Article 701. Conducting a Tender Among Qualified Participants

A tender among qualified participants may be carried out among the participants who have passed the preliminary qualification selection in accordance with Article 37 of this Law.

The state customer shall invite all participants who have passed the preliminary qualification selection to participate in the tender or may determine a limited number of participants and a list of qualified participants from among them, based on the complexity of the characteristics of the procured goods (works, services), the participants' potential, and work experience in the timely production of quality products, performance of works, and provision of services.

When determining the limited number of participants and the list of qualified participants, the state customer shall objectively determine the level of the participants in accordance with the basic principles of public procurement and shall send them proposals to participate in the tender.
