizations, employees of the citizensʼ assembly, commissions on the main areas of activity of the citizensʼ assembly, as well as other public structures assisting the activities of the citizensʼ assembly.

3. The following public structures shall operate under the citizensʼ assembly:

the “Parentsʼ University” public structure;

the “Womenʼs Advisory Council”;

the “Council of Elders” group;

the “Mahalla Control” group;

the Mahalla “Seven”.

4. Decisions of public structures shall be of a recommendatory nature. The regulation of public structures shall be approved by the decision of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

5. Public structures shall carry out their activities on a public basis in compliance with the principles of transparency, collegiality, mutual respect, equality, voluntariness and consideration of public opinion.

Chapter 2. Organization of the activities of the “Parentsʼ University” public structure

§ 1. Purpose, main tasks, rights and obligations of the “Parentsʼ University”

6. The “Parentsʼ University” (hereinafter — the University), in accordance with this Model Regulation, shall carry out activities aimed at providing practical assistance to parents, youth and other persons residing in the mahalla who face various problems in family relations, in overcoming difficult situations related to ensuring a healthy lifestyle in families and child upbringing, as well as improving their legal, moral, pedagogical, psychological and medical knowledge.

The purpose of the University shall be to improve the social and moral environment in the mahalla, assist in enhancing the competence of parents in matters of child upbringing, and further improve efforts to eliminate existing problems in families in this sphere.

7. The following shall be the main tasks of the University:

implementation of activities aimed at improving parentsʼ legal, moral, pedagogical, psychological and medical knowledge in child upbringing;

working with parents who do not pay sufficient attention to child upbringing;

assisting in preventing situations negatively affecting the stability of the social and moral environment in families in the mahalla;

providing assistance to parents in the process of child upbringing;

assisting in ensuring a healthy social and moral environment in families.

8. The University shall have the right to:

request, in established procedure, necessary information from relevant organizations for its activities;

develop, approve and amend, as necessary, action plans for providing assistance to families and individuals;

develop and improve, as necessary, plans of training sessions organized by the University;

submit its decisions on relevant issues for consideration to the district (city) department for family and womenʼs affairs and the council of the citizensʼ assembly;

involve representatives of state bodies, non-governmental non-profit organizations, qualified specialists and other persons in activities and training sessions for the implementation of tasks provided for by this Model Regulation;

organize University sessions using materials from public opinion surveys conducted in the mahalla, results of research carried out by the Institute for Family and Gender Studies, statistical data, publications in mass media, best practices of exemplary families and other practical examples.

9. The University shall be obliged to:

strictly comply in its activities with legislation and requirements of this Model Regulation;

assist in preventing disruption of the moral and ethical environment in families and mahallas, including negative impacts on child upbringing;

actively participate in the life of the citizensʼ assembly in matters related to working with parents and child upbringing, as well as in the implementation of decisions of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives), the council of the citizensʼ assembly, and documents adopted by the Committee on Family and Women and its territorial subdivisions;

regularly and effectively carry out University sessions and awareness activities in a targeted manner;

organize systematic work with parents of youth influenced by harmful ideas or who have committed offenses;

submit proposals to the district (city) department for family and womenʼs affairs and the council of the citizensʼ assembly on informing the relevant bodies in cases of identification of violations of legislation;

not disclose personal information that became known to members of the University.

§ 2. Formation of the composition of the University

10. The composition of the University shall be elected by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) for a term of five years, within one month after the election of the chairperson of the citizensʼ assembly, in a composition of 8 — 12 members.

The University shall be headed by an active woman residing in the territory of the citizensʼ assembly, possessing life experience, authority among the population and high potential. A candidate for the position of deputy head of the University and for membership shall be considered elected if more than half of those present at the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) vote in favor.

The mahalla womenʼs activist shall organize and coordinate the activities of the University in working with women.

11. Members of the University shall be elected from among lawyers, doctors, teachers, psychologists and other specialists, as well as active citizens who deeply understand the essence of the tasks assigned to the University, possess high authority, significant life experience, organizational skills and enjoy public respect due to their exemplary conduct.

12. The University shall consider its main tasks at meetings convened at least once a month. A meeting of the University shall be considered competent if at least two-thirds of its members are present. A decision shall be deemed adopted if more than half of the members vote in favor.

13. The following issues shall be considered at meetings of the University:

issues related to development of annual and quarterly work plans of the University, including plans for training sessions, and submission thereof for approval to the district (city) department for family and womenʼs affairs and the council of the citizensʼ assembly;

issues related to hearing reports of University members on the implementation of work plans;

other issues requiring coordination with the district (city) department for family and womenʼs affairs and the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

14. The head of the University shall:

organize and coordinate the activities of the University;

chair meetings of the University;

form a list of parents, youth and other persons facing various problems in family relations and develop and approve action plans to resolve their problems;

organize activities aimed at providing practical assistance to parents, youth and other persons in the mahalla in overcoming difficult situations related to ensuring a healthy lifestyle in families and child upbringing, as well as improving their legal, moral, pedagogical, psychological and medical knowledge;

distribute duties among University members;

ensure timely and high-quality execution of assigned tasks by members, observing ethical standards in working with families;

consider issues related to hearing reports of University members on work performed;

represent the University at meetings of the citizensʼ assembly (meeting of citizensʼ representatives) and the council of the citizensʼ assembly;

sign documents issued on behalf of the University;

consider other issues requiring coordination with the district (city) department for family and womenʼs affairs and the meeting of the citizensʼ assembly (meeting of citizensʼ representatives);

report on the activities of the University to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on a quarterly basis.

15. The powers of the deputy head and members of the University shall be determined by the head of the University based on the purpose, main tasks, rights and obligations provided for by this Model Regulation.

In the absence of the head for valid reasons, the deputy head shall perform his/her duties.

16. The University shall study the list of parents, youth and other persons facing various problems in family relations compiled by its members and develop action plans aimed at resolving these problems.

17. Measures aimed at providing practical assistance to parents, youth and other persons in the mahalla in overcoming difficult situations related to ensuring a healthy lifestyle in families and child upbringing, as well as improving their legal, moral, pedagogical, psychological and medical knowledge, shall be approved by the head of the University.

18. Measures may provide for individual or group work with a family or a person included in the list.

19. Measures shall include assessment of the situation in the family and the problems encountered, improvement and strengthening of the social and moral environment in the family, ensuring its stability, and enhancement of parentsʼ legal, moral, pedagogical, psychological and medical knowledge in child upbringing.

Such measures may also include training sessions and awareness activities in relevant areas.

20. In accordance with the model form provided in Annex 1 to this Model Regulation, the action plan for individual work with a family or a person shall include:

information about the family or person (surname, name, patronymic of the applicant, year of birth, family composition, number of minors and other data);

the cause of the difficult situation (problem);

measures to resolve the problem (indicating the name of activities and deadlines);

factors hindering the resolution of the problem and measures to eliminate them (including the need to involve other bodies and organizations).

21. Activities and training sessions organized by the University shall take into account the age, gender and education of participants. The place, time and procedure for conducting group sessions shall be determined by the University meeting, taking into account participantsʼ free time.

22. Group sessions of the University may be conducted in the following areas:

family law;

family spirituality;

family management;

family economics;

family psychology;

medical culture of the family;

healthy lifestyle in the family.

23. Topics of University sessions shall be determined based on the specific characteristics of the territory and existing problems, including issues identified during communication with the population.

24. Upon completion of measures provided for in the action plan for individual work with a family or person, surveys shall be conducted among participants, a conclusion shall be formed on overcoming the difficult situation, and based on this conclusion the family or person shall be removed from the list.

25. Results shall be analyzed on a monthly, quarterly, semi-annual and annual basis, and the number of families or persons removed from the list shall serve as an indicator of the effectiveness of the Universityʼs activities.

26. The form of a model questionnaire conducted among families or persons who have overcome difficult situations shall be approved by the head of the University.

27. Awareness activities of the University shall be carried out by its members through regular explanatory work among the population residing in the mahalla regarding the goals and tasks of the University, as well as through publication of materials in national and local mass media.

28. The Institute for Family and Gender Studies, the district (city) department for family and womenʼs affairs, as well as state and non-governmental non-profit organizations shall provide methodological and practical assistance in the effective organization of the Universityʼs activities.

§ 3. Early termination of the powers of university members

29. The powers of members of the University shall be terminated ahead of schedule in the following cases:

in case of resignation;

if declared legally incapable in accordance with the established procedure;

upon entry into legal force of a court conviction against him/her;

if recognized as missing or declared deceased by a court decision that has entered into legal force;

upon loss of citizenship of the Republic of Uzbekistan;

if unable to perform duties for three months due to health condition or other valid reasons;

in case of death.

30. In the event of early termination of the powers of university members, new elections to fill the vacant positions shall be held within one month by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

Chapter 3. Organization of the activities of the “Womenʼs Advisory Council”

§ 1. Main purpose, tasks, rights and obligations of the “Womenʼs Advisory Council”

31. The purpose of the “Womenʼs Advisory Council” (hereinafter — the Council) is to study the problems of women in need of social protection, assist in their resolution, strengthen families, provide advisory support aimed at increasing their role in child upbringing and social activity, as well as widely promote the ideas of an “educated girl”, a “virtuous bride” and an “enlightened woman”.

32. The main tasks of the Council shall include:

studying the problems of women in need of social protection and assisting in their resolution, and, where necessary, completing questionnaires for inclusion in the “Womenʼs Register”;

training women in need of social protection in entrepreneurship, developing model business plans and assisting them in obtaining loans;

conducting targeted work with women included in the “Womenʼs Register” and providing them with psychological counseling;

widely promoting the essence of reforms being implemented in the country to support women, as well as opportunities and benefits created for them;

providing legal, moral, pedagogical, psychological and medical advice to women in order to strengthen families and increase their role in child upbringing and social activity;

widely promoting among the population the ideas of an “educated girl”, a “virtuous bride” and an “enlightened woman”;

exercising public oversight over the timely resolution of problems of women, especially those included in the “Womenʼs Register”.

33. In performing its tasks, the Council shall have the right to:

consider appeals of women, including those included in the “Womenʼs Register”, and assist in resolving their problems;

conduct surveys to comprehensively analyze issues affecting the rights, freedoms and legitimate interests of women and determine optimal ways to resolve them;

prepare proposals and recommendations based on the results of activities and submit them to the council of the citizensʼ assembly and the district (city) department for family and womenʼs affairs for consideration;

establish targeted cooperation with organizations providing social support to families and women;

in case of identification violations of the rights and legitimate interests of women, submit materials to the district (city) department for family and womenʼs affairs for referral to law enforcement bodies;

involve qualified specialists in the Councilʼs activities where necessary;

put forward initiatives within the scope of tasks defined by this Model Regulation;

organize seminars, trainings, meetings, round tables, competitions and other events;

disseminate information about its activities in mass media, including on the Internet;

exercise public oversight over the implementation of legislation on benefits provided for women, especially those in difficult social situations, including women with disabilities.

34. The Council shall be obliged to:

comply with legislation and the requirements of this Model Regulation in its activities;

be polite, sincere and impartial in communication with citizens;

not interfere in the activities of state bodies and their officials carried out within their competence;

not allow humiliation of the honor and dignity of women or interference in their private life;

ensure confidentiality of information obtained in the course of its activities if its disclosure is restricted by law, and prevent disclosure of confidential information.

§ 2. Formation of the composition of the Council and organization of its activities

35. The Council shall be formed by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) in a composition of 10 — 15 members and shall be approved by the decision of the district (city) public council on women.

The number of members of the Council shall be determined depending on the population size of the citizensʼ assembly and the volume of work.

36. The composition of the Council may include the mahalla womenʼs activist, women residing in the mahalla who have rich life and practical experience, are well aware of womenʼs issues, are active and proactive, enjoy authority among the population, as well as respected elderly women, businesswomen, women holding managerial positions in educational and healthcare institutions in the territory, otinoyis, and psychologists.

37. The Council shall be headed by an active woman residing in the mahalla territory, possessing life experience, authority among the population and high potential.

The mahalla womenʼs activist shall organize and coordinate the activities of the Council in working with women.

38. The Chairperson of the Council shall:

exercise overall leadership of the Councilʼs activities;

convene and chair meetings of the Council;

organize the current activities of the Council;

represent the Council at meetings of the citizensʼ assembly and its council;

sign documents issued on behalf of the Council;

ensure timely communication to members of training and methodological guidance related to the Councilʼs activities and oversee their implementation;

analyze the activities of the Council and develop measures for their further improvement;

exercise other powers aimed at ensuring the effective functioning of the Council.

The Chairperson of the Council shall distribute the tasks provided for by this Model Regulation among the members and ensure their execution.

39. At its first organizational meeting, the Council shall elect from among its members the Chairperson, the Deputy Chairperson and the Secretary of the Council.

The functions of the Deputy Chairperson shall be determined by the Chairperson in agreement with the mahalla womenʼs activist. In the absence of the Chairperson for valid reasons, the Deputy Chairperson shall perform his/her duties.

40. The Secretary of the Council shall keep minutes of meetings and monitor the implementation of decisions.

41. Meetings of the Council shall be held as necessary, but at least once every quarter.

42. The procedure (schedule) of the Councilʼs work shall be determined by the Chairperson of the Council in agreement with its members, based on the procedure set out in Annex 2 to this Model Regulation.

43. Provision of premises allocated to the Council with necessary equipment, repair of premises, and material incentives for members of the Council shall be financed from the funds of relevant organizations, funds and other sources not prohibited by legislation.

44. The following shall be the methods of the Councilʼs activities:

individual interviews;

individual consultations (on education, employment-related issues, interpersonal relations, personal problems);

questionnaire surveys;

psychological diagnostics;

psychological, pedagogical and legal counseling, psychological correction;

trainings (engaging and effective exercises facilitating interpersonal relations and professional success);

round tables;

spiritual and educational events;

thematic meetings in various formats (lectures, seminars, clubs) with a psychologist aimed at developing psychological competence and skills for effective resolution of emerging problem situations.

45. The Council shall report on its activities monthly to the district (city) department for family and womenʼs affairs and quarterly to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

46. The activities of the Council shall be coordinated by the district (city) department for family and womenʼs affairs, which shall provide methodological and practical assistance, approve the Councilʼs work plan and conduct monitoring of its quarterly, semi-annual and annual activities.

47. The district (city) department for family and womenʼs affairs shall regularly take measures to improve the knowledge and qualifications of the chairpersons and members of the “Womenʼs Advisory Councils”.

48. The Council shall cooperate with the Commission on strengthening family values and the Commission on working with women under citizensʼ assemblies in the following cases:

when a comprehensive approach to womenʼs issues is required;

when resolution of problematic issues is related to family members of the women concerned;

when developing proposals aimed at increasing the role of women in child upbringing and ensuring a stable moral environment in families;

when eliminating problems hindering the realization of the rights, freedoms and legitimate interests of women.

Chapter 4. Organization of the activities of the “Eldersʼ Advisory Group”

§ 1. Purpose, main tasks, rights and obligations of the “Eldersʼ Advisory Group”

49. The purpose of the “Eldersʼ Advisory Group” (hereinafter — the Group) is to conduct targeted study and resolution of the problems of the elderly, effectively use the rich life experience of representatives of the older generation to stabilize the social and moral environment in families and the mahalla, contribute to the upbringing of youth, and ensure their active participation in the process of reforms.

50. The main tasks of the Group shall include:

establishing public oversight, in accordance with legislation, over the activities of organizations and institutions providing services to the population, as well as bodies of state power and administration in the territory;

assisting in increasing legal awareness and legal culture of the population, especially improving legal literacy among youth;

increasing the responsibility and awareness of parents in child upbringing, carrying out educational activities against ignorance, and implementing measures in general education schools aimed at promoting dress culture and ensuring student attendance;

enhancing the social activity of representatives of the older generation in state and public life, providing guidance in resolving issues within the citizensʼ assembly territory, and in organizing and conducting national traditions, customs and ceremonies;

assisting the council of the citizensʼ assembly in strengthening the social and moral environment in families;

supporting poor and large families, as well as single and disabled citizens, assisting the citizensʼ assembly council, state and public organizations in providing social support to them;

forming groups for physical training among the population and actively engaging elderly persons in mass sports competitions;

actively participating in the implementation of the “Five Important Initiatives” in mahallas aimed at developing social, spiritual and educational spheres;

preventing indifference, family conflicts and the spread of negative aspects of “mass culture” among youth, and fostering a public attitude aimed at ensuring stability of the social and moral environment in the citizensʼ assembly;

conducting awareness activities among the elderly on sports, healthy aging and personal responsibility for health;

assisting in organizing medical examinations of socially vulnerable elderly persons, ensuring medical and social services for lonely elderly, pensioners and persons with disabilities, including treatment in outpatient, inpatient and home conditions, and monitoring these processes;

assisting in the social adaptation and employment of persons of retirement age released from penal institutions

conducting awareness and explanatory activities in the mahalla on organizing weddings and other family events in a modest manner;

organizing events among the population with participation of elderly persons possessing rich life and professional experience in fields such as science, art, handicrafts, home-based work, household farming and entrepreneurship;

organizing regular visits for lonely elderly persons and pensioners to historical sites and pilgrimage places.

51. The Group shall have the right to:

request necessary information for its activities from relevant organizations in accordance with established procedure;

submit its decisions on issues within its competence to the council of the citizensʼ assembly for consideration;

involve representatives of state bodies, non-governmental non-profit organizations and other persons in events for the purpose of fulfilling the tasks set out in this Model Regulation;

submit proposals to the council of the citizensʼ assembly and the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) on eliminating causes and consequences of factors negatively affecting peace and harmony in the mahalla;

submit proposals on encouraging socially active, proactive and dedicated elderly persons, including nomination for badges such as “Veteran of Labor”, “Honored Woman” and “Pride of the Mahalla”;

study problems of the elderly in the mahalla and provide recommendations to responsible bodies for their resolution.

52. The Group shall be obliged to:

strictly comply with legislation and the requirements of this Model Regulation in its activities;

actively participate in the life of the citizensʼ assembly and in the implementation of decisions of the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) and its council;

regularly conduct awareness activities in an effective and targeted manner within its area of responsibility;

not allow humiliation of the dignity of citizens or violation of their rights and freedoms in the course of its activities;

submit proposals to the council of the citizensʼ assembly on informing relevant authorities in cases of detected violations of law;

not disclose personal information about private life that becomes known to members of the Group.

§ 2. Formation of the composition of the Group and organization of its activities

53. The composition of the Group shall be elected by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) for a term of five years, within one month after the election of the chairperson of the citizensʼ assembly, in a composition of 8 — 12 members.

The composition of the Group shall include socially active representatives of the older generation who enjoy authority in the mahalla, serve as role models, as well as retired employees of law enforcement bodies.

Leadership of the Group shall be exercised by the chairperson of the citizensʼ assembly.

A candidate nominated for membership in the Group shall be considered elected if more than half of those present at the meeting of the citizensʼ assembly (meeting of citizensʼ representatives) vote in favor.

In case a member leaves the Group before the expiration of his/her term, a new member shall be elected within one month by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

54. The head of the Group shall:

organize and coordinate the activities of the Group;

ensure fulfillment of the tasks established by this Model Regulation by the members of the Group;

convene and conduct meetings;

represent the Group at meetings of the citizensʼ assembly (meeting of citizensʼ representatives) and the council of the citizensʼ assembly;

sign documents issued on behalf of the Group.

55. At its first organizational meeting, the Group shall elect from among its members the deputy head and the secretary of the Group.

The functions of the deputy head shall be determined by the head of the Group in agreement with the council of the citizensʼ assembly.

In the absence of the head for valid reasons, the deputy head shall perform his/her duties.

56. The distribution of duties and, based on it, the annual and quarterly work plans of the Group shall be discussed at the Group meeting and approved by the council of the citizensʼ assembly.

Reports of Group members on the implementation of the work plan shall be heard at monthly meetings of the Group, and appropriate decisions shall be adopted accordingly.

A meeting of the Group shall be considered competent if at least two-thirds of its members are present, and a decision shall be deemed adopted if more than half of the members vote in favor.

57. The secretary of the Group shall keep minutes of meetings and monitor the implementation of decisions.

58. The Group shall report on its activities monthly to the council of the citizensʼ assembly and quarterly to the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

Chapter 41. Organization of the activities of the “Mahalla Oversight Group”

§ 1. Main purpose, tasks, rights and obligations of the “Mahalla Oversight Group”

581. The purpose of the “Mahalla Oversight Group” is to establish public oversight over the activities of state bodies and organizations by expanding the participation of the population in the management of state and public affairs.

582. The main tasks of the Mahalla Oversight Group shall include:

exercising public oversight over the consideration of public interests and public opinion in adopted normative legal acts, decisions, as well as state, sectoral and territorial development programs;

exercising public oversight over compliance with legislation in the field of protection of the rights and legitimate interests of citizens, legal entities and society;

exercising public oversight over the fulfillment by state bodies, organizations and their officials of tasks and functions assigned to them that affect social and public interests;

exercising public oversight over the activities of state bodies and organizations, and their officials, in the provision of public services;

exercising public oversight over the implementation by state bodies, organizations and their officials of agreements, contracts, projects and programs carried out within the framework of social partnership;

exercising public oversight over the activities of the assistant to the district (city) khokim on entrepreneurship development, employment and poverty reduction, the youth leader, the mahalla womenʼs activist, as well as preventive (senior) inspectors of internal affairs bodies in the mahalla.

583. In accordance with its assigned tasks, the Mahalla Oversight Group shall perform the following functions:

study the implementation of laws and other legislative acts in the relevant territory;

participate in the consideration of citizensʼ appeals on issues related to the activities of state bodies and organizations, and submit relevant proposals based on the results of their review;

analyze the results of work performed by employees of state bodies and organizations assigned to the mahalla;

develop proposals to eliminate shortcomings in the activities of state bodies and organizations, and participate in events devoted to discussing such proposals with their staff;

analyze the effectiveness of work carried out under adopted programs and prepare proposals to eliminate identified shortcomings;

participate in the consideration of draft normative legal acts and other decisions of state bodies and organizations of social significance;

submit proposals to relevant state bodies and organizations on taking measures in cases of detected violations of legislation in the field of environmental protection and rational use of natural resources;

develop proposals and recommendations based on the results of public oversight and submit them to relevant state bodies and organizations for consideration;

develop proposals aimed at eliminating problems and shortcomings identified as a result of public oversight.

584. In performing its tasks, the Mahalla Oversight Group shall cooperate with mass media, non-governmental non-profit organizations, as well as the council of the citizensʼ assembly, the Commission on social support and public oversight and other commissions of the citizensʼ assembly, as well as other public structures assisting the activities of the citizensʼ assembly.

585. In order to perform its main tasks and functions, the Mahalla Oversight Group shall have the right to:

send appeals and requests to state bodies and organizations;

participate in open meetings of collegial bodies of state bodies and organizations;

receive, in accordance with established procedure, information, statistics and other materials necessary for developing proposals and recommendations to improve the effectiveness of activities of state bodies and organizations;

organize public discussions on socially significant issues, as well as on draft normative legal acts and other decisions of state bodies and organizations;

conduct public hearings on issues related to the activities of state bodies, organizations and their officials that are of social significance or affect the rights and legitimate interests of citizens, legal entities and society;

carry out public monitoring by collecting, summarizing and analyzing information of public interest concerning the activities of state bodies, organizations and their officials;

conduct public expertise of draft normative legal acts;

hear, on a monthly basis at meetings of the mahalla council, reports of heads of relevant state bodies and organizations on work performed;

regularly hold discussions, including using information and communication technologies, in order to identify issues that most frequently cause public dissatisfaction;

submit materials to law enforcement bodies in cases where violations of the rights and legitimate interests of citizens, legal entities or society are identified;

cooperate with non-governmental non-profit organizations, mass media, other public commissions and structures of the citizensʼ assembly, as well as citizens, and organize seminars, round tables and other events for the performance of assigned tasks.

The Mahalla Oversight Group may also have other rights in accordance with legislation.

586. In carrying out its activities, the Mahalla Oversight Group shall:

comply with legislation on public oversight and the requirements of this Regulation;

observe restrictions established by legislation related to the activities of state bodies and organizations;

not interfere in the activities of state bodies, organizations and their officials carried out within their competence;

not create obstacles to the functioning of state bodies, organizations and their officials;

not allow violation of honor and dignity of citizens or interference in their private life;

not disclose information obtained in the course of public oversight if its disclosure is restricted by law.

§ 2. Formation of the composition of the Mahalla Oversight Group and organization of its activities

587. The Mahalla Oversight Group shall consist of the head, deputy head, secretary and members.

588. Membership of the Mahalla Oversight Group shall include citizens who enjoy authority in the mahalla, are socially active, serve as role models and possess significant life experience (excluding officials of state bodies and organizations), as well as representatives of non-governmental non-profit organizations, mass media and other institutions of civil society.

When forming the composition of the Mahalla Oversight Group, the principle of gender equality shall be observed, and persons with disabilities shall also be included.

The number of members of the Mahalla Oversight Group shall not be limited.

589. Members of the Mahalla Oversight Group shall be elected every five years by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

The Mahalla Oversight Group shall be headed by the chairperson of the citizensʼ assembly.

A candidate nominated for inclusion in the Group shall be considered elected if more than half of those present at the citizensʼ assembly (meeting of citizensʼ representatives) vote in favor.

If a member is removed from the Group before the expiration of the term, a new member shall be elected within one month by the meeting of the citizensʼ assembly (meeting of citizensʼ representatives).

5810. At its first organizational meeting, the Mahalla Oversight Group shall elect from among its members the deputy head and the secretary of the Group.

5811. Information about members of the Mahalla Oversight Group, as well as their contact details (telephone, postal and email addresses), and any amendments thereto, shall be published within five days from the date of their election in a separate section on the official websites of the district (city) khokimiyats and the Ministry of Poverty Reduction and Employment of the Republic of Uzbekistan (hereinafter — the website).

5812. The deputy head, secretary and members of the Mahalla Oversight Group may be removed from the Group in the following cases:

upon submission of an application for resignation;

in case of absence from meetings of the Group without valid reasons, as well as failure to fulfill obligations provided for in paragraph 585 of this Regulation;

upon entry into legal force of a court conviction against them;

in case of death, as well as if declared legally incapable, missing or deceased by a court decision that has entered into legal force.

5813. The head of the Mahalla Oversight Group shall:

lead and organize the activities of the Group;

convene meetings of the Group and determine the agenda;

chair meetings of the Group;

sign documents of the Group;

ensure the fulfillment of tasks assigned to members of the Group;

ensure the placement and regular updating on the website of information subject to mandatory disclosure regarding the activities of the Group;

perform other functions to ensure effective operation of the Group.

5814. In the absence of the head for valid reasons, his/her duties shall be performed by the deputy head.

5815. The secretary of the Mahalla Oversight Group shall:

ensure timely preparation of all necessary materials for meetings of the Group and request required documents and information from state bodies and organizations;

organize meetings of the Group in accordance with the agenda;

coordinate with the head the date, venue and list of invited persons for the meeting;

inform members of the Group and invited persons about the place, date and time of the meeting;

ensure that proposals and recommendations prepared as a result of public oversight are submitted to relevant state bodies and organizations.

5816. The distribution of duties and, on its basis, the annual and quarterly work plans of the Mahalla Oversight Group shall be discussed at the Group meeting and approved by the council of the citizensʼ assembly.

Reports of members on the implementation of the work plan shall be heard at monthly meetings of the Group, and appropriate decisions shall be adopted accordingly.

5817. A meeting of the Mahalla Oversight Group shall be considered competent if at least two-thirds (quorum) of its members are present.

If a quorum is not formed, the date of a new meeting shall be announced.

5818. Decisions of the Mahalla Oversight Group shall be adopted by a simple majority of votes of the members present at the meeting.

In case of a tie, the vote of the head of the Mahalla Oversight Group shall be decisive.

5819. Information, recommendations and proposals set out in the final document of the Mahalla Oversight Group shall be subject to mandatory consideration by state bodies and organizations, which shall adopt lawful decisions thereon.

5820. The Mahalla Oversight Group shall report on its activities monthly to the council of the citizensʼ assembly and quarterly to the citizensʼ assembly (meeting of citizensʼ representatives).

§ 3. Procedure for submitting and considering a mahalla chairpersonʼs request

5821. The mahalla chairperson shall have the right to send a request to officials of state bodies and organizations located in the relevant territory, requiring them to provide substantiated explanations or express their position on issues within their competence.

5822. Documents containing state secrets or other information protected by law may not be requested through a mahalla chairpersonʼs request.

5823. A mahalla chairpersonʼs request shall be sent only on issues related to the activities of the citizensʼ assembly. Sending such a request for personal interests not related to the activities of the citizensʼ assembly shall be prohibited.

5824. At a meeting of the Mahalla Oversight Group, the content of the mahalla chairpersonʼs request shall be discussed and, where necessary, it shall be recommended for consideration by the council of the citizensʼ assembly.

Based on the results of the discussion, a decision shall be adopted to approve or reject the request.

5825. If a positive decision is adopted by the Mahalla Oversight Group or the council of the citizensʼ assembly, the mahalla chairpersonʼs request shall be sent to the relevant official of the state body or organization no later than three days from the date of such decision.

5826. A mahalla chairpersonʼs request may be addressed to one or several officials of state bodies and organizations.

5827. A mahalla chairpersonʼs request shall be drafted in a concise, clear and understandable manner on the official letterhead of the citizensʼ assembly and signed by the mahalla chairperson.

5828. The mahalla chairpersonʼs request shall include:

a brief justification for sending the request;

the name, surname and patronymic of the person to whom the request is addressed;

requirements for submission of information (documents) or for verification of relevant data;

an indication that a response must be provided within fifteen days.

5829. The response to the mahalla chairpersonʼs request shall be signed by the official to whom the request was addressed or by the person acting on his/her behalf, and shall be sent to the chairperson of the citizensʼ assembly within fifteen days from the date of receipt of the request, with all requested documents attached.

5830. The response letter to the mahalla chairpersonʼs request shall be read out by the mahalla chairperson at a meeting of the Mahalla Oversight Group or, where necessary, at a meeting of the council of the citizensʼ assembly.

5831. The response to the mahalla chairpersonʼs request shall be discussed at a meeting of the Mahalla Oversight Group or the council of the citizensʼ assembly, and an appropriate decision shall be adopted.

Chapter 42. Organization of the activities of the “Mahalla Seven”

§ 1. Main purpose, tasks, powers, rights and obligations of the “Mahalla Seven”

5832. The purpose of the “Mahalla Seven” is to identify internal resources of the mahalla and mobilize them for the provision of social services and assistance.

5833. The main tasks of the “Mahalla Seven” shall include:

assisting the council of the citizensʼ assembly in ensuring implementation of laws and other legislative acts in the relevant territory, as well as in studying the socio-economic condition and needs of families;

adopting decisions on inclusion of individuals in the “Iron Register”, the “Youth Register” and the “Womenʼs Register”;

adopting decisions on provision of social assistance and allocation of subsidies to individuals through the “Iron Register”, “Youth Register”, “Womenʼs Register”, the Fund for Involving the Population in Entrepreneurship, the State Employment Promotion Fund, and the Fund for Supporting Handicrafts and Home-based Work. In this case, social assistance and subsidies shall be granted in accordance with the list approved by the Decree of the President of the Republic of Uzbekistan No. DP-209 dated 21 December 2023;

adopting collegial decisions on providing assistance from the “Sakhovat and Support” Fund based on conclusions submitted by a social worker, in order to prevent citizens from falling into difficult social situations and to assist those already in such situations;

participating in the consideration of citizensʼ appeals on issues related to the activities of state bodies and organizations, and submitting relevant proposals based on the results of their review;

exercising other powers in accordance with legislation.

5834. The provision set out in paragraph 4 of this Model Regulation that decisions of public structures are of a recommendatory nature shall not apply to decisions of the “Mahalla Seven” regarding provision of social assistance and allocation of subsidies to individuals.

5835. The “Mahalla Seven” shall have the right to:

request and obtain necessary information for its activities from state bodies and organizations in the established procedure;

in cases where violations of the rights and legitimate interests of socially vulnerable persons are identified, submit materials to law enforcement bodies;

adopt decisions on provision of types of social assistance and allocation of subsidies to socially vulnerable groups;

involve representatives of state bodies and organizations directly related to the provision of social services and assistance to individuals in the activities of the “Mahalla Seven”.

The “Mahalla Seven” may also have other rights in accordance with legislation.

5836. The “Mahalla Seven” shall be obliged to:

strictly comply with legislation and the requirements of this Model Regulation in its activities;

not allow violation of honor and dignity of citizens or interference in their private life;

not disclose personal information about private life that becomes known to members of the “Mahalla Seven”.

§ 2. Formation of the composition of the “Mahalla Seven” and organization of its activities

5837. The composition of the “Mahalla Seven” shall consist of 7 members, including the chairperson of the citizensʼ assembly, the assistant to the khokim, the youth leader, the womenʼs activist, the prevention inspector, the social worker and the tax inspector.

The “Mahalla Seven” shall be headed by the chairperson of the citizensʼ assembly.

Members of the “Mahalla Seven” shall carry out their activities on a voluntary (public) basis.

5838. The mahalla chairperson:

organizes and coordinates the activities of the “Mahalla Seven”;

ensures the performance by members of the “Mahalla Seven” of the tasks assigned to them;

convenes and conducts meetings;

represents the “Mahalla Seven” at meetings of the citizensʼ assembly (meeting of citizensʼ representatives) and the council of the citizensʼ assembly;

signs documents issued on behalf of the “Mahalla Seven”.

5839. The functions of the secretary of the “Mahalla Seven” shall be assigned to the assistant to the khokim attached to the mahalla.

5840. Issues within the competence of the “Mahalla Seven” shall be considered at its meetings.

Preparation of documents for meetings and notification of members shall be carried out by the secretary.

The assistant to the khokim, the youth leader, the womenʼs activist and the social worker shall be responsible, within the scope of their assigned duties, for preparing documents on inclusion of individuals in the relevant registers, their removal therefrom, as well as provision of social assistance and allocation of subsidies.

The secretary of the “Mahalla Seven” shall keep minutes of meetings and monitor execution of decisions.

5841. A meeting of the “Mahalla Seven” shall be deemed competent if at least two-thirds of its members (quorum) are present.

If a quorum is not reached, the date of a new meeting of the “Mahalla Seven” shall be announced.

5842. Decisions of the “Mahalla Seven” shall be adopted by a simple majority vote of members present at the meeting.

In the event of a tie, the vote of the mahalla chairperson shall be decisive.

5843. The “Mahalla Seven” shall report on its activities monthly to the council of the citizensʼ assembly of the mahalla and quarterly to the citizensʼ assembly (meeting of citizensʼ representatives).

Chapter 5. Final provisions

59. Liquidation and reorganization of public structures under the citizensʼ assembly shall be carried out by decision of self-government bodies of citizens when the relevant citizensʼ assembly is merged, divided, abolished or its boundaries are changed.

60. Persons guilty of violating the requirements of this Model Regulation shall be held liable in accordance with legislation.

on the certificate and breast badge of the chairperson of the citizensʼ assembly

Chapter 1. General provisions

1. This Regulation, in accordance with the Law of the Republic of Uzbekistan “On self-government bodies of citizens”, establishes the procedure for issuing a certificate and breast badge to the chairperson of the citizensʼ assembly, their use, as well as the procedure for issuing new ones in place of lost or damaged certificates and breast badges.

2. The certificate is a document confirming the authority and identity of the chairperson of the citizensʼ assembly.

The certificate does not replace the passport of the citizen of the chairperson of the citizensʼ assembly.

3. The breast badge of the chairperson of the citizensʼ assembly is a distinguishing sign identifying the holder as an official possessing the status of chairperson within the relevant territory.

The breast badge shall be worn on the left side of the chest.

4. The certificate and breast badge shall be issued to the chairperson of the citizensʼ assembly by the commission assisting in the organization and conduct of elections of chairpersons of citizensʼ assemblies of districts (cities) (hereinafter referred to as the assisting commission).

5. The chairperson of the citizensʼ assembly shall use the certificate and breast badge issued to him/her during the term of his/her authority.

6. Upon expiration of the term of authority of the chairperson of the citizensʼ assembly (including in cases of early termination of powers), the certificate and breast badge must be returned to the assisting commission.

Chapter 2. Form of the certificate and breast badge, procedure for production, supply, accounting and storage of certificate forms

7. The cover and forms of the certificate, as well as the breast badge, shall be produced at designated enterprises based on the order of the assisting commission, upon request of the Ministry of Mahalla and Support of the Elderly of the Republic of Uzbekistan.

Certificate forms are strict accountability documents and shall be produced on special paper with anti-counterfeiting protection elements in accordance with the description set out in Annex 1 to this Regulation.

Production of certificate covers and forms upon orders of other persons, including self-government bodies of citizens, is not permitted.

8. After a chairperson of the citizensʼ assembly is declared elected, he/she shall submit the following documents to the assisting commission no later than the next working day after the election:

the minutes and decision of the working group for organizing and conducting the election of the chairperson of the citizensʼ assembly (hereinafter — the working group), certified by the seal of the citizensʼ assembly;

a copy of the passport of the chairperson of the citizensʼ assembly;

two color photographs sized 3x4.

9. Certificate forms shall be filled in on the basis of a copy of the passport of the chairperson of the citizensʼ assembly and the minutes and decision of the working group. After entering the necessary information, the photograph of the certificate holder shall be affixed to the form.

The certificate shall be signed by the chairperson of the assisting commission and certified with the seal of the citizensʼ assembly. The completed certificate shall be laminated with a transparent film.

10. The certificate shall have a serial number. Issued certificates shall be registered in the Register for recording the issuance and return of certificates of chairpersons of citizensʼ assemblies (hereinafter — the register), maintained by the assisting commissions in accordance with the form set out in Annex 2 to this Regulation.

The serial number of the certificate must correspond to the serial number in the register.

11. The register shall include: the serial number of the certificate, the surname, name and patronymic of the certificate holder and the person who signed it, the validity period of the certificate, the photograph of the certificate holder, signature and date confirming receipt of the certificate, date of return of the certificate, surname, name and patronymic, position and signature of the person who received it, and a note on destruction of the certificate (date and number of the act).

The register shall be stitched, sealed, and kept by the assisting commission during its term of authority.

After the announcement of the next elections, the register shall be transferred to the newly formed assisting commission.

12. The breast badge shall be produced in accordance with the description and sample provided in Annex 3 to this Regulation.

13. The certificate and breast badge shall be issued within one month from the date of the election and recognition of the chairperson of the citizensʼ assembly as elected.

14. Certificates damaged or rendered unusable during completion shall be deemed invalid and destroyed in accordance with the established procedure.

15. The certificate and breast badge shall be issued to the chairperson of the citizensʼ assembly upon presentation of the passport of a citizen of the Republic of Uzbekistan.

16. Upon issuance of the certificate, the chairperson of the citizensʼ assembly shall sign the register confirming receipt of the certificate.

17. In case of loss or damage of the certificate or breast badge, a new certificate and breast badge may be issued upon application of the chairperson of the citizensʼ assembly.

The certificate shall also be replaced in case of change of the surname, name or patronymic of the chairperson.

18. An application for issuance of a new certificate due to loss shall be accompanied by a document confirming publication in the media of a notice on the loss of the certificate and its invalidity, as well as two color photographs sized 3x4.

An application for issuance of a new certificate due to damage shall be accompanied by the damaged certificate and two-color photographs sized 3x4.

19. A lost certificate shall be deemed invalid from the date of publication of the notice by the chairperson of the citizensʼ assembly in the media.

A damaged certificate shall be deemed invalid from the date a new certificate is issued.

20. Certificates whose validity period has expired or which have become unusable shall be destroyed, and an act shall be drawn up accordingly. Certificates shall be destroyed by the assisting commission.

Chapter 3. Final provisions

21. The chairperson of the citizensʼ assembly shall be personally responsible for the safekeeping of the certificate and breast badge. Transfer of the certificate and breast badge to other persons is prohibited.

22. Persons guilty of violating the requirements of this Regulation shall be held liable in accordance with the legislation.

The cover of the certificate of the chairperson of the citizensʼ assembly shall be dark green in color, measuring 60 × 90 millimeters, and made of leather or materials replacing it. On the upper central part of the front side of the certificate, the text “FUQAROLARNING OʻZINI OʻZI BOSHQARISH ORGANI” (Self-government body of citizens) shall be placed in gold color in 14-point font, and below it — the text “GUVOHNOMA” (Certificate).

The text inside the certificate shall be placed on two pages.

The inscriptions on the inner left side of the certificate shall be made in the Latin alphabet. In the upper central part of the inner left side, the name of the relevant region and district (city) shall be indicated in two lines. Below, in the center, the words “GUVOHNOMA №” (Certificate No.) shall be written, where the serial number of the certificate shall be indicated. Under it, in two lines, the surname, name and patronymic of the chairperson of the citizensʼ assembly shall be written, as well as the name of the respective citizensʼ assembly. Further below, the date of the election shall be indicated on one line, and the validity period of the certificate on the second line, with the validity period set until the next elections. At the bottom, the words “Koʻmaklashuvchi komissiya raisi” (Chairperson of the assisting commission) shall be indicated, followed by the signature, initials (name and patronymic) and surname of the chairperson of the relevant assisting commission. To the left, the letters “M.Oʻ” shall be placed.

The inscriptions on the inner right side of the certificate shall be made in the Cyrillic alphabet. In the upper central part of the inner right side, the name of the administrative-territorial unit shall be indicated. On the next line, in the center, the words “GUVOHNOMA №” (Certificate No.) shall be written, where the serial number of the certificate shall be indicated. Below, on the left side, a photograph measuring 3 × 4 cm shall be placed. To the right of the photograph, in the center, the surname, name and patronymic of the chairperson of the citizensʼ assembly shall be written in two lines, as well as the name of the respective citizensʼ assembly. Further below, the date of the election shall be indicated on one line, and the validity period of the certificate on the second line, with the validity period set until the next elections. At the bottom, the words “Koʻmaklashuvchi komissiya raisi” (Chairperson of the assisting commission) shall be indicated, followed by the signature, initials (name and patronymic) and surname of the chairperson of the relevant assisting commission. To the left, the letters “M.Oʻ” shall be placed.

The inner pages of the certificate shall be made of special light-yellow paper and covered with a transparent film. The text and numbers in the certificate shall be printed in black.

Description of the breast badge of the chairperson of the citizensʼ assembly

The breast badge of the chairperson of the citizensʼ assembly (hereinafter — the breast badge) is shield-shaped, measuring 23 × 28 millimeters, and made of a copper alloy.

At the center of the breast badge, there is an arch symbolizing the traditional gate of the mahalla. Behind it, against the background of sun rays rising between high mountains, rivers flowing from the mountains toward valleys and oases are depicted.

On the left side of the breast badge, modern buildings are depicted, while on the right side, images of a village, fields, and trees represent a well-maintained and prosperous mahalla.

At the lower part of the breast badge, a white ribbon is depicted, inside which the inscription “MAHALLA RAISI” (Chairperson of the mahalla) is placed in gold color.

Below the inscription “MAHALLA RAISI”, cultivated green fields are depicted.

The edges of both the front and back sides of the breast badge are raised.

On the reverse side of the breast badge, a circular fastening device is installed for attaching it to clothing.

Regulation

on the procedure for organizing records management in citizensʼ assemblies

Chapter 1. General provisions

1. This Regulation, in accordance with the Law of the Republic of Uzbekistan “On self-government bodies of citizens”, establishes the procedure for organizing records management in citizensʼ assemblies.

2. In order to ensure proper organization of records management, the chairperson of the citizensʼ assembly shall designate one of the employees as responsible for organizing and maintaining records management in the citizensʼ assembly (hereinafter — the responsible employee).

The responsible employee prepares materials related to holding meetings of the citizensʼ assembly (assembly of citizensʼ representatives) and meetings of the council of the citizensʼ assembly, ensures timely delivery of decisions of the citizensʼ assembly, its council, and the chairperson to the executors, and maintains records management.

Organization and maintenance of records management in commissions established in the main areas of activity of the citizensʼ assembly, the audit commission under the citizensʼ assembly, as well as in public structures assisting the activities of the citizensʼ assembly, shall be assigned to the secretaries of these structures.

3. The chairperson of the citizensʼ assembly shall be personally responsible for ensuring proper organization of records management in the citizensʼ assembly and its bodies, as well as for its effective conduct using modern information and communication technologies in accordance with this Regulation.

4. The responsible employee shall familiarize members of the council of the citizensʼ assembly with the Constitution and laws of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers of the Republic of Uzbekistan, and other legislative acts, as well as newly recruited employees with the structure of the citizensʼ assembly, this Regulation, the main rules for monitoring and verifying execution of documents, internal labor discipline, and other documents regulating the activities of the citizensʼ assembly.

At the same time, it shall be ensured that members of the citizensʼ assembly are provided with the opportunity to review documents, decisions, and other materials affecting their rights and legitimate interests.

5. When the responsible employee is dismissed or transferred to another position, documents shall be handed over to the newly appointed responsible person (until such person is appointed — to the chairperson of the citizensʼ assembly) on the basis of a handover report.

Chapter 2. Organization of records management

6. In accordance with legislation, the following documents shall be prepared in the citizensʼ assembly:

minutes of the citizensʼ assembly meeting (meeting of citizensʼ representatives) indicating the date of the meeting, the number of citizens present, the agenda and the decisions adopted;

minutes of the meeting of the council of the citizensʼ assembly indicating the date of the meeting, the number of members present, the agenda and the decisions adopted;

documents of commissions on the main areas of activity of the citizensʼ assembly, as well as minutes of commission meetings indicating the date of the meeting, the number of members present, the agenda and the decisions adopted;

documents and minutes of meetings of the audit commission under the citizensʼ assembly;

documents of the public structure “Parentsʼ University” under the citizensʼ assembly, as well as minutes of its meetings indicating the date of the meeting, the number of members present, the agenda and the decisions adopted;

documents of the “Council of Elders” group under the citizensʼ assembly, as well as minutes of its meetings indicating the date of the meeting, the number of members present, the agenda and the decisions adopted;

documents of the “Fidokor Yoshlar” public patrol group, as well as minutes of its meetings indicating the date of the meeting, the number of members present, the agenda and the decisions adopted;

documents of the entrepreneurship advisory center, if such a center is established under the citizensʼ assembly;

decisions of the citizensʼ assembly meeting (meeting of citizensʼ representatives), decisions of the council of the citizensʼ assembly, as well as decisions and assignments of the chairperson of the citizensʼ assembly.

7. Official correspondence of the citizensʼ assembly with other organizations shall be carried out through letters sent by post, as well as through electronic document exchange. Prompt information shall be transmitted via e-mail, fax, or in the form of telephone messages and telegrams.

8. The chairperson of the citizensʼ assembly shall sign the minutes of meetings of the citizensʼ assembly (meeting of citizensʼ representatives), meetings of the council of the citizensʼ assembly, as well as letters sent to other organizations.

9. Minutes shall be signed by the chairperson of the citizensʼ assembly, and in his/her absence — by one of the deputy chairpersons who presided over the meeting (deputies of the chairperson of the citizensʼ assembly for law and order issues, for family, women and socio-spiritual issues, and for improvement, household plots and entrepreneurship issues).

Minutes related to the mandatory inspection of the financial and economic activities of the citizensʼ assembly upon expiration of the term of office of the chairperson shall also be signed by the chairperson of the audit commission.

10. For the purpose of ensuring convenience in records management, the following files shall be maintained in the citizensʼ assembly:

normative legal acts regulating the activities of the citizensʼ assembly;

documents of the citizensʼ assembly meeting (meeting of citizensʼ representatives);

documents of the meetings of the council of the citizensʼ assembly;

documents of commissions on the main areas of activity of the citizensʼ assembly;

documents of the audit commission of the citizensʼ assembly;

documents of the public structure “Parentsʼ University” under the citizensʼ assembly;

documents of the “Council of Elders” group under the citizensʼ assembly;

documents of the “Fidokor Yoshlar” public patrol group;

documents of the “Womenʼs Advisory Council”;

documents of the entrepreneurship advisory center under the citizensʼ assembly;

documents on other matters within the competence of the citizensʼ assembly.

Files shall be compiled based on regulations governing the citizensʼ assembly and its bodies.

The nomenclature of documents and their retention periods shall be indicated when maintaining files.

11. The maintained files shall be signed by the relevant deputy chairperson of the citizensʼ assembly and approved by the chairperson of the citizensʼ assembly.

Storage of files shall be ensured by the responsible employee.

Documents of the commission on working with women, the public structure “Parentsʼ University” and the “Womenʼs Advisory Council” shall be maintained, signed and approved by the womenʼs activist of the mahalla.

Chapter 3. Conduct of records management

12. Acceptance of documents received by the citizensʼ assemblies and their primary processing (registration, preparation for submission to the chairperson of the citizensʼ assembly) shall be carried out by the responsible employee.

13. Envelopes containing documents, including registered mail envelopes, shall be opened by the responsible employee. In doing so, the correctness of delivery and integrity of the envelope shall be checked. If the envelope is damaged or the documents and attachments contained therein are incomplete, the sender shall be immediately notified, and a report shall be drawn up in two copies, one of which shall remain with the responsible employee, and the other shall be sent to the organization (official) that dispatched the document.

Documents received by the citizensʼ assembly by mistake shall, within no more than five days, be placed by the responsible employee into a new envelope and sent to the relevant organization (official) together with the original envelope, and the sender shall be notified accordingly.

14. Envelopes of received documents shall be destroyed (except in cases where the senderʼs address and the date of dispatch can be determined only from the envelope).

15. Incoming documents shall be divided into those subjects to registration and those not subject to registration.

Documents specified in Annex 1 to this Regulation shall not be registered. Incoming documents subject to registration shall be stamped with a registration mark.

Appeals of individuals and legal entities shall be registered separately and recorded regardless of their source.

16. Documents received by the citizensʼ assembly shall, after registration in the Register of incoming documents of the citizensʼ assemblies in the form specified in Annex 2 to this Regulation, be submitted to the chairperson of the citizensʼ assembly.

17. Work with documents prepared by the citizensʼ assembly and those received from other organizations (officials) shall be carried out in the following manner:

the chairperson of the citizensʼ assembly shall assign a resolution on the document, indicating key instructions for execution and the deadline;

the reviewed document shall be returned to the responsible employee for entering the resolution into the control card;

the document shall be forwarded to the relevant recipients.

Submission of incoming documents for review shall be carried out on the day of their receipt, and forwarding of reviewed documents according to their assignment shall be carried out on the day the resolution is issued.

If several employees are designated as responsible for execution in the resolution, the employee whose surname is listed first shall be considered responsible for execution.

18. Preparation and dispatch of outgoing documents shall be carried out by the responsible employee.

Before placing documents in envelopes, their proper execution, наличие приложений, and correspondence between the number of copies and the number of recipients shall be verified. Improperly executed documents shall be returned to the executor for correction.

For documents sent by registered mail, a list of recipient organizations (officials) shall be prepared, indicating the surname of the responsible person and the date of dispatch.

Documents submitted to the responsible employee for dispatch shall be executed and sent on the same day or within no more than one day.

19. The responsible employee shall regularly record incoming and outgoing documents, including those prepared by employees of the citizensʼ assembly, and shall summarize this information at the end of the year.

Records of appeals of individuals and legal entities shall be maintained separately.

20. The index of incoming (outgoing) documents shall consist of the corresponding index from the file nomenclature and the registration number in the form specified in Annex 3 to this Regulation, except for decisions and minutes of meetings. Their indices shall consist of registration numbers corresponding to the type of document.

21. Registration of documents shall be carried out in control cards in the form specified in Annex 4 to this Regulation. The composition of requisites of the control card may be supplemented with columns such as “control marks”, “executors”, “executorʼs signature”, “execution status” and others.

When registering documents in control cards, only documents (requests) prepared within the citizensʼ assembly or received from other organizations shall be registered independently. Documents sent as responses shall be reflected in the same control card.

The calendar scale of control cards shall be used to monitor execution deadlines of documents. The date by which the document must be executed shall be indicated therein.

In the “Correspondent” column, the name of the organization that sent or is to receive the document shall be indicated. When preparing an internal document of the citizensʼ assembly, the name of the citizensʼ assembly shall be indicated.

In the “Date of receipt and index of the document” column, the date of receipt and the index assigned in the citizensʼ assembly shall be indicated.

In the “Date and index of the document” column, the date and index assigned by the sending organization shall be indicated. When registering outgoing or internal documents of the citizensʼ assembly, the date of signing and the index or registration number shall be indicated in this column.

In the “Brief content” column, the type of document, its title or a brief description shall be indicated.

In the “Resolution and information about the executor” column, the surname of the person assigned, a concise and clear instruction on resolving the issue, the execution deadline, the author of the resolution and the date shall be indicated.

In the “Information on execution of the document” column, the specific resolution of the issue, as well as the date and index of the response letter, shall be indicated. If preparation of a response letter is not required, a record shall be made indicating when, by whom and how the issue was resolved.

In the columns “Executorʼs signature confirming receipt of the document” and “Date”, the executor shall sign and indicate the date of receipt of the document.

In the “Control marks” column, marks on monitoring execution deadlines shall be made, and specific reasons for delays in execution shall be indicated.

The columns “Fund No.”, “Inventory No.”, and “File No.” of the control card shall be filled in the archive.

Control cards shall be printed depending on the volume of work of the citizensʼ assembly.

Control cards shall be arranged in chronological order — from earlier to later dates.

22. A control card index (card file) shall be maintained in the citizensʼ assemblies. At the same time, in order to prevent loss of information, specialized automated systems may be used in compliance with information security requirements.

23. The control card index for citizensʼ appeals shall be arranged alphabetically by surnames and also by registration numbers.

24. Each type of document (decision, minutes, letter, etc.) shall have a clearly defined set of requisites (structural elements) and a standard order of their placement.

25. The following basic requirements shall apply to drafting and execution of documents:

indication of the author of the document (name and logo of the citizensʼ assembly, as a rule, on the document form);

indication of the type of document, preparation of a title, indication of the addressee and date;

indexing of the document;

signature of the responsible person who prepared the document;

authentication of the document (signing, sealing);

mark on execution of the document and its placement in the file.

26. Forms of A4 (210 x 297 mm) and A5 (148 x 210 mm) formats shall be used for drafting documents. The document form shall contain requisites in accordance with Annex 5.

If the need for a specific type of document exceeds 200 copies per year, it is allowed to prepare forms by printing.

Forms shall have margins of at least 20 mm on the left, 10 mm on the top, and 8 mm on the right and bottom.

27. Pages of documents consisting of two or more sheets shall be numbered starting from the second page. Page numbers shall be placed at the top center of the sheet in Arabic numerals, without the word “page” or punctuation marks.

28. The name of the type of document shall be indicated in each document (except letters).

29. The title of the document shall be concise and clearly reflect the content of the main text. Titles are recommended to be formulated in accordance with the document type. For example:

decision (on what?): “On acceptance of an application for financial assistance”, minutes of a meeting (of what?): “of the meeting of the commission on strengthening family values”.

The title shall be written on the left side of the page. Titles shall not be used for telegrams and memoranda prepared in A5 format.

30. Documents shall be sent to organizations, structural units or officials with indication of the addressee. The name of the organization and the structural unit shall be indicated in the nominative case. For example:

When a document is sent to the head of an organization, the name of the organization shall be included in the title of the recipient. For example:

If a document is sent to five or more addresses, a distribution list shall be prepared, and one recipient shall be additionally indicated (in writing or printed form) on each document. For example:

If a document is sent to an individual, the postal address shall be indicated first, followed by the initials and surname of the recipient. For example:

31. When indicating the date of documents, the year, day and month shall be indicated in Arabic numerals. For example: 22.04.2021.

In documents containing financial information, it is permitted to indicate the date using both words and numerals. For example: 23 April 2021.

32. Internal approval of a draft document shall be formalized by visas, including the personal signature, initials, surname and date of signing, in addition to the signatures of the deputy chairperson of the citizensʼ assembly for law-and-order issues and the womenʼs activist of the mahalla. Where necessary, the position of the approving person shall also be indicated.

Additions and objections to the document shall be presented on a separate sheet. For example:

Visas shall be placed below the “Signature” requisite or on the reverse side of the last page of the document.

In external approval (with other organizations), an approval stamp and approval note shall be executed.

33. The “Signature” requisite shall include the position of the person signing the document (full if not on a form, abbreviated if on a form), personal signature and its deciphering. For example:

If a document is signed by several officials, their signatures shall be arranged from top to bottom according to their positions.

If a document is signed by persons holding equal positions, their signatures shall be placed on one line.

In the absence of the chairperson of the citizensʼ assembly for a prolonged period, documents shall be signed by the person assigned to temporarily perform his/her duties. In this case, the actual position and surname of the signing person shall be indicated. It is not allowed to sign by placing a slash before the title or using the word “for”.

34. A document subject to approval by the chairperson of the citizensʼ assembly shall contain an approval stamp including the word “Approved”, the position of the approving person, personal signature, initials and surname, and the date. For example:

The approval stamp shall be placed in the upper right corner of the document. After the approval signature, the seal of the citizensʼ assembly shall be affixed.

35. Instructions on execution of a document shall be given in the form of a resolution of the chairperson of the citizensʼ assembly. The resolution shall include the following mandatory elements:

surname of the executor (or executors);

content of the assignment;

deadline for execution (where necessary);

signature of the chairperson of the citizensʼ assembly;

date of the resolution. For example:

36. familiarization with the content of documents in the citizensʼ assembly shall be carried out by means of relevant marks.

A mark on receipt of the document shall be placed at the bottom of the first page of the document.

A mark indicating that the document has been taken under control shall be placed in the upper right corner of the first page of the document by writing the word “Control” or placing the symbol “C”.

The mark confirming execution of the document and its placement in the file shall include:

if there is no supporting document confirming execution — brief information; if there is such a document — reference to its date and number;

the word “To file”;

the file number according to the file nomenclature;

the date of placing the document in the file;

signature of the executor.

Marks on execution of controlled documents shall be placed in accordance with the established procedure (decision of the citizensʼ assembly meeting — after execution by the relevant decision; assignment of the chairperson of the citizensʼ assembly — by the resolution of the chairperson; others — by employees of the citizensʼ assembly).

The mark “To file” indicates completion of work on the document.

Each document shall contain a mark identifying the executor. Such a mark shall be placed on each copy of the document at the lower left part of the last page, or, if there is no space, on the reverse side, and shall include the surname of the executor (the employee who prepared the document) and the official telephone number. 37. If a document has attachments, a mark on attachments shall be made as follows.

The text shall indicate the presence of an attachment. For example:

“Measures shall be taken to assist in employment of citizens who have worked abroad and reside on ʻGhunchaʼ street, according to the list provided in the attachment.”

Attachments to administrative documents shall contain a mark in the upper right corner of the first page in the following form:

If there are several attachments, they shall be numbered.

If the text of the document does not mention attachments, a list indicating the number of pages and copies of the attachments shall be provided.

If a document with its own attachments is enclosed, a mark shall be made as follows:

If the attachment is not sent to all recipients, the mark shall be made as follows:

38. A copy of a document is a reproduction of all requisites of the document. An extract is a copy of part of a document.

Copies (extracts) of documents shall be issued with the permission of the chairperson of the citizensʼ assembly. When forming personal files of employees, it is allowed to make copies or extracts of documents issued by other organizations and necessary for resolving relevant matters (diplomas, birth certificates, and similar documents).

A copy (extract) of a document shall be prepared on the general letterhead of the council of the citizensʼ assembly and certified by the signature of the responsible employee confirming its authenticity.

If the copy is not prepared on a letterhead but is taken from an original prepared on a letterhead, the text of the letterhead shall be fully reproduced. The mark “Copy” shall be placed in the upper right corner of the first page. The certification shall be made in the following form:

The certification shall be placed below the “Signature” requisite.

When a copy (extract) is sent to another organization or issued to individuals, the certification shall be affixed with a seal.

39. In order to ensure proper storage and accounting of forms, each type of form (decision, letter) shall be numbered.

The number shall be placed on the upper left part of the reverse side of the form.

40. When preparing a response letter to an incoming document, the number and date of the incoming letter shall be indicated.

41. At each meeting of the citizensʼ assembly (meeting of citizensʼ representatives), minutes shall be kept indicating the date of the meeting, the number of members of the citizensʼ assembly present, the agenda and the decisions adopted.

The minutes of the meeting shall be executed in the form specified in Annex 6 to this Regulation.

The minutes and decisions of the citizensʼ assembly meeting (meeting of citizensʼ representatives) shall be signed by the chairperson of the citizensʼ assembly. In the absence of the chairperson, one of his/her deputies who presided over the meeting shall sign.

42. The date of the minutes shall be the date of the meeting. The serial number of the minutes shall be assigned in chronological order throughout the year. Numbering shall restart from the beginning of the next year.

43. The text of the minutes shall consist of an introductory and a main part. In the introductory part of the minutes, the number of participants of the meeting, as well as the surnames, names and patronymics of invited persons shall be indicated.

The minutes shall indicate the name, initials and surname of the presiding person, the issues under discussion, the names, initials and surnames of the speakers on these issues, and the agenda with the time regulation.

The main part of the minutes shall be divided into sections in accordance with the agenda items. Each section shall be structured in the sequence: “heard — spoke — resolved”.

44. The date of the minutes shall be the date on which the meeting was held.

45. The minutes shall be executed and signed within no more than 3 days from the date of the meeting.

46. Minutes of meetings of the council of the citizensʼ assembly, commissions on the main areas of activity of the citizensʼ assembly, the audit commission, as well as public structures assisting the activities of the citizensʼ assembly shall be executed in accordance with paragraphs 42 — 46 of this Regulation.
