Article 29. Expert in administrative proceedings
On administrative procedures (LRU-457-son) · Date: 08.01.2018 · In force
In order to give an opinion on matters requiring special knowledge in the field of science, technology, art or craft, the administrative body may appoint an expert.
When appointing experts and determining the range of issues that must be clarified by experts, the opinion of all participants in the administrative proceedings is taken into account.
The expert has the right to get acquainted with the materials of the administrative case relating to the subject of the examination, write out the necessary information from them or make copies, ask questions to the persons participating in the administrative proceedings and witnesses, take part in the on-site examination, attestation and examination events and other actions, aimed at conducting an expert assessment. An expert may refuse to give an opinion if the materials presented to him are insufficient for conducting an expert examination or if he does not have the necessary knowledge to perform the duties assigned to him.
Based on the results of his research, the expert presents an expert opinion. At the request of the administrative body or other participants in the administrative proceedings, the expert must provide additional clarifications on the opinion.
