Article 111. Principle of Stability
On public procurement (ZRU-684-son) · Date: 22.04.2021 · In force
Stability in public procurement shall be based on the execution of public procurement taking into account the short-term, medium-term, and long-term economic, ecological, and social consequences of processes such as the state customer's identification of needs, preparation for procurement, conducting of procurement procedures, determination of the winner, conclusion of contracts, as well as the disposal (utilization) of these goods for the purpose of protecting the health of citizens and the environment from the harmful effects of waste generated after the goods have lost their consumer properties, and also the evaluation of final results.
When applying the principle of stability, state customers must take into account the following:
the needs and opportunities for stimulating favorable innovative solutions in the market, as well as new, modern approaches that respond more fully to the requirements of stability;
the costs of purchasing, using, servicing, and utilizing the procured goods, taking into account their advantages regarding their functional and operational characteristics throughout their entire life cycle;
the environmental impact, including climate change, resulting from the costs of energy, water, raw materials, consumables, and spare parts associated with the production, delivery, commissioning, and use of the procured goods, as well as the execution of contracts for works or services, decommissioning of the facility, restoration of the facility or termination of the contract, and other measures that may be required during the life cycle of the procured good;
social consequences, including the support of socially vulnerable groups or categories of the population in accordance with the current social development policy, as well as the impact on improving the quality of education, the level of professional training, the well-being of citizens, and the competitiveness of the economy;
the establishment of ecological requirements in forming orders and determining suppliers of goods, the prevention of environmental pollution, and the promotion of the purchase of environmentally friendly products, or the assistance in the sustainable development of the national economy by creating favorable conditions for suppliers of goods made from secondary raw materials and waste.
