ANNEX No. 1 to the Decree of the President of the Republic of Uzbekistan dated July 6, 2020 No. UP-6019
STRATEGY
for the development of competition in commodity and financial markets in 2020 - 2024
Chapter 1. Conditions and Need for Adoption of Strategy
Currently, the creation of an effective competitive environment and the gradual reduction of monopoly on the market of goods and services remain a priority area for solving problems of further development and liberalization of the economy.
To this end, measures are being taken to reduce the participation of the state in the country's economy and the transition to market mechanisms is being carried out.
In recent years, in the field of entrepreneurial activity, the tax burden has been reduced and 86 separate licensed types of activities and permission procedures have been canceled, including by combining 38 types into 16, reducing the processing time for 25 types and centralizing the issuance of 14 licenses and permits.
There has been a consistent development of the business sector; in the last three years alone, the number of operating business entities has increased by 25 percent.
The measures taken ensured the development of competition in many markets for food products (soft drinks, juices, bread, bakery products, meat and dairy products, confectionery and others) and certain markets for non-food products (furniture, carpets and rugs, textile products and others) produced by domestic producers. The monopoly of large companies has been eliminated in the market for building materials, cable and wire products, and money transfer services.
The exchange mechanism created made it possible to equally provide market participants with highly liquid and monopoly types of raw materials and materials. Currently, 65 percent of the turnover of the Uzbek Republican Commodity and Raw Materials Exchange falls on monopoly products.
As a result of the reforms carried out in recent years, the number of monopoly enterprises has more than halved.
At the same time, the following systemic problems remain unresolved, negatively affecting the competitive environment in the country's economy:
excessive state participation in the economy;
over-regulation of prices;
ineffective system of benefits and preferences;
high regulatory burden on business entities and lack of interest of sectoral regulatory bodies in the development of competition;
abuse of natural monopoly position;
imperfection of legal mechanisms to combat anti-competitive manifestations.
§ 1. Excessive Participation of the State in the Economy
Currently, economic entities with the participation of the state dominate the commodity and financial markets, for example, 80 percent of monopoly organizations have a state share or are controlled by economic entities with a state share.
In connection with the unsettledness in the legislation of the issue of the ownership of economic entities by the state and the implementation of control by the state, difficulties remain in determining the degree of participation of the state in the economy.
Economic entities with the participation of the state create structures under their control in the form of state unitary enterprises (SUEs) and subsidiaries that negatively affect competition. Currently, the number of such enterprises is more than 4,300, including in the form of joint-stock companies and limited liability companies - more than 1,300, in the form of state unitary enterprises - more than 1,800 and their affiliates - more than 1,100.
Underdeveloped market environment and excessive participation of the state in the economy leads to inefficiency in the activities of individual economic entities with the participation of the state, which is compensated by state support in the form of cross subsidies, tax and customs benefits, preferences and concessional loans.
There is a high concentration of government participation and powers in financial and capital markets (stock exchanges, central depository, banks), which gives rise to a conflict of interests and hinders the development of market mechanisms.
For example, a monopoly of the National Bank for Foreign Economic Activity of the Republic of Uzbekistan JSC, which belongs to the state, has been established for servicing settlements on transactions with securities on the stock exchange. Overall, 83 percent of the banking sector operates with government participation.
§ 2. Excessive Price Regulation
To date, state regulation of prices (declaring, approving, setting fixed or cap prices (tariffs), a regulating coefficient, setting margins and a marginal level of profitability and other methods of price regulation) is carried out in relation to more than 30 goods and services.
At the same time, despite the fact that in the field of natural monopolies tariffs are regulated for 10 types of goods (works, services), in fact, 137 different price levels are applied, set based on the categories of consumers and suppliers, as well as the territorial principle.
The cost-based pricing method used by monopoly enterprises and natural monopoly entities consists of a scheme for adding a minimum profit to costs, which leads to an unreasonable increase in costs, does not stimulate a decrease in production costs, and the increase in costs is in turn compensated by direct price increases and tariffs for consumers.
§ 3. Ineffectiveness of the Provision of Benefits and Preferences
The absence of instruments for antimonopoly regulation of the provision of state aid leads to inefficiency of the benefits and preferences provided and has a negative impact on the competitive environment.
In recent years, more than 40 thousand business entities, namely 12 percent of the total number of operating business entities, have been provided with tax incentives. This situation creates unequal conditions in the commodity and financial markets.
§ 4. High Regulatory Burden on Business Entities and the Lack of Interest of Sectoral Regulatory Bodies in the Development of Competition in their Industry
The activities of ministries and departments to promote competition in the industries regulated by them remain extremely ineffective. Only 11 out of 38 state bodies operating in the economic sphere are directly entrusted with the functions of developing a competitive environment in their industry.
In addition, a full-fledged system for assessing the regulatory impact and impact on the competitive environment of acts of legislation has not been introduced.
As a result, a difficult and complex licensing system remains, which provides for the licensing of more than 266 types of activities and more than 137 types of licensing procedures under the current 61 licenses, as well as in more than 6 thousand normative legal acts and 40 thousand documents of technical regulation that directly affect business, artificial barriers limiting the access of business entities to markets remain.
Despite the consolidation in the legislation of all the basic guarantees of freedom to carry out entrepreneurial and investment activities, according to the World Bank, in recent years in Uzbekistan, the net inflow of foreign direct investment remains low and amounts to 0.5-1.2 percent in relation to GDP, in the Index of Economic Freedom the country ranks 114th out of 180 countries, the indicator of the Freedom of Investment Indicator is 20 out of 100.
§ 5. Abuse of the Natural Monopoly Position
The presence of markets with a limited competitive environment, primarily the spheres of natural monopolies, affects interconnected markets, in in most cases by monopolizing them.
Despite the prohibition of the use by natural monopoly entities of their position to restrict competition in the markets for goods (works, services) that are not classified as natural monopolies, established in the legislation on natural monopolies, in practice, markets that have the ability to ensure interconnected competition, for example, in the field of railway transport - when selling railway tickets, repairing freight cars, serving restaurant cars, cleaning wagons and others, are currently monopolized.
§ 6. Imperfection of Legal Mechanisms to Combat Anti-Competitive Manifestations
There are no effective mechanisms to eliminate barriers to entry into markets, as well as to combat the monopoly of large enterprises and cartel agreements, to prevent unfair competition, and the independence of the antimonopoly authority in decision-making is practically limited.
The system of preventive and proactive measures to prevent the restriction of competition has not been formed, the mechanism for analysis and effective antimonopoly control over merger and acquisition of large enterprises has not been established, the legal mechanisms for restraining competition in the bidding process remain ineffective, and key performance indicators of the antimonopoly authority have not been developed.
