Parents shall have the right to demand the return of their child from any person who holds him/her in violation of the law. In the event of a dispute, the parents may apply to the court for protection of their rights. When considering these claims, the court may - taking into account the child's opinion - dismiss the parents' claim if it concludes that the child's surrender to his/her parents is not in concord with the child's interest.
If the court finds that neither the parents nor the person who has the child are capable of ensuring the child's proper upbringing and development, the court shall place the child into the care of the guardianship and trusteeship body.
